THE SIX PRACTICES OF THE PEOPLE OF YERICHO (Yerushalmi Halachah 9 Daf 29a)

משנה ששה דברים עשו אנשי יריחו על שלשה מיחו בידם ועל ג' לא מיחו בידם אלו שלא מיחו בידם מרכיבין דקלים כל היום וכורכין את שמע [דף לג עמוד ב (עוז והדר)] וקוצרין וגודשין לפני העומר ולא מיחו בידן

(a)

(Mishnah): Six things were done by the people of Yericho. The Chachamim protested three of them but the other three they did not protest. They did not protest -

1.

Grafting date-palm branches during the entire 14th of Nisan.

2.

Korchin on [Krias] Shema (the Gemara will explain this).

3.

Harvesting and making a heap of new crops before bringing the Omer offering.

אלו שמיחו בידן מתירין בגמזיות של הקדש [דף כט עמוד ב] ואוכלין מתחת הנשרים בשבת ונותנין פיאה לירק ומיחו בידן חכמים

However, the Chachamim did protest -

1.

Permitting themselves to benefit from branches of [carob and sycamore] trees that were Hekdesh.

2.

Eating dates underneath date trees on Shabbos (that perhaps fell off on Shabbos).

3.

Separating Peah from vegetables (even though they are exempt).

(Gemara): Who is the Tana who said "harvesting'' ( (a) 3.)? - R. Meir. Who is the Tana who said "making a heap''? R. Yehudah.

א''ר יעקב בר' סוסיי קומי ר' יוסי כל עמא מודיי שקוצרין וכל עמא מודיי שאין גודשין. מפליגין בהרכבת דקלים. ר''מ אומר מרכיבין דקלים כל היום וברצון חכמים היו עושין ר' יודה אומר לא היו עושין ברצון חכמים

(R. Yaakov to R. Yosi): All agree that they may harvest (in Yericho as it is in a valley and unsuitable for using for the Omer offering); and all agree that they may not make a heap (as there will be no loss caused by waiting). They disagree about grafting date-palms - R. Meir said that they grafted during the entire day of the 14th which followed the will of the Chachamim; R. Yehudah said that it did not follow the will of the Chachamim.

KORCHIN ON SHEMA (Yerushalmi Halachah 9 Daf 29b)

כיצד היו כורכין את שמע

Question: What is Korchin on Shema?

אמר רב אחא אמר רבי זעירה א''ר לא שמע ישראל ה' אלהינו ה' אחד אלא שלא היו מפסיקין בין תיבה לתיבה דברי רבי מאיר רבי יודה אומר מפסיקין היו אלא שלא היו אומרים ברוך שם כבוד מלכותו לעולם ועד.

Answer #1 (R. Acha quoting R. Zeira quoting R. Ila): R. Meir says "Shema Yisrael Hash-m Elokeinu Hash-m Echad'', but they would not stop between one word and the next. R. Yehudah says that they would stop, but they would not say "Baruch Shem Kevod Malchuso Le'Olam Va'ed''.

ר' יוסה אמר ר' זעירה ר' לא שמע ישראל ה' וגו' אלא שלא היו מפסיקין בין אחד לברוך דברי רבי מאיר רבי יודה אומר מפסיקין היו אלא שלא היו אומרים ברוך שם כבוד מלכותו לעולם ועד

BRANCHES OF CONSECRATED TREES (Yerushalmi Halachah 9 Daf 29b)

כיצד היו מתירין בגמזיות של הקדש

(a)

Question: How would they permit themselves to benefit from branches of [carob and sycamore] trees that were Hekdesh?

אמרו להן חכמים אין אתם מודין לנו בגידולי הקדש שהן אסורין

Question (Beraisa - Chachamim to the people of Yericho): Do you not agree that products that grow from Hekdesh are prohibited?

אמרו להן אבותינו כשהקדישו לא הקדישו אלא קורות מפני בעלי אגרוף שהיו באו ונוטלין אותן בזרוע

Response: When our forefathers consecrated them, they only consecrated the 'beams' (trunks), because of the ruffians who came and took them by force.

Question: Why then did the Rabanan protest?

Answer #1: They held that both the trunks and the fruits were consecrated.

אפילו תימר קורות הקדישו ופירות לא הקדישו צריכא לרבנין

Answer #2: Even if they only consecrated the trunks but not the fruits, it was still prohibited although there was no actual prohibition of Meilah.

