DAF DISCUSSIONS - NEDARIM 28

kerfish asks:

The Ran in nedarim daf 28b (I think its there) says there is no dini dimalchus in eretz yisrael under a Jewish king because the king doesnt own the land. Why does the king not own the land? And what does this have do do with Jewish king? What if there is a goying king in Irael? Is there dini demalchus according to the Ran?

kerfish,

The Kollel replies:

The Ran is in Nedarim 28a, DH b'Moches. He writes that the king is not able to expel the citizens from Eretz Yisrael because the whole nation of Yisrael are partners in Eretz Yisrael (see Tosfos to Bava Basra 44b, DH d'Lo, who says that every Jew owns four Amos in Eretz Yisrael).

According to this, if the king in Eretz Yisrael is a Nochri, he still may not expel the citizens, because every Jew has his part of the Land.
