NEDARIM 86 - Two weeks of study material have been dedicated by Mrs. Estanne Abraham Fawer to honor the Yahrzeit of her father, Rav Mordechai ben Eliezer Zvi (Rabbi Morton Weiner) Z'L, who passed away on 18 Teves 5760. May the merit of supporting and advancing Dafyomi study -- which was so important to him -- during the weeks of his Yahrzeit serve as an Iluy for his Neshamah.

RAN DH Amar Rav Ila... [TRANSLATION: Rav Ila said, what if one who says to his friend 'this field that I sell to you, when I will buy it from you, it will be Kodesh' - is it not Kodesh?!]

ר"ן ד"ה אמר רבי אילא...

(SUMMARY: The Ran explains his reasoning, and R. Yirmeyah's objection to it.)

הא דפשיטא ליה לרבי אילא דכה"ג קדשה לאו ממתני' וממתניתא שמיע ליה הכי אלא סברא דנפשיה קאמר

(a)

Explanation: It is obvious to Rav Ila that in such a case it becomes Hekdesh. He did not learn this from a Mishnah or Beraisa. Rather, he said his own reasoning;

דודאי קדשה ומדמי ליה הכי דנהי דודאי סבירא ליה דטעמא דקדשה מפני שברשותו היא עכשיו

Surely, it becomes Hekdesh. He compares as follows. Granted, surely he holds that the reason it becomes Hekdesh is because now it is in his Reshus;

דהא בשמכרתי (הגהות ישנות) לך איהו גופיה מודה דלא קדשה אפ"ה סבירא ליה דקונם שאני עושה לפיך להא דמיא

Source: In the case "that I sold to you", he (Rav Ila) himself agrees that it does not become Hekdesh. Even so, he holds that "what I do is Konam to your mouth" is like this;

דלא דמי לאומר לחבירו שדה שמכרתי לך דלא קדשה משום דבזביני פסיקא מילתא כדאמרינן לקמן דגופא ופירא ביד לוקח

i.

It is unlike one who says to his friend "this field that I sold to you.[should be Hekdesh]." It does not become Hekdesh, because through the sale, it (his control over it) was cut, like we say below, that the Guf (permanent rights to it) and Peros are in the buyer's hand;

מה שאין כן אשה דכיון דגופא בידה הוא ומעשה ידיה היא שמזכה בכל יום לבעל כשדה זו שאני מוכר לך דמיא (הגהת נדרי זריזין)

ii.

This is unlike a woman. Since she herself is in her hand, and every day she acquires her earnings for her husband, this is like "this field that I sell to you."

אע"ג דעדיף (הגהת נדרי זריזין) מיניה שבידו להקדיש עכשיו

(b)

Implied question: (How can we learn from a field?) It has an advantage over [her earnings], for he can be Makdish it now!

קונם דאשה נמי אית ביה חד צד למעליותא טפי משדה משום דבשדה בין שעת הקדשו לשעה שיחול דהיינו לכשיקחנה יש זמן שהשדה יוצא מרשות מקדיש לגמרי גופא ופירא

(c)

Answer: Also Konam of a woman has an attribute over a field, because a field, in between the time of Hekdesh, and the time it takes effect, i.e. when he buys it [back], there is a time that the field totally leaves the Reshus of the Makdish, regarding Guf and Peros;

מה שאין כן גבי אשה שגופה לעולם ברשותה הוא

This does not apply to a woman. Her Guf is always in her Reshus;

ומשום הכי סבירא ליה דכי היכי דבשדה זו שאני מוכר לך לכשאקחנו ממך תקדיש קדשה

Therefore, he holds that just like "this field that I sell to you, when I will buy it from you, it will be Kodesh", it becomes Kodesh...

אשה נמי כי אסרה מעשה ידיה על בעלה לכי מגרשה חייל כך נראה בעיני

ii.

Also a woman, when she forbade her earnings to her husband for when she will be divorced, it takes effect. So it seems to me.

ואפי' הכי אתקיף ליה רבי ירמיה דלא דמי דדלמא האי צד דאיכא בשדה למעליותא דמצי מקדיש לה מהשתא עדיף טפי מההוא צד דאיכא באשה דגופה בידה הוא

(d)

Distinction: Even so, R. Yirmeyah challenged him, for these are different. Perhaps the attribute of a field, that he can be Makdish it now, is preferable to the attribute of a woman, that her Guf is in her hand;

דמאי נפקא מינה כיון דלא מציא לאסור שיחול איסורה עכשיו עד שתתגרש

What difference does it make [that her Guf is in her hand], since she cannot forbid so that the Isur will take effect now, until she is divorced?

