THE RAN EXPLAINS THE MISHNAH

ר"ן ד"ה הפר האב ולא הפר הבעל

(a)

Mishnah: If the father annulled but the husband did not annul.

בגמרא פריך היינו רישא.

Explanation: The Gemara asks, this is the same as the Reisha.

ר"ן ד"ה ואין צריך לומר קיים אחד מהן

Mishnah: There is no need to teach if one of them affirmed.

שאין האחד יכול להפר ובגמרא פריך למה ליה למיתנא.

Explanation: That the [other] one cannot annul. The Gemara will ask why this needed to be taught.

ר"ן ד"ה גמ'. היינו רישא אביה ובעלה מפירין נדריה

Gemara: This is like the Reisha - her father and her husband annul her vows!

דמשמע דוקא כששניהם מפירין.

Explanation: It implies that specifically when both of them annul.

ר"ן ד"ה מהו דתימא אביה או בעלה

Gemara: One might have thought her father or her husband.

ולא סגי ליה דליתני עד שיפרו שניהם דאי תנא הכי הוה אמינא דלא סגי בהפרת בעל עד דליפר אב אבל בהפרת אב לחודיה סגי

Explanation: It is not enough to teach 'until both of them annul', for had it taught so, one might have thought that Hafarah of the husband does not help until the father annuls, but Hafarah of the father helps by itself.

א"נ איפכא וכדשקלינן וטרינן בהא לקמן בשמעתין להכי תנא הפר האב ולא הפר הבעל הפר הבעל ולא הפר האב אינו מופר.

Alternatively, oppositely (Hafarah of the father does not help by itself until the father annuls, but Hafarah of the husband helps by itself), like the Sugya discusses below. Therefore, it taught that if the father annulled but the husband did not, or the husband annulled but the father did not, it is not annulled.

ר"ן ד"ה קיים אחד מהן צריכא למיתני

Gemara: If one of them affirmed, need this be taught?!

בתמיה

Explanation: This is said in astonishment.

דאע"ג דאורחיה דתנא למתני זו ואין צ"ל זו

Implied question: The Tana is wont to teach 'this, and it goes without saying this'! (Why is the Gemara astounded?)

היינו דוקא במילי דלא דמו להדדי דאע"ג דאתיא בתרייתא מק"ו מקמייתא תני לה

3.

Answer: That is only regarding matters that do not resemble each other. Even though the latter is learned from a Kal v'Chomer from the first, he taught it;

אבל הכא חדא מלתא היא דהפר אחד וקיים אחד היינו ממש הפר זה בלא זה ועדיפא מינה.

However, here it is one matter. One of them annulled and one of them affirmed. This is truly when one annulled without the other, and it is better than it (more clear that it is not annulled).

ר"ן ד"ה וחזר המקיים ונשאל על הקמתו

Gemara: And the one who affirmed, he went back and asked about (undid) his affirmation.

כדאמרינן לקמן דנשאלין על ההיקם

Explanation: This is like we say below, that one can ask [to permit] Hakamah.

ר"ן ד"ה מהו דתימא מאי דאוקי הא עקריה

Gemara: What might you have thought? What he affirmed, he uprooted.

ובהפרה דמקיים לחודיה סגי דאידך כבר הפר

Explanation: And it suffices for the one who was Mekayem to annul [now], for the other already annulled.

RAN DH Ka Mashma Lan... [TRANSLATION: [The Mishnah] teaches that this is not so. [The vow lasts] until both of them annul at once.]

ר"ן ד"ה קמ"ל דעד דמפירין שניהם בבת אחת

(SUMMARY: The Ran explains that both must annul after he permits his Hakamah.)

כלומר שלא יפסיק בין אחד לחבירו דבר שהוא מעכב הפרה כגון הקמה דהאי

Explanation: I.e. without interruption between one and the other of something that prevents Hafarah, such as Hakamah of the other;

דכיון דההיא שעתא לאו בר הפרה הוא אפי' הך הפרה קמייתא דאידך בטלה לה וצריך שיהו מפירין עכשיו שניהם בבת אחת

Since at the time he cannot annul, even the first Hafarah of the other is Batel, and both of them must annul now at once.

