SEPARATING AN INVALID KORBAN PESACH (Yerushalmi Halachah 7 Daf 66b)

משנה המפריש נקיבה לפסחו או זכר בן שתי שנים ירעה עד שיסתאב וימכר ויפלו דמיו לנדבה

(a)

(Mishnah): One who separates a female, or a male animal in its second year as his Korban Pesach (it is invalid and) it must graze until it receives a blemish and then be sold and its money used as a voluntary Korban.

המפריש פסחו ומת לא יביאנו בנו אחריו [דף סז עמוד א] לשם פסח אלא לשם שלמים

(b)

One who separates his Korban Pesach and then dies, his son should not bring it as a Korban Pesach in place of him; rather, it should be brought as a Shelamim.

גמרא מתניתא לאחר כפרה וכר''ש דתני

(c)

(Gemara): The Mishnah (about separating a female etc.) is referring to when it exists after the time of the sacrifice of the Korban Pesach, and it follows R. Shimon of the Beraisa -

קודם לפסח תהא רועה עד שתסתאב ותימכר ויביא בדמיה פסח

If he separated it before Pesach, it should graze until it receives a blemish and then sold and the money used for a Korban Pesach.

לאחר הפסח תבוא שלמים

If it was after Pesach, it should graze etc. and the money used for a Korban Shelamim.

ר''ש אומר קודם לפסח תימכר שלא במום לאחר הפסח תבוא שלמים

R. Shimon says - before Pesach, he should sell it unblemished; after Pesach, it should come as a Shelamim.

לא כן סברינן מימר כל שנראה ליקרב בפסח אין גופו קרב שלמים.

(d)

Question: (The Mishnah taught that one who separates his Korban Pesach and then dies, his son should not bring it as a Korban Pesach in place of him; rather, it should be brought as a Shelamim.) Why is it that it should be brought as a Shelamim even if he died on the 14th - it was already fitting to be used and then rejected?

Answer: The Mishnah is discussing when he separated the money and it is teaching that he should not use that money for a Pesach but rather, it should be used to purchase a Shelamim.

A PESACH THAT BECAME MIXED UP WITH OTHER KORBANOS (Yerushalmi Halachah 8 Daf 67a)

[דף פ עמוד ב (עוז והדר)] משנה הפסח שנתערבה בזבחים כולן ירעו עד שיסתאבו וימכרו ויביא בדמי היפה שבהן ממין זה ובדמי היפה שבהן ממין זה ויפסיד המותר מביתו

(a)

(Mishnah): If a Pesach became mixed with other sacrifices, they must all graze until they receive a blemish and then be sold and the value of the most expensive one should used to give each type of sacrifice, and the extra cost should come from the money of the owner.

נתערב בבכורות ר''ש אומר אם חבורת כהנים יאכלו

(b)

If it became mixed up only with firstborn animals - R. Shimon says that if it is a group of Kohanim, they may eat it.

גמרא תני אין לוקחין שביעית בכסף מעשר

(c)

(Gemara - Beraisa): One may not buy Shevi'is produce with Maaser Sheni money (lest the time of Bi'ur arrives and he will be required to destroy the remaining produce - which is prohibited to do with Shevi'is produce).

ר' יוסה אמר במחלוקת

(d)

R.Yosa: This law is a dispute, like the Mishnah in Maaser Sheni where there is a dispute between R. Shimon and Rabbanan about buying Terumah with Maaser Sheni money.

א''ר יונה דברי הכל היא אוכלי תרומה זריזין הן

R. Yona: Even R. Shimon, who said there that we are not concerned about the Terumah being wasted (as the Kohanim are careful), is concerned in the case of Shevi'is and will agree with the Rabbanan that one may not buy Shevi'is produce with Maaser Sheni money.

התיב ר' חנניא קומי ר' מנא והתנינן נתערב בבכורות ר''ש אומר אם חבורת כהנים יאכלו ותני עלה יאכלו כמור שבהן

(f)

Question (R. Chananya to R. Mana - Mishnah): "If the Pesach became mixed with firstborn animals, R. Shimon says that if it is a group of Kohanim, they may eat it''. And the Beraisa teaches that they must eat it according to the requirements of the strictest Korban?

אמר ליה אוכלי פסחים בשעתן זריזין הן כאוכלי תרומה

(g)

Answer: Those who eat the Korban Pesach are zealous like the Kohanim who eat Terumah.

תדע לך דתנינן אין צולין בשר בצל וביצה אלא כדי שיצולו ותנינן משלשלין את הפסח לתנור עם חשיכה

(h)

Proof (Mishnah): "One may not roast meat, onion or egg (on a Friday afternoon) unless it will be roasted before Shabbos.'' On the other hand, the Mishnah teaches that "they lower the Korban Pesach into the oven just before nightfall''. (The resolution is that those that bring the Korban Pesach are zealous and there is no concern that they might stoke the fire on Shabbos.)

