עריפה לאו דוקא, דמדידה הוא דהויא בג'.

Clarification: Arifah is 'Lalav Davka' (not literal), since it is the Medidah (the measuring) that requires three.

כדתנן בפ' עגלה ערופה (סוטה דף מד:) 'ג' מב"ד הגדול שבירושלים היו יוצאין ... '; והדר קתני 'נפטרו זקני ירושלים והלכו להן; זקני אותה העיר מביאין עגלה ערופה'; והתם לא קתני ג'!

Source #1: For so we learned in the Mishnah in PerekEglah Arufah - 'Three Dayanim would go from the Beis-Din ha'Gadol in Yerushalayim (to measure) ... ', and later the Mishnah says 'The elders of Yerushalayim would take their leave, and the elders of that town would bring an Eglah Arufah'; And there it does not mention three.

TOSFOS DH 'YACHOL ZINEI HA'SHUK'?

תוס' ד"ה 'יכול זקני השוק'?

(Summary: Tosfos reconciles this, and other Sugyos, which interpret "Ziknei" as Hedyotos, with the Mishnah in Sotah, which interprets "Ziknei ha'Ir" as Mumchim).

כאן מוכח ד"זקני" משמע הדיוטות.

Clarification: It is evident from this Gemara that "Ziknei" refers to Hedyotos (laymen).

וכן לקמן גבי 'עריפה' אמרינן 'אי כתב "זקני", ה"א זקני השוק; וכן בריש מצות חליצה (יבמות דף קא. ושם) מרבינן הדיוטות מדכתיב "זקני עירו".

Precedents: Similarly later, where, in connection with the 'Arifah', the Gemara says that, had it written "Ziknei", we would have thought that it meant 'elders from the street' (laymen); And so too at the beginning of 'Mitzvas Chalitzah', where the Gemara includes Hedyotos from the fact that the Torah writes "Ziknei Iro".

וקשה, דבפ' עגלה ערופה (סוטה דף מד:) תנן 'נמצא סמוך לעיר שאין בה ב"ד לא היו מודדין'; ומפרש בגמרא ד"זקני העיר" בעינן, וליכא?

Question: But in Perek Eglah Arufah the Mishnah writes that if the corpse is found close to a town that has no Beis-Din, they did not measure. And the Gemara learns this from the Pasuk "Ziknei ha'Ir" (which implies Mumchim)?

וי"ל, ד"זקני העיר" שאני, דמשמע 'המיוחדים שבעיר', כדדרשינן הכא "העדה" - 'המיוחדים שבעדה'.

Answer: The answer is that "Ziknei ha'Ir" (with a 'Hey') implies special elders in the city, just like we Darshen here "ha'Eidah" - 'people who are special in the community'.

TOSFOS DH 'LO SH'RAK VE'LO PIRCHUS'.

תוס' ד"ה 'לא שרק ולא פירכוס'.

משמע דתרי מילי נינהו! ולא כפי' הקונטרס פ' קמא דכתובות שפירש ד'פוקסת' היינו 'מעברת שרק על פניה'; והתם מוכח ד'פוקסת' היינו 'פירכוס'; ואין להאריך.

Clarification: The Gemara implies that 'Sh'rak' and 'Pirchus' are two different things - not like Rashi in the first Perek of Kesuvos, who writes that 'Pokeses' is equivalent to smearing 'Sh'rak on the face, and it is evident there that 'Pokeses' and 'Pirchus' are one and the same. And this is not the time and place to elaborate.

TOSFOS DH 'VE'R. SHIMON LO DARSHI "VAV" '.

תוס' ד"ה 'ורבי שמעון לא דריש "וי'ו" '.

(Summary: Tosfos cites other places in Shas where R. Shimon does not Darshen the 'Vav', and where R. Yehudah does, and he reconciles them with other Sugyos, where both Tana'im seem to switch their respective opinions).

וכן בפ' קמא דסוטה (דף ו:) גבי "וטהורה" - דקאמר ר"ש 'אין זכות תולה במים המרים'; וכן בשלהי התכלת (מנחות דף נא:) גבי "ומחציתה".

Precedents: Similarly, in the first Perek of Sotah, where, in spite of the 'Vav' in the word "u'Tehorah Hi", R. Shimon maintains that merits do not prevent the water of the Sotah from taking effect immediately; and likewise in Perek ha'Techeiles, in connection with the word "u'Machtzisah".