ומיהו בהכי (גירסת כתב יד) סגי שלא תאמר אין הפרה אחר הפרה וכיון דהפרה קמא איבטילא תו לא מצי מיפר דליתא וכן דעת הרמב"ן ז"ל

Opinion #1: However, this suffices. Do not say that there is no Hafarah after Hafarah, and since the first Hafarah is Batel, he cannot annul afterwards. This is wrong. Also the Ramban says so.

אבל מדברי הר"ם במז"ל נראה דכל שחלה הקמה בין הפרה דחד להפרה דאידך שוב אינן יכולין להפר

(c)

Opinion #2: However, the Rambam connotes that whenever Hakamah took effect between Hafarah of one and Hafarah of the other, they cannot annul.

ומיהו בבת אחת לאו דוקא דאפי' מיפר זה שחרית וחבירו ערבית סגי כל שלא הפסיק בינתיים דבר שהוא מעכב הפרה

Qualification: "At once" is not precise. Even if one annulled in the morning and the other at night, it suffices, as long as there was no interruption between them of something that prevents Hafarah.

וכ"ת כיון דהאי דינא אתא תנא לאשמועי' מאי אין צריך לומר דקתני דמרישא משמע הכי

Question: Since the Tana comes to teach this law, why did he teach "we need not say [when one of them was Mekayem]", for we infer this from the Reisha?

אדרבה צריכא

Just the contrary, this is [greatly] needed!

דיש לי לומר דתנא הכי קתני כיון דהפרה דחד בלא חבריה לאו כלום הוא א"צ לומר דבשקיים אחר הפרה קמייתא לאו מידי הוא

Answer: I can say that he teaches as follows. Since Hafarah of one without the other is nothing, we need not say that when one of them was Mekayem, the first Hafarah is nothing;

וסמיך תנא דלשתמע ממלתיה דתו לא חזיא לצרופי דאי חזיא למה ליה למיתני א"צ לומר היינו כפרכא דגמרא

The Tana relies that we understand from his teaching that it is no longer able to join [to the other's Hafarah]. If it were able, why did he teach "we need not say", like the Gemara asked?

והקשה הרשב"א ז"ל אמאי אמרינן דהפרה קמייתא בטלה לה דהא לבתר דאתשיל על הקמתו כיון דחכם עוקר את הנדר מעיקרו הרי הוא כאילו לא הקים כלל

Question (Rashba): Why do we say that the first Hafarah was Batel? After he permitted his Hakamah, since a Chacham uproots a Neder from the beginning, it is as if he never was Mekayem at all!

וכדתנן בפרק האיש מקדש (דף נ) המקדש את האשה ע"מ שאין עליה נדרים ונמצאו עליה נדרים אינה מקודשת

This is like the Mishnah in Kidushin (50a), if one was Mekadesh a woman on condition that she has no Nedarim, and she was found to have Nedarim, she is not Mekudeshes;

הלכה לפני חכם והתירה הרי זו מקודשת דחשבינן לה כאילו לא היה עליה נדרים כלל בשעת קדושין

i.

If she went in front of a Chacham and he permitted her, she is Mekudeshes, for we consider her as if she had no Nedarim at all at the time of Kidushin.

ה"נ לבתר דאתשיל נחזייה להאי גברא כאילו לא הקים מעולם

Also here, after he permitted [his Hakamah], we should view him as if he was never Mekayem!

