ואין מטהר בזוחלין אלא עד המקום שהיה יכול להלך מתחילתו

(a)

Distinction: It is Metaher through flowing water only up to where it could go initially.

והיינו נמי דתנן בפרק ה' (כן צריך להגיה) דמקואות מעיין שהוא מושך כנדל רבה עליו מים והמשיכו הרי הוא כמות שהיה

Support: A Mishnah (Mikva'os 5:3) teaches that if a spring flowed like a Nadel (centipede), and they added water to make it flow [more], its law did not change;

היה עומד ורבה עליו והמשיכו שוה למקוה לטהר באשבורן ולמעיין להטביל בו בכל שהוא

If the spring was initially stagnant, and they increased the flow, it is like a Mikveh to be Metaher b'Ashboren, and it is like a spring to immerse [Kelim] in any amount.

וה"פ מעיין שהיה מושך מעט מעט כנדל זה שהוא שרץ קטן מרובה הרגלים והמשיכו עכשיו בשטף אבל אינו נמשך אלא באותו מקום שהיה מהלך בו מתחילתו הרי הוא כמות שהיה

Explanation: If a spring initially flowed very slowly like a Nadel, i.e. a small vermin with many legs, and they caused it to flow quickly now, but it flows only where it flowed initially, its law did not change;

וסיפא קתני דאם היה עומד כלומר שלא היה נמשך כלל ורבה עליו והמשיכו שני דינין יש בו דבמקום שלא היה מהלך מתחלתו שוה למקוה שצריך אשבורן וה"ה שאין מטבילין בו בכל שהוא

The Seifa teaches that if it was stagnant, i.e. it did not flow at all, and they added and increased the flow, it has two laws. Where it did not flow initially, it is like a Mikveh, which needs Ashboren. Likewise, one may not immerse [Kelim] there in any [arbitrarily small] amount;

ובמקום שהיה עומד מתחלתו שוה למעיין להטביל בו בכל שהוא ומינה שהוא מטהר בזוחלין

Where it stood initially, it is like a spring to immerse [Kelim] in any amount. From this we derive that it is Metaher through flowing water.

נמצא לפי דעת זה שאפי' בזמן גשמים שהנהרות רבים אדם טובל בנהרות שאינן מכזבין באותן מקומות שהן נמשכין והולכין אפי' ביומי תשרי

Consequence: According to this opinion, even at a time of rain when rivers increase, one may immerse in rivers that do not cease, in the places they flow even in the days of Tishrei;

אבל באותן מקומות שנמשכים ומתרחבים יותר מהגשמים כל היכא דאיכא למיחש שרבו הנוטפין על הזוחלין אין טובלין בהם

However, in the places they widened and now flow due to the rainwater, wherever there is concern lest Notefin became the majority over flowing water, one may not immerse there.

אבל היכא שרבו זוחלין על הנוטפין אפי' באותן מקומות שלא היה הולך שם מתחלתו טובלין בו

However, where there is more flowing water than Notefin, even in places where it did not initially go, one may immerse.

והיינו ההיא דר"א בר צדוק שהעיד על הזוחלין שרבו על הנוטפין שכשרי' ומטהרין בזוחלין

Support: This is what R. Eliezer bar Tzadok testified, that if there is more flowing water than Notefin, it is Kosher and it is Metaher through flowing water;

ובודאי אפי' במקום שנתרבה קאמר דאי באותו מקום בלבד שהיה מהלך מתחלתו מאי אסהדתי' פשיטא דהיכי תיסק אדעתין ששנים או שלשה טיפי מים יפסלו פרת מלטבול בו

Surely this is even in a place where it widened. If it were only where it initially went, what is [the Chidush of] his testimony? This is obvious! How would one think that two or three drops of [Notefin] water would disqualify the Pras from immersing in it?!

אלא ודאי כדאמרן וזהו דעת הראב"ד ז"ל.

Rather, surely it is like we said. This is the Ra'avad's opinion.

דעת הרמב"ם ז"ל דכי קתני בכל הני דאע"פ שרבו עליו נוטפין דינו כמעיין דוקא כשרבו המים בגומת המעיין עצמו ששם הוא חשיבות מימיו ומבטלים כל המים הבאים עליהם

Explanation: The Rambam holds that when it says in all these places "even if Notefin became the majority, it has the law of a spring", this is only when the water increased at the source of the spring. There is the importance of its waters, and all water that comes on (is added to) them is Batel;

אבל רבה במקום משך הנהר למטה כל שרבו נוטפין על הזוחלין נפסל כולו

However, if it increased along the course of the river, whenever Notefin became the majority over flowing water, it is totally Pasul.

