SACRIFICES THAT MAY BE BROUGHT BUT NOT EATEN IN A STATE OF TUMAH (Yerushalmi Halachah 4 Daf 48a)

משנה חמשה דברים באין בטומאה ואין נאכלין בטומאה העומר ושתי הלחם ולחם הפנים וזבחי שלמי ציבור ושעירי ראשי חדשים

(a)

(Mishnah): Five things may be brought but not eaten in a state of Tum'ah - 1) The Omer; 2) the Two Breads of Shavu'os; 3) the Showbreads; 4) public Shelamim offerings; 5) the goats of Rosh Chodesh.

הפסח שבא בטומאה נאכל בטומאה שלא בא מתחילתו אלא לאכילה

A Pesach that was brought in a state of Tum'ah may be eaten in Tum'ah, as the entire purpose of bringing it was to eat it.

גמרא וכל קרבנות ציבור אינן באין בטומאה

(Gemara) - Question: May all public sacrifices not be brought in a state of Tum'ah?

לא אתא אלא מימיר לך אע''פ שהן באין בטומאה אינן נאכלין בטומאה

Answer: The Mishnah comes to teach that other sacrifices may be brought but may not be eaten in Tum'ah.

בין כמאן דאמר הלחם עיקר בין כמאן דאמר כבשים עיקר. ארבעה אנון

Question: (There are two opinions in Maseches Menachos as to the primary part of the Shtei HaLechem on Shavu'os - R. Akiva says that it is the bread and R. Shimon ben Nanas says that it is the sheep.) According to both opinions, only one part is primary - so why does our Mishnah not list four things, instead of five?!

Answer: Our Tana was concerned for both opinions so he taught five.

אית תניי תני כלהום למדין מן הפסח אית תניי תני כל א' ואחד למד במקומו

One Beraisa taught that we learn from the Korban Pesach that all public sacrifices override Tum'ah. Another Beraisa taught that each sacrifice has its own source that teaches that it overrides Tum'ah.

מאן דאמר כולהון למידין מן הפסח מה מועדו שנאמר בפסח דוחה את הטומאה אף מועדו שאמר בכולן דוחה את הטומאה

According to the opinion that all public sacrifices learn from the Korban Pesach - Just as "in its time'' of the Korban Pesach overrides Tum'ah, so "in its time'' that is stated about all of them overrides Tum'ah.

Question: According to the opinion that each sacrifice has its own source, what is the source?

ואתיא כהדא דתני רבי אומר מה ת''ל (ויקרא כד) וידבר משה את מועדי ה'

Answer: He follows the following Beraisa -

Question: Rebbi says - What is learned from the Pasuk that states (Vayikra 23, 44), "And Moshe spoke about the Moadim (festivals) of Hash-m...''?

לפי שלא למדנו אלא על הפסח והתמיד שידחו את השבת שנאמר בהם במועדו

Answer: We have learned regarding the Pesach and the Tamid offering that they override Shabbos, as the Pasuk about them states, "at its time''.

Question: What is the source of this law for other public sacrifices?

ת''ל (במדבר כט) אלה תעשו לה' במועדיכם

Answer: The Pasuk states (Bamidbar 29, 39), "These you shall perform for Hash-m on your festivals''.

[דף נו עמוד ב (עוז והדר)] לעומר ולקרב עמו ולשתי הלחם ולקרב עמהן לא שמענו

Question: But what is the source for the Omer and the Shtei Halechem and the sacrifices that accompany them?

וכשהוא אומר וידבר משה את מועדי ה' אל בני ישראל קבען חובה שכולם יבואו בטומאה

Answer: When the Pasuk states, "And Moshe spoke about the Moadim of Hash-m to the children of Israel'' - this fixed for them an obligation that they should all be brought [even] in a state of Tum'ah.

וכשם שהן באין בטומאה כך יהוא נאכלין בטומאה

Question: Should we also say that they can be eaten in a state of Tum'ah?

גזירת הכתוב הוא [דף מח עמוד ב] (ויקרא ז) והבשר אשר יגע בכל טמא לא יאכל

Answer: No, as the Pasuk states (Vayikra 7, 19), "And the flesh that touches anything Tamei, you shall not eat''.

Question: Perhaps this should also apply to the Korban Pesach?

שנייה היא שלא בא מתחילתו אלא לאכילה

Answer: No, as the entire purpose of bringing it was to eat it.
