(R. Yehuda citing R. Shmuel): (Referring to daf 44 (c) in the Mishnah above) The upper ones belong to the poor when they are white (as they are visibly from the new produce); the lower ones belong to the landowner when they are green (as they are visibly from last year's crop).

R. Meir said in the Mishnah that everything belongs to the poor, because doubtful Leket is regarded as Leket - even the new produce belongs to the poor - since even the new crop will always contain some green produce (and it is therefore doubtful as to which year the produce grew).

(R. Yochanan): (The Mishnah's law that doubtful items belong to the poor) is the opinion of R. Yehuda ben Chagra of the Baraisa - if someone converted and his crops were harvested - if they were harvested before the conversion, they are exempt; if after the conversion, they are obligated. If it is unknown, they are exempt; R. Yehuda ben Chagra obligates them.

Answer #2 (R. Shimon ben Lakish citing Bar Kapara): The pasuk states (Shemos 23:6), "You shall not pervert the judgment of your poor man in his quarrel" - but in his gifts, you may 'pervert' justice (and award him Leket even if it is only doubtfully his).