הא לא דמיא אלא לאומר לחבירו שדה זו שמכרתי לך לכשאקחנה ממך תקדיש דלא קדשה משום שאין בידו להקדישה עכשיו

2.

Rather, this resembles one who said to his friend "this field that I sold to you, when I buy it from you it will be Kodesh." It does not become Kodesh, because it is not in his hands to be Makdish it now;

ואשה נמי דכוותה היא.

Also a woman is like this.

RAN DH Maskif Lah Rav Papa... [TRANSLATION: Rav Papa objected, is this similar?! Regarding a field, the matter is clear-cut!]

ר"ן ד"ה מתקיף לה רב פפא...

(SUMMARY: The Ran explains why Rav Papa derives oppositely.)

נהי דודאי שפיר קא דחית דליכא למיגמר אשה משדה זו שאני מוכר לך דלא דמיין כדקאמרת

(a)

Admission: Granted, you properly rejected that you cannot learn a woman from "this field that I sell to you", for they are different, like you said;

אפ"ה מאי דבעית למפשט לאידך גיסא דלא חייל קונם דידה משדה זו שמכרתי לך ליתא

(b)

Objection: Even so, what you wanted to resolve the other way, that her Konam does not take effect, from "this field that I sold to you", this is wrong!

דגבי זביני פסיקא מילתא דגופה דשדה ופירא ביד לוקח ומשום הכי לא קדשה

Regarding a sale, the matter is clear-cut. Guf and Peros are in the buyer's hand. Therefore, it does not become Kodesh;

אבל גבי אשה כיון דגופה בידה הוא איכא למימר דקדשה

i.

However, regarding a woman, since the Guf is in her hand, we can say that [her earnings] become Kodesh.

ואדרבה איכא למיפשט הכא דקדשה מהאומר לחברו שדה שמשכנתי לך לכשאפדנה ממך תקדיש

(c)

Just the contrary! We can resolve that it becomes Kodesh, from one who said to his friend "this field that I mortgaged to you, when I redeem it from you it will be Kodesh";

דקדשה משום דגופא דשדה ברשות מקדיש הוא אשה נמי דכוותה

It becomes Kodesh, because the Guf of the field is in the hands of the Makdish. Also a woman is like this!

והאי דנקט לכשאפדנה ממך

(d)

Implied question: Why did it mention "when I redeem it from you"?

משום דהקדש דמים הוא זה ואינו מפקיע מידי שעבוד הלכך אין ההקדש חל עד שיפדנה

(e)

Answer: This is because it is Hekdesh Damim (monetary), and it does not uproot a lien. Therefore, Hekdesh does not take effect until he redeems it.

וההיא דאמרינן בפרק האומר משקלי עלי (ערכין כא) גבי המשכיר בית לחבירו והקדישו משכיר הדר בו מעלה שכר להקדש

(f)

Implied question: In Erchin (21a), regarding one who rented a house to his friend, and the landlord was Makdish it, the tenant pays rental to Hekdesh;

ופרכינן עלה היכי דר ביה במעילה קאי

Citation (21a): How may he live there? He transgresses Me'ilah! (This connotes that monetary Hekdesh uproots a lien.)

כבר כתבתי בפרק השותפין (לעיל /נדרים/ דף מו: ד"ה היכי) דלא קשיא דההיא במשכיר בית סתם היא ולא בית מיוחד

Answer: I already wrote above (46b DH Heichi) that this is not difficult. We discuss one who rents a Stam house, and not a particular house;

ומשום הכי מצי משכיר להקדיש ונותן לו לשוכר בית אחר.

Therefore, the landlord can be Makdish it and give to the tenant another house.

THE RAN EXPLAINS THE GEMARA

ר"ן ד"ה מתקיף ליה רב שישא בריה דרב אידי מי דמי שדה זו בידו לפדותו,

(a)

Gemara - Objection (Rav Shisha brei d'Rav Idi): The comparison is faulty! 'This field', he can redeem it!

ומש"ה כי אמר לכשאפדנה ממך תקדיש קדשה דכל שבידו לאו כמחוסר מעשה דמי

Explanation: This is why when he said "when I will redeem it from you it will be Kodesh", it becomes Kodesh, because anything b'Yado (that he could do) is not as if it is Mechusar Ma'aseh. (We do not say that it does not take effect because an action needs to be done.)