ולדידי לאו קושיא היא כלל דקידושין מתוך שהוא מעשה גמור אע"ג דכל זמן שלא התירה לא חיילי כי התירה אמרינן דאיגלי מילתא דמעיקרא חיילי

(h)

Answer: To me, this is not difficult at all. Since Kidushin is a total action, even though as long as she did not permit [her vows] it does not take effect, when she permits, we say that retroactively it is revealed that it took effect from the beginning;

אבל הפרה דחד מהני קלשה לה טפי דבאפי נפשה לאו מידי היא אלא בצרופא דאידך

However, Hafarah of one of them is weaker, for by itself is nothing, unless it joins with the other;

ואפי' בצרופא דאידך לא מהני כל זמן שאינן ראוים להצטרף ביחד וכדתניא דהפר א' מהן ומת בטלה לה הפרתו

And even when it joins with the other, it does not help as long as they are not proper to join together, like a Beraisa teaches, that if one of them annulled and died, his Hafarah is Batel;

הלכך כיון דהפרה דחד אפי' כי לא הקים חבריה קלישא טובא כל היכא דהקים כיון דההיא שעתא לא חזיא לאצטרופי בטלה לה לגמרי

i.

Therefore, since Hafarah of one of them, even if the other was not Mekayem, is very weak, whenever the other was Mekayem, since at the time it is not able to join, it is totally Batel;

וכיון דלא חזיא ההיא שעתא לא חזיא נמי בתר זימנא.

ii.

Since it is not able [to join] at the time, it is not able [to join] also afterwards.

RAN DH v'Na'arah Me'orasah... [TRANSLATION: An engaged Na'arah, that her father and her husband annul her vows, what is the source? Rabah said, "and if she will be to a man..." teaches that her father and her husband annul her vows.]

ר"ן ד"ה ונערה המאורסה דאביה ובעלה...

(SUMMARY: The Ran explains how we conclude that it must discuss an Arusah.)

נראה לי דה"ק דכיון דלנשואה כתיב קרא אחרינא דהיינו אם בית אישה נדרה כדמפרש לקמן על כרחין האי בארוסה מתוקמא דתרי קראי בנשואה למה לי

Explanation: It seems to me that it means that as follows. Since another verse teaches about a Nesu'ah, i.e. "Im Beis Ishah Nadarah", like we explain below, you are forced to say that we establish this verse to discuss an Arusah. Why would we need two verses about a Nesu'ah?!

וכיון דבארוסה מתוקם על כרחין אית לן למימר דוי"ו מוסיף על ענין ראשון

Since we establish it to discuss an Arusah, we are forced to say that Vav Mosif Al Inyan Rishon;

דלעיל מיניה כתיב וה' יסלח לה כי הניא אביה אותה ובתריה כתיב ואם ביום שמוע אישה יניא אותה לומר שאביה ובעלה מפירין נדריה

Above, it says "va'Shem Yislach Lah Ki Heni Aviha Osah", and afterwards it says "v'Im b'Yom Shemo'a Ishah Yani Osah" to teach that her father and husband annul her Nedarim;

ואתי שפיר בארוסה דכיון דבארוסה לא יצתה מרשות אב דין הוא דלא ליפר ארוס לחודיה

i.

It is fine to establish this to discuss an Arusah. Since an Arusah did not leave her father's Reshus, it is proper that the Arus cannot annul alone.

ועל כרחין נמי הכי אית לן למימר דאי לא אמרי' וי"ו מוסיף על ענין ראשון וארוס לחודיה מיפר קרא דנשואה ל"ל

Support: We are forced to say so. If we would not say Vav Mosif Al Inyan Rishon, and an Arus can annul alone, why would we need a verse for a Nesu'ah?

השתא בארוסין מיפר לחודיה בנשואין מיבעיא וכי בשביל שנשאה הורע כחו

During Eirusin, [her husband] can annul alone. Is there any question about during Nisu'in? Because he did Nisu'in, was his power weakened?!

