BAVA BASRA 65 (25 Av) - Dedicated by Rabbi Dr. Eli Turkel of Raanana, l'Iluy Nishmas his mother, Golda bas Chaim Yitzchak Ozer (Mrs. Gisela Turkel) who passed away on 25 Av 5760. Mrs. Turkel accepted Hashem's Gezeiros with love; may she be a Melitzas Yosher for her offspring and for all of Klal Yisrael.

SELLING A HOUSE (Yerushalmi Halachah 3 Daf 13b)

משנה המוכר את הבית מכר את הדלת אבל לא המפתח מכר את המכתשת הקבועה אבל לא את המיטלטלת מכר את האיסטרוביל אבל לא את הקלת מכר תנור מכר כיריים

(a)

(Mishnah): If a person sold a house, the sale includes the door but not the key. It includes the mortar attached to the floor, but not the unattached mortar. It includes the fixed frame around a millstone, but not the funnel. It includes the oven and stove (since they are attached). (Note: The text at the end of the Mishnah, according to the Bavli is "(it does not include) the oven and the stove''. According to that, the Mishnah is referring to an oven and a stove that are not attached.)

בזמן שאמר לו הוא וכל מה שבתוכו הרי כולן מכורין:

When the seller said to him, "and everything that is inside it'', everything is included in the sale.

גמרא כיני מתניתא מכר את המכתשת החקוקה אבל לא את הקבועה:

(Gemara): The Mishnah should read (as does the Tosefta, beginning of 3rd Perek), "(If he sold him a house) he (also) sold him the carved mortar (if it was carved out one of the stones of the wall) but not the attached mortar.''