4)

RAN DH Ishah b'Yadah Lehisgaresh [TRANSLATION: Is it in a woman's ability to become divorced?]

ר"ן ד"ה אשה בידה להתגרש

(SUMMARY: The Ran explains that he annuls due to Melachos not in exchange for food.)

בתמיה וכיון שאין בידה שיחול נדרה כשתרצה כי אמרה נמי לכי מגרשה לא חייל

(a)

Explanation: This is said in astonishment. And since it is not b'Yadah to make her vow take effect when she wants, even when she said "when I will be divorced", it does not take effect.

ומקשו הכא אשה נמי בידה היא שיחול נדרה כל שעה ושעה שתרצה דהא קיי"ל כרב הונא דאמר יכולה אשה שתאמר לבעלה איני נזונית ואיני עושה

(b)

Question: Also a woman, it is b'Yadah to make her vow take effect whenever she wants, for we hold like Rav Huna, who says that a woman can tell her husband "do not feed me, and I will not work for you"!

יש לומר דרבי יוחנן בן נורי דאמר יפר לאו משום מה שהאשה חייבת לעשות לבעלה בכל שבוע תחת מזונות קאמר דהיינו משקל חמש סלעים ביהודה שהם עשרה סלעים בגליל

(c)

Answer: R. Yochanan ben Nuri, who said that he annuls, this is not due to what a woman must work for her husband every week in exchange for her food, i.e. [spinning] the weight of five Sela'im [of warp-thread] in Yehudah, which are 10 Sela'im in Galil.

דאי משום הני בלחוד ליכא למימר שמא יגרשנה ותהא אסורה לחזור שהרי אפשר לבעל ליזהר ממנה בכך

(d)

Support: If it were due only to this (what she must produce), he would not say "lest he divorce her and she will be forbidden to return to him." The husband can be careful about [not benefiting from] this;

אלא הכא באוסרת כל הנאה שלה על בעלה עסקינן אפילו אותן שבע מלאכות שחייבת לעשות לו דהיינו טוחנת ואופה ומכבסת וכולהו אינך

Rather, here we discuss one who forbids all Hana'ah from her to her husband, even the seven Melachos that a woman must do for him, i.e. grinding, baking, laundering and all the others.

והיינו דקאמר ותהא אסורה לחזור לו שאינה יכולה לשמשו במלאכות הללו

2.

This is why it says "she may not return to him", for she cannot serve him in these Melachos.

ומהני מלאכות לא כל הימנה להפקיע עצמה שאינן תחת מזונות שתאמר איני ניזונית ואיני עושה

i.

She may not discharge herself from these Melachos, for they are not in place of food, that she would be able to say "do not feed me, and I will not work for you."

הלכך אין בידה להפקיע עצמה מהן שלא תעשה אותן לבעלה אלא לאחר שתתגרש ומשום הכי אמרינן אשה בידה להתגרש בתמיה.

ii.

Therefore, she cannot discharge herself from doing them for her husband; [she is exempted] only after she is divorced. Therefore, we say in astonishment "is it b'Yadah for a woman to become divorced?!"

THE RAN EXPLAINS THE GEMARA

ר"ן ד"ה הא לא דמיא

(a)

Gemara: This is not similar.

פירוש אלא אי מדמית לה להא ודאי דמיא לאומר לחברו שדה זו שמשכנתי לך לעשר שנים תקדוש דקדשה אף על גב דאין בידו לפדותה קודם לעשר שנים

Explanation: Rather, if you compare her, surely she resembles one who tells his friend 'this field that I mortgaged to you for 10 years should be Hekdesh.' It becomes Hekdesh, even though he cannot redeem it before 10 years;

אשה נמי אף על גב דאין בידה להתגרש קודם אסור.

2.

Also a woman, even though she cannot make herself be divorced [her husband decides to divorce her], it is forbidden (her vow takes effect).

ר"ן ד"ה מי דמי התם קיץ

(b)

Gemara: Is this similar?! There, it is limited!

גבי שדה איכא קיצותא לפדותה דהיינו לאחר עשר שנים (הגהת רב רנשבורג, הגהות ישנות) ומשום הכי מצי מקדיש לה מעכשיו

Explanation: Regarding a field, there is a limit to redeem it, i.e. after 10 years. Therefore, he can be Makdish it now;

ר"ן ד"ה הכא לא קיץ

(c)

Gemara: Here, it is not limited.

