1)

SLAUGHTERING FOR VARIOUS PEOPLE (Yerushalmi Halachah 6 Daf 61b)

משנה האונן והמפקח בגל וכן מי שהבטיחוהו להוציאו מבית האסורין החולה והזקן שהן יכולין לוכל כזית שוחטין עליהן

(a)

(Mishnah): One may slaughter the Pesach for the following people:

1.

An Onen (a mourner for the death of a close relative - he is considered a Onen until and including the entire day of burial);

2.

One who is searching a collapsed building/pile of stones for potential survivors;

3.

One that was promised that he will be released from prison that day;

4.

A sick person or an elderly person who are able to eat a Kzayis of the meat.

ועל כולן אין שוחטין עליהן בפני עצמן [דף עג עמוד א (עוז והדר)] שלא יביאוהו את הפסח לידי פסול

(b)

One may not slaughter a Pesach only for these people, in order to avoid the Korban Pesach becoming invalid (if ultimately they are not able to eat it).

לפיכך אם אירע בהן פסול פטורין מלעשות פסח שני חוץ מן המפקח בגל שהיה טמא מתחילתו

(c)

Therefore, if one of these people became disqualified, they are exempt from Pesach Sheni; except for the person who is searched for survivors, as if he is Tameh, it took place before the slaughtering.

גמרא ר' יוסי בי ר' בון אבא בר בר חנה בשם ר' יוחנן מתניתא בשחבשוהו ישראל אבל אם חבשוהו עכו''ם (תהילים קמד) אשר פיהם דבר שוא וימינם ימין שקר

(d)

(Gemara - R. Yosi bei R. Bun bar bar Chana quoting R. Yochanan): The case of the Mishnah that discusses the prisoner refers to Jewish captors (who promised to free him); but as for gentile captors, the Pasuk states (Tehillim 144, 11), "...that their mouths speak falsehood and their right-hand is a right-hand of falsehood''

בנתון חוץ לירושלם אבל בנתון בתוך ירושלם אפילו לא הבטיחו כמי שהבטיחו

(e)

The case of the prisoner is when he is being held outside of Yerushalayim, but if he inside, even if they did not promise him, it is as if they did.

רבי יונה ורבי יוסי תריהון בקדמית' הוינן אמרין ישראל ערל מזין עליו ולא הוינן אמרין כלום

(f)

R. Yona/R. Yosi both said originally that an uncircumcised Jew who became Tameh from a corpse, they sprinkle him and he does not again require sprinkling when he is then circumcised (i.e. the sprinkling when he was uncircumcised was sufficient). However, this statement is incorrect.

תנא רבי סימון בר זבדי קומי רבי הילא נאמר כאן (שמות יב) ואז יקרב לעשותו ונאמר להלן אז יאכל בו מה אז שנאמר להלן עד שיהא כשר בשעת אכילה אף אז שנאמר כאן עד שיהא כשר בשעת שחיטה.

(g)

Beraisa (R. Simon bar Zavdi to R. Hila): This Pasuk states about an uncircumcised Jew (Shemos 12, 48), "...and then he shall approach to perform it''; and the earlier Pasuk states about an uncircumcised slave (Shemos 12, 44), "...then he may eat from it''. Just as the earlier Pasuk requires the slave to qualify (by becoming circumcised) when he eats, so when an uncircumcised Jew slaughters, he must qualify (by becoming circumcised).

(h)

Sometimes one who is searching for survivors (in the rubble) has the same law as the rest of the list in the Mishnah and sometimes he is different -

פעמים שהן נעשה כיוצא בהם בגל ארוך אני אומר נזרק עליו הדם עד שלא הגיע לטומאה

Sometimes he has the same law as the rest of the list - when the pile is long - in such a case there is reason to believe that the blood of the Pesach was thrown before he became Tameh (and he is exempt from Pesach Sheni).

פעמים (שהן)[שאין] נעשין כיוצא בו [דף סב עמוד א] בגל עגול

2.

Sometimes he has a different law - when the pile is round - as he certainly became Tameh at the beginning and is therefore obligated in Pesach Sheni.

אירע בהן פסול בין שחיטה לזריקה הן נעשין כיוצא בו בגל עגול

(i)

If in any of the cases of the Mishnah they were disqualified between the slaughtering and the throwing, they follow the law of the round pile (above) and are obligated in Pesach Sheni.

2)

SLAUGHTERING FOR AN INDIVIDUAL, A LARGE GROUP, AND FOR WOMEN AND SLAVES AND CHILDREN (Yerushalmi Halachah 7 Daf 62a)

משנה אין שוחטין את הפסח על היחיד דברי ר' יהודה

(a)

(Mishnah): R. Yehuda says - they may not slaughter the Pesach for an individual.

ור' יוסי מתיר אפילו חבורה של מאה שאינן יכולין לוכל כזית אין שוחטין עליהן

(b)

R. Yosi permits it. One may not even slaughter for a group of one hundred people if they cannot eat a Kzayis (as the defining factor is whether at least one person will eat a Kzayis).

(c)

One may not make a group of women, slaves and children.

גמרא א''ר יוחנן טעמא דר' יודה (דברים טז) לא תוכל לזבוח את הפסח באחד שעריך

(d)

(Gemara - R. Yochanan): R. Yehuda's source is the Pasuk that states (Devarim 16, 5), "you may not slaughter the Pesach in one of your cities'' - this is expounded to refer to slaughtering for "one'' person.

(e)

Question: How does R. Yosi use this Pasuk?

פתר לה כר''א בן מתיא דתני ר''א אומר יכול יהא היחיד מכריע על הטומאה תלמוד לומר לא תוכל לזבוח את הפסח באחד

(f)

Answer: He expounds like R. Eliezer ben Masya in the Beraisa - I might have thought that one person can tip the scales to make a majority of Tameh people that would allow all to slaughter in Tumah- the Pasuk states (ibid), "you may not slaughter the Pesach with one''.

אמר רבי יוחנן מודה רבי יודה שאם עבר וזרק את הדם שהורצה

(g)

R. Yochanan: R. Yehuda agrees that if he transgressed (by slaughtering the Pesach for an individual) and threw the blood, it is accepted.

עבר ושחט מתירין לו לזרוק

(h)

Question: If he transgressed and slaughtered, do they allow him to throw? (This question remains unanswered).

תני אין עושין חבורה נשים ועבדים וקטנים מפני שהן מרבין בתיפלה

(i)

(Mishnah): One may not make a group of women, slaves and children - as it increases sin (between women and slaves and between slaves and children).

תני בר קפרא שלא יביאו את הקדשים לידי ביזיון

(j)

Reason #2 (Bar Kafra - Beraisa): In order that Kodshim should not come to disgrace (as these people do not know how to be careful with Kodshim).

רבי יעקב בר אחא בשם ר' איסי אין עושין חבורה של גרים מתוך שהן מקולקלין אין מדקדקין בו והם מביאין אותו לידי פסול

R. Yaakov bar Acha quoting R. Isi: One may not make a group of converts since they will not be careful and will cause it to become disqualified.