והדר מקשי לפרושי מילתיה ומקשי אימא הדין קרא בנשואה כתיב לומר דבעל לחודיה מיפר דוי"ו מוסיף על ענין ראשון לא אמרינן ליה אלא כי מוכחי קראי הכי

Explanation (cont.): We then challenge in order to explain the matter. We ask, perhaps the verse discusses a Nesu'ah, to teach that a husband annuls alone, for we say Vav Mosif Al Inyan Rishon only when it is proven from the verses;

ואי מיתוקם בארוסה מוכחי כדכתיבנא אבל בנשואה לא מוכחי כלל אדרבה דינא הוא דבעל לחודיה מיפר (מכאן מעמוד ב) דכיון שנשאת שוב אין לאביה רשות בה

If we establish the verse to discuss an Arusah, it is proven, like I wrote. However, regarding a Nesu'ah, it is not proven at all. Just the contrary, it is proper that the husband annul alone, for once she had Nisu'in, her father has no Reshus over her.

הלכך נימא דבנשואה בעלה לחודיה ליפר ובארוסה אב לחודיה ליפר דהא בארוסין לא נפקא מרשות אב,

Therefore, we should say that for a Nesu'ah, her husband annuls alone, and for an Arusah, her father annuls alone, for through Eirusin she does not leave her father's Reshus.

ומהדר ליה דליכא לאוקמה בנשואה דבנשואה כתיב קרא אחרינא אם בית אישה נדרה ותרי קראי למה לי

We answer that we cannot establish it to discuss a Nesu'ah, for another verse teaches about a Nesu'ah, i.e. "Im Beis Ishah Nadarah." Why would we need two verses?!

וכדסליק אדעתיה מעיקרא אלא דהש"ס מפרש מילתיה קימעא קימעא.

This is like we initially thought, just the Gemara explains the matter bit by bit.

THE RAN EXPLAINS THE GEMARA

ר"ן ד"ה ואימא תרווייהו בנשואה

(a)

Gemara: Say that both of them discuss a Nesu'ah!

אבל בארוסה לא צריך בעל כלל

Explanation: However, for an Arusah, [her father annuls alone; he] does not need the husband at all.

ר"ן ד"ה וכ"ת תרי קראי למה לי לומר שאין הבעל מיפר בקודמין

(b)

Gemara: And if you will say, why are two verses needed? They teach that a Ba'al cannot annul Kodmin (vows before Nisu'in).

ולהכי הדר וכתב ואם בית אישה נדרה לאשמועינן שאין הבעל מיפר נדרים שקדמו לה קודם שנשאה.

Explanation: Therefore it returned and wrote "v'Im Beis Ishah Nadarah", to teach that a husband does not annul previous vows from before Nisu'in.

ר"ן ד"ה הא ממילא שמעת מינה

(c)

Gemara: We know this automatically!

דואם (כן צריך להגיה) בית אישה לחודיה סגי דמשמע מיניה דבעל מיפר ושאינו מיפר בקודמין.

Explanation: "V'Im Beis Ishah Nadarah" alone suffices. It implies that a husband annuls, and he does annul Kodmin.

RAN DH v'Iy Bo'is Eima... [TRANSLATION: And if you want, you can say that Havayah implies Eirusin.]

ר"ן ד"ה ואיבעית אימא הויה קדושין משמע

(SUMMARY: The Ran points out that "Havayah" connotes also Nisu'in.)

הלכך על כרחיך לא מצית אמרת דבארוסה אב לחודיה מיפר דהויה קדושין משמע

(a)

Explanation: Therefore, Al Korchacha (against your will) you cannot say that a father annuls alone for an Arusah, for "Havayah" connotes Kidushin.

אלמא בנערה המאורסה צריך בעל ולא סגי באב לחודיה

Inference: Na'arah Me'orasah needs [also] the husband. The father alone does not suffice.

וכ"ת נהי דהויה קדושין משמע נשואין נמי משמע דהא ביבמות (דף ס) אמרינן דכהן מיטמא לאחותו ארוסה

(b)

Question: Granted, "Havayah" connotes Kidushin. It also connotes Nisu'in, for in Yevamos (60a) we say that a Kohen [has a Mitzvah to] become Tamei for his Arusah sister;

ומוקמי קרא דולאחותו הבתולה הקרובה אליו אשר לא היתה לאיש בשנשאת אלמא הויה נמי נשואין משמע

We establish the verse "ul'Achoso ha'Besulah ha'Kerovah Elav Asher Lo Haysah l'Ish" to discuss (exclude) a Nesu'ah. This shows that "Havayah" connotes also Nisu'in!

