THE PROHIBITION OF "LO YERAEH LECHA'' (Cont'd) (Yerushalmi Halachah 2 Daf 14a)

לא יראה לך אית תניי תני לא יראה לך לך אין את רואה אבל רואה את לגבוה

(a)

Beraisa #1: "It may not be seen in your possession'' - You may not see your Chametz, but you may see Chametz belonging to the Beis HaMikdash.

(b)

Beraisa #2: Even Chametz belonging to the Beis HaMikdash may not be seen.

מאן דאמר לך אין את רואה רואה את לגבוה בשהקדישו קודם לביעורו מאן דאמר אפילו לגבוה כשהקדישו לאחר ביעורו

(c)

Resolution: Beraisa #1 refers to when it was consecrated before the time of bi'ur. Beraisa #2 refers to when it was consecrated after the time of bi'ur.

Resolution #2 (R' Bun bar Chiya): It refers to consecrated items for which he is responsible according to R' Shimon (who holds that he is therefore considered to be the owner).

Resolution #1: Beraisa #1 refers to when he declared it ownerless (hefker) before the time of bi'ur. Beraisa # 2 refers to doing so after the time of bi'ur.

DECLARING CHAMETZ OWNERLESS (HEFKER) (Yerushalmi Halachah 2 Daf 14b)

הבקיר חמצו בג' עשר לאחר הפסח מהו

(a)

If one declared his Chametz hefker on the 13th (of Nisan), after Pesach -

ר' יוחנן אמר אסור

1.

R' Yochanan said that it is prohibited.

רשב''ל אמר מותר

2.

R' Shimon ben Lakish said that it is permitted.

מתיב ר' יוחנן לרשב''ל אין את מודה לי משש שעות ולמעלן שהוא אסור

(b)

Question (R' Yochanan to R''SBL): Do you not agree that if declared hefker after the 6th hour, it is prohibited?

[דף טז עמוד ב (עוז והדר)] א''ל תמן איסורו גרם לו הא מה אית לך למימר

Answer: There, its prohibition (after 6 hours) caused it to be prohibited after Pesach. Here, if declared hefker before the 6th hour, why should it be prohibited after Pesach?

(R' Yosa to R' Pinchas): Do you remember that we used to say that R' Yochanan follows R' Yosa (the tanna) (if a Jew loaned money to a gentile and took Chametz as his collateral over Pesach, it is prohibited to derive benefit - since the Jew had acquired it after Pesach, it is prohibited) and R''SBL follows R' Meir (that he has not transgressed since it did not yet belong to him during Pesach)?

Correction (R' Yosa): But it is not true - rather R' Yochanan was concerned for deceit (that a person might not declare it ownerless and claim that he did) and R''SBL was not concerned.

(f)

Question: What is the practical difference between these (two understandings of the dispute between R' Yochanan and R''SBL (in (d) and (e))?

נפלה עליו מפולת מ''ד הערמה לית כאן הערמה והוא מותר מ''ד זכייה לית כאן זכייה והוא אסור

(g)

Answer: If a building fell on it (before Pesach and it was uncovered after Pesach). According to the opinion that they disagree about deceit, there is no deceit here and it is permitted. According to the opinion that they disagree over acquisition (that someone else must acquire it for it to leave his possession), there was no acquisition here so it is prohibited.

הכל מודין בגר שמת וביזבזו ישראל את נכסיו מ''ד הערמה מותר ומ''ד זכייה מותר

(h)

All agree that if a convert died [before Pesach, thereby rendering his property hefker] and a Jew acquired his property [after Pesach], according to the opinion that they disagree about deceit, it is permitted (since it became automatically hefker when he died); according to the opinion that they disagree about acquisition, it is permitted (as here acquisition is not required since it was not intentionally declared hefker).