ולפי זה אתיא מימרא דשמואל כפשטה דאין המים מטהרין בזוחלין אפילו באמצע הנהר במקום שהיה מהלך בו בתחלה אלא פרת ביומי תשרי בלבד וכפי מה שפירש' למעלה

Support: According to this, Shmuel's teaching is like its simple meaning. Flowing water is not Metaher, even in the middle of the river where it used to flow from the beginning, except for the Pras in Tishrei, like I explained above.

ולפי זה הא דמפליג בתוספתא בין נתרחב ללא נתרחב נ"ל דאריבה בגומת המעיין קאי דאפי' הכי כל שרבו נוטפין אינו מטהר אלא במקום שהיה מהלך מתחלתו אבל במקום שנתרחב אינו מטהר אלא באשבורן

Consequence: According to this, the Tosefta's distinction between whether or not it widened, it seems to me that this refers to increase in the spring's source. Even so, if Notefin became the majority over flowing water, it is Metaher only where it flowed initially. Where it widened, it is Metaher only through Ashboren.

ואף על גב דאיכא למימר איפכא דאריבה בהמשך הנהר קאי אבל ריבה בגומת המעיין אפי' בנתרחב כשר

Implied question: We could say oppositely! Perhaps it refers to increase along the course of the river, but if it increased at the source, even where it widened is Kosher!

Distinction: However, R. Eliezer bar Tzadok's testimony, even according to this opinion, surely implies that it is even where the river widened. As long as the majority is flowing water, it is Kosher.

דליכא למימר דאריבה במקום משך הנהר קאי ואשמעינן רבותא שאע"פ שלא ריבה במקום גומת המעיין אלא במקום שנמשכו מימיו כשר

Suggestion: Perhaps we can say that it refers to increase along the course of the river, and teaches a Chidush, that even though it did not increase at the source, only where the water flowed, it is Kosher!

דאכתי פשיטא וכי ג' טיפי מים יפסלו פרת.

Rejection: Still, this is obvious! Could two or three drops of water disqualify the Pras?!

RAN DH Tanan [TRANSLATION: A Mishnah taught.]

(SUMMARY: The Ran brings Mishnayos about Tevilah in flowing water.)

במס' מקואות (פ"ה מ"ה) הנוטפין שעשאן זוחלין כלומר שהמשיכן

Citation: A Mishnah (Mikva'os 5:5) says, 'if Notefin became flowing.' I.e. he added water [to increase them];

סומך אפי' מקל ואפי' קנה ואפי' זב ואפי' זבה כלומר גודר בפניהם באלו והוו להו כאשבורן ומטהרין

[The Mishnah says,] one may put next to them even a staff, even a reed, even a Zav, and even a Zavah. I.e. one uses these to fence in front of them, and they are like Ashboren, and they are Metaher.

R. Yosi says, we do not make flow with something that is Mekabel Tum'ah. I.e. we do not make a fence.

Explanation: A spirit of insanity seized that mule, and threw him into the water. Istuyat is an expression of Satya, a spirit of insanity, like we say 'Siyuta seized it' (Bava Kama 37b).

Gemara: Akrokasa (frog).

צפרדע.

Translation: 'Akrokasa' means frog.

Gemara: [A fever] clothed him.

Gemara: At the head of the sifter.

Explanation: At the beginning of the sifting of the sifter.

Gemara: Bordam

תיבה אחת כשתי תיבות בור דם והוא חולי שמקלח דם מלמטה.

Explanation: It is one word that is like two words - Bor Dam (a pit of blood). It is an illness in which blood flows below.

Gemara: We do not visit him.

Explanation: It is because sometimes he needs to defecate, and they pain him. (I.e. for he is embarrassed to leave the visitors to go to defecate. - PF)

Gemara: And we do not mention its name.

Gemara: Refu'as Nefesh is for free.

Explanation: 'Nefesh' means desire, like we find "Im Yesh Es Nafshechem." I.e. he heals him if he wants, but not for wages.

ומתוקמא מתני' בשנכסי חולה אסורין על הרופא.

We establish our Mishnah when the Choleh's property is forbidden to the doctor.

RAN DH Ela Refu'as Nefesh Gufo [TRANSLATION: Rather, Refu'as Nefesh is his body.]

ר"ן ד"ה אלא רפואת נפש גופו

(SUMMARY: The Ran explains that there is another doctor there.)