4)

USING THE PRODUCTS OF A CONSECRATED FIELD (Yerushalmi Halachah 9 Daf 29b)

המקדיש שדה אילן מהו שישייר לו מן הגידולין

(a)

Query: Is one who consecrates a field of trees able to retain the products (even though they are taking nutrients from the Hekdesh ground)?

נשמעינה מן הדא [דף לד עמוד א (עוז והדר)] משנודעו העוללות העוללות לעניים

(b)

Suggestion (Mishnah in Peah): [If one consecrated his vineyard before the Oleilos (grape clusters that are not completely formed) became recognizable (as at that time all the grapes were still small), they are not for the poor.] If consecrated after the Oleilos became recognizable, they are for the poor (see Vayikra 19,10) - this applies even though they are growing from a field of Hekdesh!

(c)

Rejection: They belong to the poor since one cannot consecrate something that does not belong to him.

מעתה אפילו לא נודעו העוללות יהו העוללות לעניים

(d)

Question: If so, the Oleilos should be for the poor even if they were not recognizable?

שנייא היא שהוא כרם להקדש

(e)

Answer: It is as if he planted the vineyard for Hekdesh.

כהדא דתני הנוטע כרם להקדש פטור מן הפרט מן הערלה ומן הרבעי ומן העוללות וחייב בשביעית

Proof (Beraisa): One who plants a vineyard for Hekdesh is exempt from Peret, Orlah, Revay and Oleilos but obligated in the laws of Shevi'is.

Proof (R. Zeira quoting R. Yochanan): The Pasuk states (Vayikra 25,2), "And the land will rest a resting for Hashem'' - even something for Hash-m has the Kedushah of Shevi'is upon it.

Question (R. Chiya bar Aba to R. Mana): (If you say that a vineyard of Hekdesh is obligated in Shevi'is, what should one do with the fruits?) One cannot eat it without Pidyon (redeeming it), as Hekdesh cannot be taken out with Pidyon; one cannot redeem it and eat it otherwise it will be like buying an axe with the money of Shevi'is (as the redemption money should be given to the Beis HaMikdash)?!

Answer: The treasurer (of the Beis HaMikdash) will exchange it with someone else's money (and that money can now be used).

א''ר מתנייה למה לי נן פתרין לה דברי הכל כההיא דמר ר' יוחנן דברי ר' יוסה מפני שקדם נדרו להבקירו. והכא מפני שקדם הבקר נדרו להקדישו. א''ר יוחנן וחורון כר' יוסה

Question (R.Masanya): Why do we not explain this statement that "the vineyard is obligated in Shevi'is'' (see (f)) in the way of R. Yochanan - (He was discussing the Mishnah in Nedarim - "If a person prohibited his friend from benefiting from him, he may put the food on a rock and declare it to be ownerless (Hefker) and the friend may take it and eat it. R. Yosi prohibits this.'') R. Yochanan explained the words of R. Yosi that since the vow preceded declaring it Hefker, it does not work. (However, if declaring it Hefker preceded the vow, it is permitted.) Here too, Hefker preceded the vow (i.e. the status of Hefker brought by Shevi'is preceded his consecration), so he may eat the fruits without Pidyon?! R. Yochanan says that there was a case where the Chachamim ruled like R. Yosi (who said that even if the Oleilos were recognizable, the poor should give the profits to Hekdesh). (Note: According to Korban Ha'Edah, the previous sentence and the sugya that follows are out of place and is actually relevant to the Mishnah in Peah brought earlier (b)).

לית הדא פליגא על ר' יוחנן דרבי יוחנן אמר מכיון שעבר עליו ושכחו הרי הוא שכחה

Question: Does that Mishnah (that states that Shichechah applies to Aris (vines that are growing along poles) when one cannot reach out and take them) not disagree with R. Yochanan who said that as soon as he passes by, it immediately becomes Shichechah?

Answer: Aris is different as it is normally searched out (so even if he passed by, it is not yet Shichechah).

אפילו על דר' אושעיה לית היא פליגא דרבי הושעיה אמר רומס הייתי זיתים עם רבי חייה הגדול ואמר לי כל זית שאת יכול לפשוט ידך וליטלו אינו שכחה שנייא היא שכל רוגלות ורוגלות אומן בפני עצמו

The end of that Mishnah (that stated, "Shichechah applies to Rogliyos (vines that grow resting on the ground) from when one passes by) is not even a question on R. Oshiya, who said, "I was once harvesting olives with R. Chiya HaGadol and he told me that any olive that I can reach out and take is not Shichechah''. The resolution is that each and every Roglos is viewed like its own row.