A GROUP WHO LOST THEIR KORBAN PESACH (Yerushalmi Halachah 9 Daf 67b)

[דף סז עמוד ב] משנה חבורה שאבד פסחה אמרו לאחד צא ובקש ושחוט עלינו והלך ומצא ושחט והם לקחו ושחטו

(a)

(Mishnah): If a group lost their Korban Pesach and they told one member of the group to go and find it and slaughter it for them; if he went and found it and slaughtered it and they acquired a new animal and slaughtered it -

אם שלו נשחט ראשון אוכל משלו והן אוכלין עמו אם שלהן נשחט ראשון הוא אוכל משלו והן אוכלין משלהן

(b)

If his was slaughtered first, he eats from it and they all eat with him. If theirs was slaughtered first, he eats from his and they eat from theirs.

אין ידוע אי זה מהן נשחט ראשון או ששחטו שניהן כאחת הוא אוכל משלו והם אינן אוכלין עמו ושלהן יצא לבית השריפה ופטורין מלעשות פסח שני

(c)

If it is not known which one was slaughtered first or if they were slaughtered at the same time, he eats from his Korban but they do not eat with him and their animal is taken out to be burned; furthermore, they are exempt from Pesach Sheni.

אמר להן אם איחרתי צאו ושחטו עלי הלך ומצא ושחט והן לקחו ושחטו אם שלהן נשחט ראשון הן אוכלין משלהן והוא אוכל עמהן ואם שלו נשחט ראשון הוא אוכל משלו והן אוכלין משלהן

(d)

If he said to them - if I am delayed, go out and slaughter for me - if he went and found the lost animal and slaughtered it and they acquired an animal and slaughtered it; if theirs was slaughtered first, they eat from theirs and he eats with them; if his was slaughtered first, he eats from his and they eat from theirs.

[דף פא עמוד א (עוז והדר)] אם אינו ידוע איזה מהן נשחט ראשון או ששחט שניהן כאחת הן אוכלין משלהן והוא אינו אוכל עמהן ושלו יצא לבית השריפה ופטור מלעשות פסח שני

(e)

If it is not known which one was slaughtered first or if they were slaughtered at the same time, they eat from theirs but he does not eat with them; his animal is taken out to be burned and he is exempt from Pesach Sheni.

אמר להן ואמרו לו אוכלין כולם מן הראשון ואם אינו ידוע איזה מהן נשחט ראשון שניהן יוצאין לבית השריפה

(f)

If both he said it to them and they said it to him, all eat from the first one slaughtered. If it is not known which one was slaughtered first, they are both taken out to be burned.

לא אמר להם ולא אמרו לו אינן אחראין זה בזה

(g)

If neither he said it to them nor they said it to him, they are not responsible for each other (i.e. he eats from his and they eat from theirs).

שתי חבורות שנתערבו פסחיהן

(h)

If the Korbanos Pesach of two groups became mixed up -

אלו מושכין להן אחד ואלו מושכין להן אחד. אחד מאלו בא לו אצל אלו ואחד מאלו בא לו אצל אלו וכן הן אומרים

Each group takes an animal and then one person from each group goes to the other group and declares -

אם שלנו הוא הפסח הזה ידיך משוכות משלך ונמניתה על שלנו ואם שלך הוא הפסח הזה ידינו משוכות משלנו ונימנינו על שלך

i.

If this Pesach is ours, your hands are withdrawn from yours and appointed on ours; if this Pesach is yours, our hands are withdrawn from ours and appointed on yours.

וכן חמש חבורות של חמשה חמשה ושל עשרה עשרה מושכין להן אחד מכל חבורה וחבורה וכך היו אומרין

(i)

And similarly when there are five groups of five people or ten people, each group takes an animal and makes that declaration.

(j)

(Gemara - R. Yochanan): This Mishnah is the opinion of R. Noson, who said that one can fulfill his obligation through the throwing of the blood, even without eating. (This is clear from the words of the Mishnah - "it is taken out to be burned and they are exempt from Pesach Sheni''.)

תני בר קפרא יפה שתיקה לחכמים קל וחומר לטיפשים וכן שלמה אומר (משלי יז) גם אויל מחריש חכם יחשב. ואין צורך לומר חכם מחריש

(k)

(Beraisa - Bar Kafra): Silence is good for the wise and certainly for the fools (as in the Mishnah, if neither he nor they would have spoken, each could have eaten from their own Korban). And so says King Shlomo (Mishlei 17, 28), "Even a fool who is silent will be considered wise'' - and certainly a wise man who is silent.
