THE KAPARAH OF SE'IR HA'MISHTALE'ACH (Yerushalmi Halachah 6 Daf 6b)

מתני' ועל זדון טומאת מקדש וקדשיו שעיר הנעשה בפנים ויום הכיפורים מכפר

(a)

(Mishnah): For intentional Aveiros of Tum'as Mikdash v'Kodoshav, the inner goat and Yom Kipur atone;

ועל שאר עבירות שבתורה הקלות והחמורות הזדונות והשגגות הודע ולא הודע עשה ולא תעשה כריתות ומיתות בית דין שעיר המשתלח מכפר:

(b)

For all other transgressions, light or severe, Mezid or Shogeg, whether or not the person knows he sinned, Lav or Aseh, even what is punishable by Kares or death, Se'ir ha'Mishtale'ach atones.

גמ' הדא היא מכפר על הזדונות ותולה על השגגות.

(c)

(Gemara): This is like we said [above, at the end of 4b, that Se'ir ha'Mishtale'ach] atones for Mezid, and suspends for Shogeg [until he finds out, and then he brings a Korban].

לא הן קלות לא תעשה לא הן חמורות כריתות ומיתות בית דין.

(d)

Question: Are not light [Aveiros] Lavim, and severe are Chayavei Kares and Misas Beis Din?! (Why does it list both of these?)

אמר ר' יהודה כיני מתניתא הקלות והחמורות אותן הקלות בין שעשאן בזדון בין שעשאן בשגגה [דף ז עמוד א] ואותן השגגות בין שנתוודע לו בהן בין שלא נתוודע לו בהן.

Answer (R. Yehudah): Our Mishnah means as follows. Light or severe - whether the light Aveiros were b'Mezid or b'Shogeg, and those Shegagos, whether or not he found out.

אילו הן קלות עשה ולא תעשה חמורות כריתות ומיתות בית דין.

These are light - Aseh and Lo Sa'aseh. These are severe - Kares and Misas Beis Din.

כשם שהשעיר הנעשה בפנים מכפר על הזדונות ותולה על השגגות אף שעיר המשתלח כן.

Just like the inner goat atones for Mezid and suspends for Shogeg, also Se'ir ha'Mishtale'ach.

ניחה לא הודע הודע ולא כן תני

(f)

Question: Granted, if he did not find out [about his sin, Se'ir ha'Mishtale'ach atones]. However, it was not taught so when he found out!

מניין למחוייבי חטאות ואשמו' וודאין שעבר עליהן יום הכיפורים שחייבין להביא אחר יום הכיפורים וחייבי אשמות תלויין פטורין.

(Above, 3b): What is the source for one who was liable a Chatas or Asham Vadai, and Yom Kipur passed, that he must bring after Yom Kipur, but one who was obligated Asham Taluy is exempt [after Yom Kipur]?

א"ר בון בר חייא בין שנתוודע לו בהן בין שלא נתוודע לו בהן.

Answer (R. Bun bar Chiya): This is whether or not he found out [that there is a Safek whether he sinned, but not if he found out that he Vadai sinned].

ולא כבר כיפר יום הכיפורים.

(h)

Question: Didn't Yom Kipur already atone? (If he found out only about the Safek, he is Chayav Asham Taluy. Yom Kipur atones for this. Why does it say that it only suspends!)

ר"ש בשם לוי שובדא (במוכר) [צ"ל בנורד - פני משה] ביום הכיפורים היא מתניתא.

(i)

Answer (R. Shimon citing Levi Shuvda): Our Mishnah discusses one who rebels against Yom Kipur (does not want it to atone for him).

ולמה לא מר בשלא נתוודע בהן ביום הכיפורים.

Question: Why didn't he say that it is when he did not know [about the Safek] on Yom Kipur?

מילתיה אמרה אפילו לא נתוודע לו בהן ביום הכיפורים יום הכיפורים מכפר.

Answer: This teaches that even if he did not know about the Safek on Yom Kipur, Yom Kipur atones.

