Our sugya here comes out that r Yehuda hold ein breira but in Bava kama on 69 the gemara after a long difficult sugya comes out that r Yehuda has to hold yesh breira?

The Gemara in Bava Kama (69a, last line) also states that Rebbi Yehudah does not hold of Bereirah, and this is the conclusion of the Gemara there concerning the opinion of Rebbi Yehudah. The Gemara there states that for this reason one must switch around the names of Rebbi Yehudah and Rebbi Dosa in the Beraisa cited there (about the owner of the field who says in the morning that whatever the poor people will collect will be Hefker). According to the conclusion, it cannot be Rebbi Yehudah who said this because Rebbi Yehudah holds Ein Bereirah.