וכיון שכן נימא דבין בקדושין בין בנשואין אביה ובעלה מפירין נדריה

Therefore, we should say that both [after] Kidushin, and after Nisu'in, her father and husband annul her vows!

ליתא דפשיטא לן דכיון שנשאת שוב אין לאביה רשות בה

Answer #1: This is wrong. It is obvious to us that once she had Nisu'in, her father has no Reshus in her [vows].

ועוד דהא כתיב ואם בית אישה נדרה דאלמא בעל מיפר לחודיה.

(d)

Answer #2: "Im Beis Ishah Nadarah" teaches that a Ba'al (after Nisu'in) annuls alone. (Surely the Torah taught a Nesu'ah separately because the law changed.)

RAN DH Eima Av Lechudei Leifer [TRANSLATION: Say that a father alone annuls!]

ר"ן ד"ה אימא אב לחודיה ליפר

(SUMMARY: The Ran explains that in the Hava Amina, the Arus can only be Mekayem.)

נ"ל דאב לחודיה ליפר הוא דקשיא ליה דכיון דלא יצתה מרשות האב כדכתיבנא לעיל בדין הוא דמצי מיפר

Explanation: It seems that he asks that the father should be able to annul by himself. Since she did not leave her father's Reshus, like I wrote above, it is proper that he can annul;

אבל ארוס לא וסמיכותא דואם היו תהיה היינו לומר דארוס בעי אב

However, an Arus cannot annul alone. The verse "v'Im Hayo Sihyeh" is written next to ["v'Im Heni Aviha..."] to teach that an Arus needs the father [to annul with him].

וארוס דכתב רחמנא לומר שאם הקים הוקם כדאמרי' בסמוך עליה דאב

The Torah wrote about an Arus to teach that if he was Mekayem, the vow stands, like we say below about the father (if the Arus can annul by himself, the Torah wrote about the father to teach that if he was Mekayem, the vow stands).

ואע"ג דכתיב עליה דאם היו תהיה לאיש וכו' ואם ביום שמוע אישה יניא אותה והפר את נדרה וכו'

(b)

Implied question: It says about her (an Arusah) "v'Im Hayo Sihyeh l'Ish... "v'Im b'Yom Shemo'a Ishah Yani Osah v'Hefer Es Nidrah"! (This shows that an Arus can annul.)

לאו למימרא דהפרתו תועיל כלל אלא שאם לא הפר ביום שמעו נמצא שהקים

(c)

Answer: This does not show that his (an Arus') Hafarah helps at all. Rather, if he did not annul on the day he heard, it turns out that he was Mekayem;

דלהכי בלחוד הוא דאוקמה ברשותא דארוס ולאו למידי אחרינא

Only for this the Torah established her in the Arus' Reshus (that he can be Mekayem), but not for anything else.

דכיון דלא יצתה מרשות אב אין לך לזכות בארוס אלא בפחות שבשיעורין.

Since she did not leave her father's Reshus, we should award the Arus with the smallest rights.

ר"ן ד"ה ומהדר ליה א"כ ואסרה אסר בבית אביה למה לי

Gemara: If so, why does it say "v'Asrah Isar b'Veis Aviha"?

כלומר אמאי טרח קרא לאשמועי' דבעודה פנויה מיפר אב לאשמועי' הכי בתר קרא דואם היו תהיה ואנא אמינא במקום ארוס אב מיפר לחודיה שלא במקום ארוס מיבעיא.

Explanation: Why did the verse toil to teach that when she is still single, her father can annul? Let it teach so after the verse "v'Im Hayo Sihyeh l'Ish", and I would say that if when there is an Arus, a father can annul by himself, when there is no Arus, is there a question?!