THE DIVISIONS OF KAPARAH (Yerushalmi Halachah 6 Daf 7a)

עשה אף על פי שלא עשה תשובה לא תעשה ר' שמואל בשם ר' זירא והוא שעשה תשובה.

(a)

[If one transgressed] an Aseh, even if he did not repent [Yom Kipur atones for it]. For a Lo Sa'aseh, R. Shmuel said in the name of R. Zeira [that it atones] only if he repented.

האומר אין העולה מכפרת אין העולה מכפרת [צ"ל עלי מכפרת היא אי אפשי שתכפר לי אינה - פני משה] מכפרת היא על כורחו

(b)

If one said "Olah does not atone" or "Olah does not atone for me", it atones for him. If he said "I do not want it to atone for me", it does not atone for him Bal Korcho (against his will);

האומר אין יום הכיפורים מכפר (מכפרת היא על כורחו אין יום הכיפורים אי איפשי שיכפר לו אין) [צ"ל אי אפשי יכפר לי - פני משה] מכפר הוא לו על כורחו.

One who says "Yom Kipur does not atone" or "I do not want it to atone for me", it atones for him Bal Korcho.

א"ר חנינה בי ר' הילל לא מסתברא דאלא חילופין לא כולא מן בר נשא מימר למלכא דלית את מליך.

(c)

Objection (R. Chaninah brei d'R. Hillel): The opposite is reasonable! [In a Korban, even though he says so, in any case he brings the Korban. Regarding Yom Kipur, if he says so,] a person cannot tell the king "you are not the king"! (If one does not want Kaparah, he rebels. Presumably, Yom Kipur does not atone for him.)

העולה מכפרת על הירהור הלב מאי טעמא [יחזקאל כ לב] העולה על רוחכם היה לא תהיה.

(d)

Olah atones for thoughts of the heart. What is the reason? "Veha'Olah Al Ruchachem Hayo Lo Sihyeh" (it is due to what crossed your minds).

א"ר לוי העולה מכפרת על רוחכם

(R. Levi): Olah atones for Ruchachem.

וכן איוב הוא אומר [איוב א ה] אולי חטאו בני וברכו אלהים בלבבם הדא אמרה שעולה מכפרת על הירהור הלב.

And similarly it says [about] Iyov "[... v'He'elah Olas Mispar Kulam] ... Ulai Chat'u Vanai u'Varchu Elokim bi'Lvavam." This teaches that Olah atones for thoughts of the heart.

רבי אומר על כל עבירות שבתורה יום הכיפורים מכפר חוץ מפורק עול ומיפר ברית ומגלה פנים בתורה שאם עשה תשובה מתכפר לו ואם לאו אין מתכפר לו.

(e)

Rebbi says, Yom Kipur atones for all Aveiros in the Torah, except for Porek Ol (casting off the yoke), one who annuls Bris [Milah] and one who falsifies Torah. If he repented, it atones for him. If not, it does not atone for him.

ר' זבידא אמר ר' יוסא מקשה מיסבר סבר רבי שיום הכיפורים מכפר בלא תשובה

(f)

Question (R. Zvida citing R. Yosa): Does Rebbi hold that Yom Kipur atones [for all other Aveiros] without Teshuvah?!

אתא ר' אשיין רבי יונה רבי בא ר' חייה בשם ר' יוחנן יום הכיפורים מכפר בלא תשובה ומיתה ממרקת בלא תשובה

(g)

Answer (R. Ashiyan citing R. Yonah citing R. Ba citing R. Chiyah citing R. Yochanan): [Indeed, Rebbi holds that] Yom Kipur atones without Teshuvah. Death cleanses without Teshuvah.

ותני כן יום מיתה כתשובה. מאן תניתה רבי

(h)

Support (Beraisa): "The day of death is (atones) like Teshuvah." Who taught this? It is Rebbi.

הדא היא דתנינן מיתה ויום הכיפורים מכפרין עם התשובה דלא כר'

(i)

This that was taught "death and Yom Kipur atone with Teshuvah", is unlike Rebbi.