גבי אשה לית ליה קיצותא דשמא לא תתגרש הלכך דין הוא דלא ליהוי הקדש כי מגרשה כיון שהקדישה בעודה תחתיו.

Explanation: Regarding a woman, there is no limit. Perhaps she will not [ever] be divorced. Therefore, it is proper that [her work] not be Hekdesh [even after] she is divorced, since she was Makdish it while married to him.

RAN DH Ela Amar Rav Ashi... [TRANSLATION: Rather, Konamos are different. They are like Kedushas ha'Guf.]

ר"ן ד"ה אלא אמר רב אשי שאני קונמות דכקדושת הגוף דמיין

(SUMMARY: The Ran explains that therefore, they uproot Shibud.)

שהרי הן כקדושת המזבח דכי היכי דקדשי מזבח אין לה פדיון כך אין פדיון לקונם שיהא מותר למי שנאסר עליו

(a)

Explanation: They (Konamos) are like Kedushas Mizbe'ach. Just like Kedushas Mizbe'ach has no Pidyon, also Konam has no Pidyon to permit it to the one to whom it is forbidden;

וכיון דקונם קדושת הגוף הוא מפקיע מידי שעבוד שהיא משועבדת לבעל וחייל

Since Konam is Kedushas ha'Guf, it uproots her obligation to her husband, and takes effect.

ומשום הכי פסק שמואל כרבי יוחנן בן נורי אע"ג דסבירא ליה לשמואל דאין אדם מקדיש דבר שלא בא לעולם

This is why Shmuel rules like R. Yochanan ben Nuri, even though Shmuel holds that one cannot be Makdish Davar she'Lo Ba l'Olam...

משום דידי אשה איתנהו בעולם ומציא מקדשא להו בקונם שהוא מפקיע מידי שעבוד

This is because a woman's hands are in the world, and she can be Makdish them through Konam, which uproots liens.

ולקמיה פריך אם כן מאי איריא שמא יגרשנה הא מהשתא חייל הקדש.

Below, we ask "if so, why does he say 'lest he divorce her?' From now the Hekdesh takes effect!"

RAN DH d'Amar Rava Hekdesh [TRANSLATION: For Rava said, Hekdesh...]

ר"ן ד"ה דאמר רבא הקדש

(SUMMARY: The Ran discusses which Hekdesh uproots Shibud.)

כגון עשה שורו אפותיקי לבעל חובו והקדישו אחר כך למזבח מפקיע אותו הקדש שעבוד המלוה וגובה חובו ממקום אחר

(a)

Explanation: E.g. he made his ox an Apotiki to his creditor (he stipulated that the loan will be paid from it), and afterwards he was Makdish it for the Mizbe'ach. This Hekdesh uproots the creditor's lien. He collects his loan from elsewhere.

והוא כשר לקרבן ולא הוי גזל כיון דלא הוה קני ליה אלא לגוביינא בעלמא

The ox is Kosher for a Korban. It is not theft, for the creditor acquired it only for mere collection.

ודוקא קדושת הגוף אבל קדושת דמים לבדק הבית לא מפקעא שעבוד

(b)

Opinion #1: This refers only to Kedushas ha'Guf. Kedushas Damim for Bedek ha'Bayis does not uproot a lien;

כדתנן בערכין בפרק שום היתומים (דף כג:) מוסיף עוד דינר ופודה את הנכסים הללו וכו'

Source (Erchin 23b - Mishnah): He adds a Dinar and redeems the property...

שאם הקדיש הלוה נכסיו שמוסיף המלוה דינר על הלואתו ופודה את הנכסים מפני מראית העין

Explanation: If the borrower was Makdish his property, the lender adds a Dinar to his loan and redeems the property. [Really, the property is not Hekdesh, for Kedushas Damim does not uproot a lien. The "redemption" is] due to Mar'is ha'Ayin;

שלא יאמרו הקדש יוצא בלא פדיון וגובה חובו כך כתב רש"י זכרונו לברכה בפרק אף על פי

This is lest people say that Hekdesh goes out [to be Chulin] without Pidyon. [Then the lender] collects his debt. So wrote Rashi in Kesuvos (59b)

אבל רבינו תם זכרונו לברכה חולק עליו שאפילו הקדש דמים מפקיע מידי שעבוד ואין כאן מקום להאריך.

(c)

Opinion #2: R. Tam, of blessed memory, disagrees, and holds that even Hekdesh Damim uproots a lien. This is not the place to elaborate.

