Chutz la'Aretz is not Tamei because of our uncertainty. The Chachamim made a Gezeirah, decreeing Tum'ah on Chutz la'Aretz (see Shabbos 15). In a case of uncertainty, we follow the rules of "Safek Tum'ah b'Reshus ha'Rabim Tahor" and the converse for Reshus ha'Yachid.