ומתוקמא בשנכסי רופא אסורים על החולה ומשום הכי לא ירפא בהמתו

(a)

Explanation: We establish this when the doctor's property is forbidden to the Choleh. Therefore, he may not heal his animal;

וכשיש שם רופא אחר דאי לא שרי לרפאותה דהא תנן מחזיר לו אבידתו ואין לך השבה גדולה מזו

This is when there is another doctor there. If not, he may heal it, for the Mishnah taught that he returns his Aveidah. This is the ultimate return [of an Aveidah]!

אלא ודאי כשיש רופא אחר עסקינן ואפילו הכי מרפאהו רפואת נפש דהיינו גופו לפי שלא מן הכל אדם זוכה להתרפאות

Rather, surely we discuss when there is another doctor. Even so, he may heal Refu'as Nefesh, i.e. the Choleh's body, for one does not merit to be healed from everyone (perhaps only this doctor can cure the Choleh)!

והכי איתא בירושלמי.

(b)

Support: The Yerushalmi says so.

RAN DH Aval Omer Lo Sam Ploni... [TRANSLATION: But he may tell him 'this medicine is good for [the illness], this medicine is bad for it.']

ר"ן ד"ה אבל אומר לו סם פלוני יפה לה סם פלוני רע לה

(SUMMARY: The Ran discusses what the doctor may do for the Choleh and his animal.)

דכיון דאיהו לא יהיב ההוא סם עליה שרי דהנאה ממילא אתיא

(a)

Explanation: Since he (the Madir) did not put the potion on it, it is permitted, for the Hana'ah comes automatically.

ומינה דברפואת גופו אפילו לשום הסם בידיו שרי

(b)

Inference: In Refu'as Gufo, he may even put the potion with his hands.

ומיהו דוקא שיהא משל מודר אבל משל מדיר לא דאפילו היכא דאין לו למודר ממה שיתרפא דמצוה קא עביד

Limitation: This is [permitted] only to put the Mudar's [potion], but not the Madir's. Even when the Mudar has nothing to be healed from, and it is a Mitzvah [to heal him]...

אפי' הכי כיון דיהיב ליה מדיליה מיד ליד אסור כי ההיא דמודר הנאה מחבירו דבעי שיניח על גבי הסלע אבל לא שיתן מידו לידו ממש וכמו שכתבתי למעלה (/נדרים/ דף לט:)

Even so, since he (the Madir) gives his own to him (the Mudar), from hand to hand, it is forbidden, like the Mudar Hana'ah from his friend [who has nothing to eat]. He must put it on the rock, but he may not give it straight from his hand to his hand, like I wrote above (39b).

ומיהו היכא דחולה אסר על עצמו נכסיו של רופא אפשר דאפילו הסם של רופא שרי דמן חיותיה לא אדריה.

However, when the Choleh forbade to himself the doctor's property, perhaps even the doctor's potion is permitted, for he did not vow against his [own] survival.

THE RAN EXPLAINS THE MISHNAH (pertains to the coming Mishnah)

ר"ן ד"ה מתני'. ורוחץ עמו באמבטי גדולה (שייך למשנה הבאה)

(a)

Mishnah: He may bathe with him in a big bathtub.

שכיון שהיא גדולה אין המים עולין על זה בשביל חבירו אבל לא באמבטי קטנה שמתוך שהיא קטנה כשרוחץ עמו מעלה המים עליו ומהנהו.

Explanation: Since it is big, the water level does not rise due to his friend. However, it is forbidden in a small one. Since it is small, when he bathes with him, he makes the water rise, and benefits him.

ר"ן ד"ה רבי יהודה אומר בימות החמה

(b)

Mishnah: R. Yehudah says, in summer.

מילתא דתנא קמא מפרש ואזיל דכי קאמר וישן עמו במטה דוקא בימות החמה שאינו נהנה בחימומו אבל לא בימות הגשמים מפני שהוא מחממו ומהנהו כדכתיב (קהלת ד) אם ישכבו שנים וחם להם.

Explanation: He explains the first Tana. He permits sleeping with him in a bed only in summer, when he does not benefit from the warmth, but not in winter, for he warms him and benefits him - "if two lie [together], it is warm for them."

(c)

Mishnah: He may sit with him on a bed.

אפי' בימות הגשמים דכי האי גוונא ליכא חימום.

Explanation: This is even in winter, for in such a case he does not warm him.

ר"ן ד"ה ואוכל עמו על השולחן

(d)

Mishnah: He may eat with him at a table.

ולא גזרינן דילמא אכיל ממנתיה דחבריה.

Explanation: We do not decree lest he eat from his friend's portion.

ר"ן ד"ה אבל לא מן התמחוי

(e)

Mishnah: But he may not [eat with him] from a platter.

אם נותנים לשניהם קערה ביחד שאם האחד אוכל מעט והשני הרבה נמצא מהנהו משל חבירו.