ותימה, דבריש מרובה (ב"ק דף סה:) דריש ר"ש וי"ו "ואת אשמו"? ובפרק כל האסורים (בכורות כח:) גבי "ומן הצאן" - 'להוציא את הנוגח לקרבן'? ובריש פ' ד' מיתות (לקמן דף נא:) אמר ר"ע ' "בת" "ובת" אני דורש'? ורבי שמעון קאי התם כוותיה?

Question #1: However, there appears to be a contradiction from the Gemara at the beginning of 'Merubeh', where R. Shimon does Darshen the 'Vav' of "ve'es Ashamo", and from Perek Kol ha'Asurim, in connection with the Pasuk "u'min ha'Tzon" - 'to preclude a goring ox from being brought as a Korban; and from Perek 'Arba Misos', where R. Akiva Darshens "Bas" "u'Bas", and where R. Shimon concurs with him?

וכן קשה מרבי יהודה דדריש הכא וי"ו - ובפרק אלו מציאות (ב"מ דף כז.) גבי "ומצאתה" - דאתא לידו משמע. וקשה, דבריש תמורה (דף ב:) גבי "ואם המיר ימיר", אמרינן 'ור' יהודה וי"ו לא דריש'? וכן בשלהי טרף בקלפי (יומא ד' מה.) גבי "והאש"?

Question #2: In similar vein, we can query R. Yehudah, who Darshens the 'Vav' here and in 'Eilu Metzi'os' (in connection with "u'Metza'sah" - 'de'Asa li'Yedeih Mashma') - from the Gemara at the beginning of Temurah, in connection with "ve'Im Hamer Yamir", and from the the Gemara in 'Taraf be'Kalpi', in connection with "ve'ha'Eish", where R. Yehudah does not Darshen the 'Vav',

וי"ל, דהא דקאמר 'לא דריש ליה' (ולא משמע ליה) לאו משום דלא דריש ליה כלל, אלא דווקא לההיא דרשה קאמר.

(d)

Answer: When the Gemara says 'Lo Darish Lei', it does not mean that he does not Darshen it at all, but rather that he does not concur with the D'rashah that his disputant learns from it.

TOSFOS DH 'MASNISIN DE'LO KI HAI TANA'.

תוס' ד"ה 'מתני דלא כי האי תנא'.

(Summary: On the assumption that the Gemara's Kashya is based on the fact that our Mishnah does not mention 'Melech' and 'Kohen Gadol', Tosfos explains why the Gemara only queries the Mishnah with regard to the Mitzvah of Eglah Arufah, and not with regard to 'Ein Mosifin al ha'Ir' and with regard to 'Motzi'in le'Milchemes ha'Reshus', where the Tana also omits various items).

תימה, אי משום דמתני' לא חשיבא 'מלך וכהן גדול', ה"נ אשכחן גבי 'אין מוסיפין על העיר' - דבעינן מלך ונשיא ואורים ותומים וב' תודות ושיר, כדתנן בפ"ב דשבועות (דף יד.)? וכן גבי 'מוציאין למלחמת הרשות' - דבעינן מלך ומשוח מלחמה, כדאמר בגמ' (דף טז.)?

Question: If this is because our Mishnah does not mention 'Melech' and 'Kohen Gadol', neither does it mention them in connection with 'Ein Mosifin al ha'Ir', even though it too, requires 'Melech, Nasi, Urim ve'Tumim, Sh'tei Todos and Shir', as we learned in the second Perek of Shevuos (none of which are in fact mentioned in our Mishnah), nor 'Melech and Mashu'ach Milchamah' in connection with 'Motzi'in le'Milchemes ha'Reshus', even though we will learn in the Gemara shortly that they are required there?

וי"ל, דבכל הנהו, לא חשיב כולהו מילי אלא שבעים וא' לחודייהו; אבל הכא דסגי בג' או בה', אם איתא דצריך מלך וכהן גדול הוה ליה למיתני בהדיא?

(b)

Answer: That is because in the latter two cases, it does not reckon anything else, other than that they need seventy-one Dayanim. Here however, where three or five Dayanim will suffice, if it required Melach and Kohen Gadol, then it ought to mention them specifically.

TOSFOS DH 'MELAMED SHE'HA'MAKOM GOREM'.

תוס' ד"ה 'מלמד שהמקום גורם'.

(Summary: Tosfos explains why it is that although the correct location for Ma'aser Sheini is in Yerushalayim, that of the Sanhedrin is in the Lishkas ha'Gazis'. They also prove that Beis Pagi has the same status as Yerushalayim).

ואע"ג דבמעשר שני כתיב נמי 'מקום', ומעשר שני נאכל בכל העיר?