8)

RAN DH Chametz

ר"ן ד"ה חמץ

(SUMMARY: The Ran discusses how the Isur of Chametz uproots Shibud.)

ישראל שעשה חמצו אפותיקי לעובד כוכבים ועבר עליו הפסח איסור חמץ מפקיע שעבוד העובד כוכבים ואסור בהנאה

(a)

Explanation: A Yisrael made his Chametz an Apotiki for a Nochri, and Pesach passed. The Isur of Chametz uproots the Nochri's lien, and [the Chametz] is Asur b'Hana'ah.

והא דתנן בפרק כל שעה (פסחים ל:) עובד כוכבים שהלוה את ישראל על חמצו אחר הפסח מותר בהנאה

(b)

Implied question: A Mishnah (Pesachim 30b) teaches that if a Nochri lent to a Yisrael relying on his Chametz [for collateral], after Pesach the Chametz is Mutar b'Hana'ah!

מוקמינן לה התם כשהרהינו אצלו שמסרו אצלו במשכון.

(c)

Answer: There, we establish it when he put the Chametz in the Nochri's Reshus for a security.

THE RAN EXPLAINS THE GEMARA

ר"ן ד"ה ושחרור

(a)

Gemara: And freedom.

עשה עבדו אפותיקי ושחררו לוה משוחרר ומלוה גובה חובו ממקום אחר.

Explanation: He made his slave an Apotiki [to his creditor,] and [afterwards] the borrower freed him. He is free, and the creditor collects his loan from elsewhere.

ר"ן ד"ה אי הכי

(b)

Gemara: If so.

דפקע שעבודא דבעל למה לי שמא יגרשנה מהשתא קדיש.

Explanation: [If] the husband's lien is uprooted, why does he say 'lest he divorce her?' From now it is Hekdesh!"

RAN DH v'Od Shema Yegarshenah ka'Amar [TRANSLATION: He means, and further, perhaps he will divorce her.]

ר"ן ד"ה ועוד שמא יגרשנה קאמר

(SUMMARY: The Ran explains why even if it does not take effect now, it takes effect after divorce.)

מהשתא נמי קדיש דקונם מפקיע שעבודיה דבעל

(a)

Explanation: Also now [before divorce] it is Kodesh, for Konam uproots the husband's lien;

ולכשתמצא לומר דאלמוה רבנן לשעבודיה דבעל בעודה תחתיו דשויוהו כלוקח גמור ולא כמלוה אפ"ה יפר שמא יגרשנה

And if you will say that Chachamim strengthened the husband's lien when she is married to him and made him like a total buyer and not like a lender (therefore, her Konam does not take effect before divorce), even so, he annuls, lest he divorce her.

והיינו דהתם פרק אע"פ פריק אלמוה רבנן לשעבודיה והכא לא אדכר ליה אלא ועוד שמא יגרשנה קאמר ודא ודא אחת היא

Support: There in Kesuvos (59b) we answer that Chachamim strengthened his lien, and here the Gemara does not mention this. It says only "also, perhaps he will divorce her." Both of these are the same. (Also here, it means that even if you will say that Chachamim strengthened his lien, even so, he annuls, lest he divorce her.)

וא"ת ואי אלמוה רבנן לשעבודיה דבעל דלא ליחול השתא הדרא קושיין לדוכתה כיון דהשתא לא חייל לקמיה היכי חייל דהשתא מיהת לא מיגרשא

(b)

Question: If Chachamim strengthened the husband's lien, and [her Konam] does not take effect now, the question returns! Since it does not take effect now, how can it take effect later? Now she is not divorced!

וי"ל דכיון דמדינא חייל אי לאו דאלמוה רבנן לשעבודיה כי אלמוה הני מילי דכל היכא דקיימא קמיה לא ליחול

(c)

Answer: Since according to letter of the law it would take effect, had Chachamim not strengthened his lien, when they strengthened it, this was only so while she is married to him, it does not take effect;

אבל נתגרשה כאילו חייל מעיקרא דמי כיון דמדינא ראוי לחול.

However, when she is divorced, it is as if it took effect from the beginning, since according to letter of the law it was proper to take effect.

THE RAN EXPLAINS THE MISHNAH

ר"ן ד"ה מתני'. נדרה אשתו וסבור שנדרה בתו

(a)

Mishnah: His wife vowed, and he thought that his daughter vowed.

שאמרו לו שבתו נדרה ומתוך כך הפר או קיים.

Explanation: They told him that his daughter vowed, and amidst this he annulled or affirmed.

