To whom is the Torah speaking when it writes "Vehayah alecha Damim"?

Mo'ed Katan, 8a: It is warning the Beis-Din, to teach us that, if they fail to remove the thorns from the roads, to prepare the roads and the highways and to measure the Mikva'os, then they are responsible for any blood that is subsequently spilt 1 (on account of their negligence). 2

It is not clear how failure to measure Mikva'os leads to the spilling of blood - unless it is referring to men and women Toveling in vain and subsequently becoming Chayav Kareis.