(a)

Implied Question: Even though by Ma'aser Sheini too, the Torah writes "Makom", yet Ma'aser Sheini could be eaten anywhere in Yerushalayim.

הכא גבי סנהדרין לא מקרי 'מקום' אלא 'לשכת הגזית', סמוך למחנה שכינה.

(b)

Answer: 'Makom' in connection with Sanhedrin refers specifically to the Lishkas ha'Gazis, which was close to the Machaneh Shechinah.

כדאמר באיזהו מקומן (זבחים דף נד:) 'גמירי דסנהדרין בחלקו של יהודה ושכינה בחלק בנימין'. אבל בית פגי, לא.

Source: Like the Gemara in 'Eizehu Mekoman' which quotes a tradition that the Sanhedrin sat in the portion of Yehudah, and the Shechinah in that of Binyamin, but not in Beis Pagi.

אע"ג דדינו כירושלי' (כדאמר בהשוכר את הפועלים [ב"מ דף צ.]) 'והא בעי חומה? כגון דדשו לפנים מחומת בית פגי'.ובפרק התודה (מנחות דף עח:) אמרינן 'השוחט את התודה, ולחמה חוץ לבית פגי, לא קדש את הלחם'.

Implied Question: Despite the fact that it had the Din of Yerushalayim (as we learned in 'ha'Socher es ha'Po'alim') 'But does it not require a wall? It speaks where they walked within the wall of Beis Pagi!' And in Perek ha'Todah too, we say that 'If someone Shechts a Torah whist its loaves are outside Beis Pagi, the loaves do not become sanctified'.

ולאו דווקא א'בית פגי, אלא אפי' בירושלים אין שם מקומן.

Conclusion: Likewise (see Maharsha), not only is Beis Pagi not the rightful location of the Beis-Din ha'Gadol, but neither is Yerushalayim.

וכדאמר בפ"ק דשבת (דף טו.) 'מ' שנה קודם שחרב הבית, גלתה סנהדרין וישבה לה בחנות'; ומפרש התם - שלא דנו דיני נפשות. ואמרינן בפרק בתרא דראש השנה (דף לא.) 'עשר גליות גלתה סנהדרין - מלשכת הגזית לחנות, ומחנות לירושלים'.

Proof: Like we learned in the first Perek of Shabbos 'Forty years before the Beis-Hamikdash was destroyed, the Sanhedrin went into exile, and sat in 'Chanus' `and we learned in the last Perek of Rosh ha'Shanah 'The Sanhedrin was exiled ten times - from Lishkas ha'Gazis to Chanus and from Chanus to Yerushalayim.

TOSFOS DH 'ILEIMA LE'DAVAR HA'RESHUS, MI NAFKI?'

תוס' ד"ה 'אילימא לדבר הרשות, מי נפקי?'

ואחר תמיד של בין הערבים שהיו הולכין לביתם, כדאמרי' בהנחנקין (לקמן פח:) 'היה הולך כל אחד ואחד לבדו, ולא מתרמי שימצאו כולן ביחד'.

Clarification: Neither can we establish it after the Tamid shel Bein ha'Arbayim, when they all went home, since each judge made his own way home, and it there is no way that they would have all met together.

TOSFOS DH ' "AL YECHSAR HA'MAZEG" '.

תוס' ד"ה ' "אל יחסר המזג" '.

(Summary: As long as twenty-three Dayanim [the equivalent of a Beis-Din Ketanah] remain, we will learn in the fourth Perek, then the single Dayan may leave. Tosfos explains in this light, the word "ha'Mazeg" [based on 'Mizug' - dilution] is one to two, based on the Gemara later, and they reconcile it with the Gemara in Shabbos, which gives the proportion as one to three, proving their answer from Gemaras in Bava Metzi'a and Eruvin. Finally, they present a novel explanation on "ha'Mazeg", based on a Gematriyah).

כדאמר, שאם הוצרך אחד מהם לצאת, אם יש בה כ"ג, יוצא, ואם לאו אינו יוצא; והיינו כמזיגה, דעל חד תרי.

Explanation #1: Like we will learn later, that if one Dayan needs to go out, then as long as twenty-three remain, he may leave, otherwise, he may not. And this is akin to 'Mezigah' (diluting wine), one part wine and two parts, water.

ואע"ג דסתם מזיגה על חד תלת, כדאמרינן בריש המוציא יין (שבת דף עז. ושם)?

(b)

Implied Question: Even though, according to the Gemara in 'ha'Motzi Yayin', S'tam 'Mezigah' is one part wine, three parts water ...

