DERIVING BENEFIT FROM FOODS THAT ARE PROHIBITED TO EAT (Yerushalmi Halachah 1 Daf 10b)

ר' אבהו בשם ר''א כל מקום שנא' לא תאכל לא תאכלו לא יאכלו את תופש איסור הנייה כאיסור אכילה עד שיבא הכתוב ויפרוש לך כשם שפירש לך באבר מן החי ונבילה

(a)

(R' Abahu quoting R' Elazar): Whenever a verse states "lo sochal'', "lo sochlu''' or "lo yochlu'', it is prohibited to derive benefit just as it is prohibited to eat; unless the verse comes to explain differently as is the case of eiver min hachai (eating a limb from a live animal) and Neveilah (eating from the carcass of an animal that was not correctly slaughtered).

וכי מה פירש לנו באבר מן החי

Question: What was stated about eiver min hachai?

(שמות כב) ובשר בשדה טרפה לא תאכלו לכלב תשליכון אתו

(c)

Answer: (Shemos 22,30) "You should not eat from the flesh of a Tereifah in the field, you should throw it to the dog''. (The verse explicitly permits feeding it to one's dog.)

וכי מה פירש לנו בנבילה

(d)

Question: What was stated about a Neveilah?

(דברים יד) לא תאכלו כל נבלה לגר אשר בשעריך תתננה ואכלה או מכר לנכרי

Answer (Devarim 14,21): "You shall not eat any Neveilah, you shall give it to the stranger within your gates and he shall eat it, or sell it to a gentile''. (The verse explicitly permits deriving benefit from it by selling it.)

Question #1 (Chizkiyah to R' Abahu - Beraisa): Did the verse prohibit it to a dog? (The verse only mentioned a prohibition to eat it.)

והא כתיב (ויקרא ז) כל חלב שור וכשב ועז לא תאכלו. מעתה [דף יא עמוד א] את תופש איסור הנייה כאיסור אכילה

Question #2: The verse states (Vayikra 7,23) "You shall not eat any forbidden fats from a ox, a sheep and a goat''. Do you say that there is a prohibition to derive benefit just as there is a prohibition to eat it?

שנייא היא דכתיב (שם) וחלב נבלה וחלב טרפה יעשה לכל מלאכה ואכל לא תאכלוהו.

(h)

Answer: The following verse states (7,24) "And the forbidden fats of a Neveilah and of a Tereifah can be used for all work, but do not eat it.'' (The verse explicitly permits benefitting from it.)

והכתיב (דברים יב) רק הדם לא תאכלו. מעתה את תופש איסור הנייה כאיסור אכילה

Question: The verse states (Devarim 12,16) "Just do not eat the blood''. Is it prohibited to derive benefit just as it is prohibited to eat it?

שנייה היא דכתיב (שם) על הארץ תשפכנו כמים. מה המים מותרין בהנייה אף הדם יהא מותר בהנייה

Answer: It is different, as that verse states "You shall spill it on the ground like water'' - Just as one may derive benefit from water, so too one may derive benefit from blood.

והכתיב (בראשית לב) על כן לא יאכלו בני ישראל את גיד הנשה

(k)

Question: The verse states (Bereishis 32,33) "Therefore Bnei Yisrael should not eat the Gid ha'Nasheh''. (If one may therefore not derive benefit from it, why does the Mishnah rule that one may send the hind-quarters (containing the Gid ha'Nasheh) to a gentile. Surely when doing so, one is benefitting from it?)

א''ר אבהו קיימתיה בגיד הנשה שבנבילות

Answer (R' Abahu): This Mishnah is referring to when it is a Neveilah; therefore one may derive benefit from it (by selling it to a gentile).

[דף יג עמוד ב (עוז והדר)] והא כתיב (ויקרא כד) ולחם וקלי וכרמל לא תאכלו עד עצם היום הזה.

(m)

Question: The verse states (Vayikra 23,14) "You may not eat bread, or roasted kernels or fresh kernels until that very day''. (Grains from the new year's crops may not eaten until after the Omer sacrifice is brought on Pesach. However, they may be fed to one's animals)?

א''ר אבא מרי אחוי דר' יוסי שנייה היא שקבע הכתוב זמן

Answer (R' Aba Mari): The verse fixed a limited time for its prohibition. (During this time though, one may derive benefit, unlike other prohibitions that are not time-bound.)

והא כתיב (ויקרא יא) לא תאכלום כי שקץ הם

(o)

Question: The verse states (Vayikra 11,42) "You shall not eat them as they are an abomination''.(However, the Mishnah teaches that if one caught creeping things, he may sell them)?

א''ר (מנא) מיעט איסור הנייה שבו.

(p)

Answer (R' Mana): The verse explicitly permitted deriving benefit from them (as the verse states, "it is an abomination for you'').
