FOR WHICH TUM'OS DOES THE KORBAN COME? (Yerushalmi Halachah 2 Daf 4a)

ר"א בן יעקב אומר מתוך שאמר [דברים כו יד] לא אכלתי באוני ממנו יכול ישראל שאכל מעשר אונן או טמא יביא קרבן

(a)

Suggestion (R. Eliezer ben Yakov): Since it says "v'Lo Achalti b'Oni Mimenu [v'Lo Bi'arti Mimenu b'Tamei]", perhaps if a Yisrael ate Ma'aser [Sheni] when he is an Onen or Tamei, he brings a Korban!

(b)

Rejection: "Me'Eleh" - for some of these [Aveiros mentioned in the Parshah] he is Chayav [Korban], and for some of them he is exempt.

אוציא את המעשר שאינו בעון מיתה ולא אוציא את התרומה שהיא עון מיתה שנאמר [שם כב ט] ומתו בו כי יחללוהו.

(c)

Suggestion: I should exclude Ma'aser, for which there is no punishment of Misah (at all), but I should not exclude Terumah, for which there is a punishment of Misah [bi'Ydei Shamayim] - "u'Mesu Bo Ki Yechaleluhu"!

Rejection: "Me'Eleh" - for some of these he is Chayav, and for some of them he is exempt.

Suggestion: Perhaps [we learn from a Gezeirah Shavah "Asham-Asham" - just like there ("v'Hesi'u Osam Avon Ashmah" it discusses) Terumah, also here ("v'Ashem", it discusses) Terumah!

ולא מע"ז למדתה. וע"ז למדה על כל עבירות שבתורה לומר מה ע"ז מיוחדת שחייבין על זדונו כרת ועל שגגתה חטאת יצאת תרומה שאינה אלא עון מיתה.

Answer: Do we not learn [Chiyuv Korban] from idolatry? Idolatry teaches about all Aveiros in the Torah. Just like idolatry, one is Chayav Kares for Mezid and Chayav Chatas for Shogeg (the same applies to all Aveiros). This excludes Terumah, which has only the punishment of Misah [bi'Ydei Shamayim, but not Kares].

א"ר חנינה קומי רבי מנא ומע"ז למדתה וילמד מע"ז ולכל דבר מידיעה אחת.

(R. Chanina, in front of R. Mana): If we learn from idolatry, we should learn from idolatry, and for everything one Yedi'ah [at the end should suffice. Why do we require for Tum'ah also Yedi'ah at the beginning?]

אמר לו ע"ז בקבוע וטומאת מקדש וקדשיו בעולה ויורד ואין למידין קבוע מעולה ויורד ולא עולה ויורד מקבוע.

Answer (R. Mana): Idolatry has a Kavu'a (fixed Chatas - even an Oni must bring an animal), and Tum'as Mikdash v'Kodoshav brings Oleh v'Yored. We cannot learn Kavu'a from Oleh v'Yored, and not Oleh v'Yored from Kavu'a.

ומה חמית מימר בטומאת הקודש הכתוב מדבר.

Question: (If we cannot learn Oleh v'Yored from Kavu'a, we should include Terumah!) Why do you want to say that the verse discusses [only] Tum'as ha'Kodesh?

נאמר כאן [שם ה ב] בהמה טמאה ונאמר להלן [שם ז כא] בהמה טמאה מה בהמה טמאה האמורה להלן בטומאת הקודש אף בהמה טמאה האמורה כאן בטומאת הקודש.

Answer: It says here "[Chayah Temei'ah of b'Nivlas] Behemah Temei'ah" (this is extra, for Behemah is included in Chayah), and it says there [about eating Kodshim b'Tum'as ha'Guf] Behemah Temei'ah. Just like there, Behemah Temei'ah refers to Tum'as ha'Kodesh, also here Behemah Temei'ah refers to Tum'as ha'Kodesh.