Explanation: If they give to both of them one platter, if one eats little, and the other much, he benefits from his friend.

ר"ן ד"ה אבל אוכל עמו מן התמחוי החוזר

(f)

Mishnah: However, he may eat with him from a platter that returns.

שחוזר לבעל הבית שהתמחוי גדול כל כך שאין יכולין לאכול כל מה שבתוכו ומותרה חוזר לבעל הבית ובכי האי גוונא לא מתהני חד מחבריה.

Explanation: It returns to the host. It is so big that they cannot eat everything in it. The remainder returns to the host. In such a case, one does not benefit from his friend.

ר"ן ד"ה לא יאכל עמו מן האבוס של פועלים

(g)

Mishnah: He may not eat with him from a food bin set out in front of workers.

קערה גדולה שנותנין לפני הפועלים שמתוך שהם עמלים אוכלין הרבה ואובסין אותן כבהמות ומש"ה נקרא אבוס

Explanation: This is a big bowl that they put in front of workers. Since they toil, they eat much and they stuff them like animals. This is why it is called Avus (a feeding trough for animals).

ואם אחד מהם אוכל מעט נמצא מהנה את חבירו

If one eats little, and the other much, it turns out that he benefits his friend.

ולפי שאין הפועלין מחזירין מן האבוס שלהם לבעל הבית לא תנא שריותא באבוס החוזר.

3.

Because the workers do not return from their bin to the employer, there is no Heter for a bin that returns.

ר"ן ד"ה באומן

(h)

Mishnah: In a row.

שורת הכרם ומש"ה לא יעשה עמו שכשהוא חופר לפניו את הקרקע מהנהו דקא מרפי לה לארעא

Explanation: This is a row of a vineyard. He may not work with him, for when he digs the land in front of him, he softens the land.

ואפילו רחוק ממנו אסר ר"מ דגזר רחוק משום קרוב כדאיתא בגמרא.

2.

Even when he is far from him, R. Meir forbids. He decrees when he is far due to when he is close, like the Gemara will say.

ר"ן ד"ה וחכ"א עושה הוא רחוק ממנו

(i)

Mishnah: Chachamim say, he may work far from him.

דלא גזרי רחוק אטו קרוב.

Explanation: They do not decree far due to close.

RAN DH Gemara Tanya Lo Yirchatz Imo... [TRANSLATION: A Beraisa teaches, he may not bathe with him, nor sleep with him in a bed, whether big or small.]

(SUMMARY: The Ran explains the argument of R. Meir and R. Yehudah.)

אתרוייהו קאי דגזר רבי מאיר באמבטי גדולה אף על גב דלא אהני ליה אטו קטנה דמהני ליה

Explanation: [Whether big or small] refers to both of them. R. Meir decrees about a big bath, even though he does not benefit him, due to a small bath, in which he benefits him;

וגזר נמי במטה בין גדולה בין קטנה ואפילו בימות החמה אטו קטנה בימות הגשמים דמהני ליה

He decrees also about a bed, whether big or small, even in summer, due to a small bed in winter, in which case he benefits him.

ור' יהודה פליג בתרוייהו דגדולה אפילו בימות הגשמים שרי דלא גזרינן אטו קטנה

R. Yehudah argues about both of these. He permits a big [bed], even in winter. He does not decree due to a small [bed];

וקטנה נמי נהי דבימות הגשמים אסור בימות החמה שרי דלא גזרינן ימות החמה אטו ימות הגשמים

Also regarding a small [bed], granted it is forbidden in winter, but he permits in summer. He does not decree summer due to winter.

Inference: From here it connotes that R. Yehudah, who says in our Mishnah "in summer, but not in winter", explains what was taught in the Reisha "and he sleeps with him in a bed." The entire Mishnah (i.e. what was taught Stam) is like R. Yehudah.

Gemara: He may not eat with him from a platter.

שאוכלין בקערה אחת וחוששין שמא ימשוך ידו מלאכול לכבוד חבירו ונמצא מהנהו.

Explanation: They eat from one bowl. We are concerned lest one refrain from eating to honor his friend, and it turns out that he benefits him.

(b)

Gemara: That returns to the host.

שיש בו כל כך שמותרו חוזר לבעל הבית.

Explanation: It has so much that what is left over returns to the host.

Gemara: When he is close, all agree that it is forbidden.

דמהני ליה לחבריה דמרפי ארעא קמיה כשחופר סמוך לו ואין הלה צריך לחפור בכח גדול.

Explanation: He benefits his friend, for he softens the land in front of him when he digs near him. The other need not dig with great strength.