ר"ן ד"ה וסבור שנדרה בקרבן

(b)

Mishnah: He thought that she vowed about a Korban.

שאמרו לו שאסרה עליה דבר אחד ואמרה שיהא כקרבן.

Explanation: They told him that she forbade one matter to herself, and said that it should be like a Korban.

ר"ן ד"ה הרי זה יחזור ויפר

(c)

Mishnah: He returns and annuls.

דהקמה או הפרה קמייתא כיון דבטעות הוי לא מהני ולא מידי

Explanation: The first Hafarah or Kiyum, since it was mistaken, did not help at all.

והכי איתא בתוספתא (פ"ז) בהדיא שאם הקים בטעות יכול להפר

Support: The Tosefta (Perek 7) explicitly says that if he mistakenly affirmed, he can annul.

דתניא התם נדרה אשתו וקיים לה וסבור בתו נדרה בתו וקיים לה וסבור אשתו נדרה הרי זה יפר וכו'.

Citation (Tosefta): If his wife vowed, and he affirmed her [vow], and he thought that his daughter vowed, or his daughter [vowed], and he affirmed, and he thought that his wife vowed, he can annul...

RAN DH Gemara Lemeimra d'Yani... [TRANSLATION: This means that "he will annul her" is precise!]

ר"ן ד"ה גמ' למימרא דיניא אותה דוקא הוא

(SUMMARY: The Ran discusses the source to say so about Hakamah.)

דכיון דכתיב אותה משמע שיפר לשם אותה שנדרה ולא שיטעה באשה אחרת

Explanation: Since it says "Osah", this connotes that he annuls for the sake of the one who vowed, and he does not err about another woman.

וקשה לי כיון דמאותה מפיק לה תינח בהפרה דכתיב אותה אבל בהקמה מנלן האי דכתיבנא במתני' ואיתיה בתוספתא

(b)

Question: Since we learn from "Osah", granted, this teaches about Hafarah, about which it says "Osah." Regarding Hakamah, what is the source for what I wrote in our Mishnah [that mistaken Hakamah is invalid], and is brought in the Tosefta?

וכ"ת כיון דהקמה והפרה איתקיש וכדאמרי ליה רבנן לר' אליעזר בפירקין דלעיל /נדרים/ (דף עה)

Implied suggestion: It is because there is a Hekesh between Hakamah and Hafarah, like Rabanan said to R. Eliezer above (75a);

אמרו לו אישה יקימנו ואישה יפרנו את שבא לכלל הקם בא לכלל הפר

Citation (75a): They said to him "Ishah Yekimenu v'Ishah Yeferenu" - what can be Mekuyam can be annulled.

ור' עקיבא נמי לקמן /נדרים/ (דף פז:) מקיש הפרה להקמה מה הקמה ממנו אף הפרה ממנו

Support: Also R. Akiva below (87b) equates Hafarah to Hakamah. Just like partial affirmation suffices, also partial annulment suffices.

Since we hold that Hafarah is only Osah (he knows for whom he annuls), it is as if it is written Osah [also] regarding Hakamah.

Conclusion: Rather, surely even the one who equates them, he equates them only for matters in that verse itself. It is not a Hekesh, rather, a mere Semichus (they are written near each other) "Ishah Yekimenu v'Ishah Yeferenu." (Rashash - two matters in the same verse is a Semichus! Also, there is Vov Mosif Al Inyan Rishon, which (teaches that the law of the previous Parshah applies), like a Hekesh! Tif'eres Tziyon - since we do not equate them for Hafarah b'Libo (in his heart - 79a), we infer that Chazal knew that we do not expound a Hekesh, rather, a mere Semichus. PF - often, we expound a Hekesh (e.g. divorce and Kidushin), even though a verse overrides it (money does not divorce, even though it is Mekadesh (Kidushin 5a)! Here is different, for the Gemara did not bring a source to distinguish Kiyum b'Libo from Hafarah b'Libo.)

Reiteration of Question (b): Therefore, granted, it says "Osah" regarding Hafarah. However, for Hakamah, what is the source?

ואפשר דלה דכתיב בהקמה כדכתיב כי החריש לה כאותה דמי ומשמע דוקא

Answer: Perhaps "Lah" written regarding Hakamah, like it says "Ki Hecherish Lah", is like Osah. It connotes specifically [the one for whom he intended].

Ruling: It seems to me from here l'Halachah, that just like above it is obvious that a husband cannot annul for his two wives at once, for Osah is precise...