היינו דווקא רבא, שהיה רגיל למזוג כן שהוא כמשפט המזיגה על חד תלת, אבל שאר בני אדם האוהבים יין חזק, אין מוזגין אלא על חד תרי!

Answer: That speaks specifically according to Rava (who was a wine-maker, and) who tended to dilute his wine one to three, whereas most people, who prefer their wine strong, are inclined to dilute it one to two, as we explained.

כדמשמע בשילהי הזהב (ב"מ דף ס. ושם) שהיתה מזיגתו משונה, דאמר רבא - 'מזיגה דידי מידע ידיע'.

Proof #1: " means The Gemara in 'ha'Zahav', implies that Rava's wine was different than everybody else's, when it cites him as saying 'My dilution is recognizable!'.

ואמר נמי בכיצד מעברין - (עירובין דף נד.) 'דמיא האי מזיגה למזיגה דרבא בריה דרב יוסף בר חמא'.

Proof #2: And n 'Keitzad Me'abrin' too, it says 'This dilution resembles that of Rava b'rei de'Rav Yosef bar Chama'.

וי"מ "אל יחסר המזג" - שלא יחסר בגימטריא מז"ג שהוא חמשים; אבל אי חסר מ"ט אין לחוש, דמשתיירי כ"ב, 'ואין ב"ד שקול', ומוסיפין עליהם אחד, הרי כאן כ"ג.

Explanation #2: Some commentaries interpret "Al Yechsar ha'Mazeg" to mean that there should never be missing the Gematriyah of "Mazeg", which is fifty. But if there are only forty-nine short, that would leave twenty-two, in which case, based on the principle "Ein Beis-Din Shakul" (A Beis-Din may never comprise an even number), they would have to add one (making up the required twenty-three).

TOSFOS DH 'NETA REVAI U'MA'ASER SHEINI ... SHE'EIN DAMAV YEDU'IN'.

(Summary: Tosfos proves that 'Ein Damav Yedu'in' does not apply to Neta Revai, and explain why not. And they conclude that nowadays, three people are not required anyway).

Reason: This is because seeing as the owner is impatient to eat from his tree for the first time, we are afraid even if their value is known (see Tosfos Yom-Tov).

Ruling: Nowadays however, when we do not redeem them for their full value anyway, three people are not required.

TOSFOS DH 'BI'SHELOSHAH LEKUCHOS'.

(Summary: Tosfos refutes the explanation that the three purchasers wish to acquire it and that it goes to the highest bidder, in favor of Rashi, who learns that it is talking about three expert merchants. This they do on the basis of the case of the man and his two wives cited shortly).

Explanation #1: Some say that the three purchasers refer to three people who wish to purchase the Ma'aser, and it goes to the highest bidder.

Refutation of #1: Because, according to the first explanation, how will we explain 'a man and his two wives' mentioned in the Beraisa (seeing that whatever a woman owns belongs to her husband)?

Implied Question & Refutation: Tosfos refute the suggestion that the Gemara is talking about where the owner gave it to the women on condition that her husband has no rights to it, as that would be a Dochek.

TOSFOS DH 'TZINORA SHEL HEKDESH'.

תוס' ד"ה 'צינורא של הקדש'.

(Summary: Tosfos presents four definitions of 'Tzinura').

פירש בקונטרס - 'שטוין בה זהב'.

(a)

Explanation #1: Rashi defines 'Tzinura' as something with which one spins gold.

והוה כי ההיא דכלים (פ"ט מ"ו) דתנן 'כוש שבלע את הצינורא, ומלמד שבלע את הדרבן (כוש הוא הפלך שהנשים טוות בו.

(b)

Proof: This conforms with the Mishnah in Keilim 'A spindle which 'swallowed' the Tzinora, and an ox-goad which 'swallowed' its metal tip ('Kush' is the spindle with which the women spin).

ועוד איכא צינורא אחר - דאמרינן שילהי ר' עקיבא (שבת צ.) ובפ' בתרא [דמנחות] (דף קז.) 'דמחטטין בה את הפתילות, ומקנחין בה את הנרות'

Explanation #2: There is also another kind of Tzinora - like the Gemara in 'R. Akiva' and 'in the last Perek in Menachos says, that is used to clean the top of the wick, and to clean out the lamp'.

ועוד יש צינורא אחר - דאמר בפ"ק דיומא (דף יב.) 'כהן גדול לובש שמונה ומהפך בצינורא'; משמע שהיינו מזלג שמהפך בו איברי תמיד.

Explanation #3: A third kind of Tzinora is mentioned in the first Perek of Yoma 'A Kohen Gadol wears eight Begadim and turns over the pieces of Korban with a pitch-fork.