RAN DH Eima Av Ba'i Arus... [TRANSLATION: Say that a father needs the Arus, but the Arus alone can annul!]

(SUMMARY: The Ran explains why we ask oppositely to the previous question.)

מכי חזא דמאי דסליק אדעתיה מעיקרא דנערה המאורסה לא יצתה כלל מרשות אב ליתיה דעל כרחין כשנתארסה אב לחודיה לא מצי מיפר

Explanation: Once we see that the initial Hava Amina, that a Na'arah Me'orasah did not leave her father's Reshus at all, is wrong, for you are forced to say that after Eirusin, her father cannot annul alone...

מפיך ליה לפרכיה דכיון שכן אדרבה משמעותא דקראי דארוס עיקר ואב טפל לו

We ask oppositely now. Since this is so (she left his Reshus), the verse connotes that the Arus is primary and the father is secondary!

דכיון דטרח רחמנא לאשמועינן דאב מיפר קודם שנתארסה מכלל דלאחר שנתארסה נפקא לה מרשותיה

Since the Torah toiled to teach that a father annuls before Eirusin, this implies that after Eirusin, she leaves his Reshus;

וכיון דכתב קרא בהדיא דארוס מיפר משמע דלחודיה מיפר ושותפותיה דאב דליתיה אלא משום וי"ו מוסיף על ענין ראשון

Since the verse explicitly wrote that an Arus can annul, this connotes that he can annul alone. We know the partnership of the father only due to Vav Mosif Al Inyan Rishon...

מסתייך אי מוקמת ליה לומר שאם הקים הוקם דודאי פשטיה דקרא משמע דארוס לחודיה ליפר

i.

Therefore, it should suffice to establish [his partnership] to be that if he was Mekayem the Neder, it is Mekayem, for surely the simple meaning of the verse connotes that an Arus can annul alone;

אלא דלא מצינן למימר דלא שייך אב בנדרי ארוסה אלא ארוס דאי הכי הפרת אב דכתב רחמנא למה לי

ii.

However, we cannot say that a father has no part in vows of an Arusah, and only the Arus does, for if so, why did the Torah write [this next to] Hafarah of the father?

וכיון שכן כל היכא דמוקמת ליה לאב במידי סגי לן ונוקמיה הכי לאם הקים הוקם

iii.

Therefore, any way we can establish the father to have some [part in Hafarah], this suffices. We should establish it that if he was Mekayem, it is Mekuyam!

RAN DH [TRANSLATION: We answer, if so, why do we need "Im Beis Ishah Nadarah"? A Kal va'Chomer [teaches that a Ba'al annuls alone after Nisu'in]!]

According to letter of the law we should have said that her father can annul alone, if not for the question "if so, why do we need "v'Asrah Isar b'Veis Aviha"? ...

לית לן לגרועי הניאה דאב אלא אמאי דמוכחא לן האי פירכא אבל לענין אם הקים הוקם דלא מוכחא לן לא.

[Therefore,] we should diminish Hafarah of the father only as much as is proven from this question, but not that if he was Mekayem, it is not Mekuyam, which is not proven.

Gemara - Suggestion: Say that "Im Beis Ishah Nadarah" teaches that a Ba'al cannot annul Kodmin!

Explanation: From what you said that a Ba'al (of a Nesu'ah) cannot annul Kodmin (vows from before Nisu'in), we learn that an Arus can annul only with partnership of the father;

דהאב וארוס מיפר בקודמין כדמשמע מונדריה עליה נדריה שהיו עליה כבר

The father and Arus annul Kodmin, like [the verse] connotes "u'Nedareha Aleha" - vows that she already had.

והיכי אפשר דארוס מיפר ולא בעל לאו משום שותפותיה דאב דמפר בכולה דגבי אב ליכא קודמין כנ"ל פירושא דשמעתא.

How is it possible that an Arus can annul, and a Ba'al cannot? Is it not due to partnership of the father that he can annul all vows, for regarding the father, there are no Kodmin? It seems to me that this is the explanation of our Sugya.
