דאם איתא דמתני' דפותחין כיון דימים טובים מותרין ע"י שאלה אפי' מעמיד הרי הוא כמשנה

Question (against Opinion #2): If in the Mishnah of "we are Pose'ach", since Yamim Tovim are permitted through She'elah, even if he is Ma'amid, he is like one who changes...

א"כ כי אמר רבא דהכל מודים דבמשנה כולן מותרים אפלוגתא דב"ש וב"ה בלחוד קאי ולאו אפלוגתא דרבי עקיבא ורבנן

If so, when Rava said that all agree that when he changes, all are permitted, he refers only to the argument of Beis Shamai and Beis Hillel, but not to the argument of R. Akiva and Rabanan;

דהא אמרת דבמתניתין (גירסת כתב יד) דפותחין אפילו מעמיד כמשנה הוא ופליגי רבנן

Source: You said in our Mishnah of "we are Pose'ach" that even when he is Ma'amid, he is like one who changes, and Rabanan argue.

Question: If so, what was Ravina's challenge to Rava from the Mishnah of a basket, that it is like R. Akiva, and Rabanan argue?

Rava should say to him "indeed, this is true!" According to him (Rava), surely Rabanan of "we are Pose'ach" do not hold that a Neder that was partially permitted is totally permitted, even when he changes;

If they held in a case of change [that a partially permitted Neder is totally permitted], regarding the Mishnah of "we are Pose'ach" they should permit even when he is Ma'amid, for you said that Ma'amid in the Mishnah of "we are Pose'ach" is like one who changes in the Mishnah of figs!

אלא ודאי רבא אפלוגתא דב"ש וב"ה בלחודא קאי ולאו אפלוגתא דפותחין רבנן דרבי עקיבא אפילו אמשנה פליגי (גירסת כתב יד)

Rather, surely Rava refers only to the argument of Beis Shamai and Beis Hillel, but not to the argument of "we are Pose'ach." Rabanan of R. Akiva argue even about one who changes.

ואי הכי מאי קא מקשה לרבא ר' עקיבא היא ופליגי רבנן

Reiteration of Question: If so, how did [Ravina] challenge Rava [that according to you, the Mishnah of a basket] "is like R. Akiva, and Rabanan argue"?

לימא ליה אין ה"נ

Rava should say to him "indeed, this is true!"

אלא ודאי מתני' דפותחין כמתני' דתאני' למר כדאית ליה ולמר כדאית ליה

Answer: Rather, surely the Mishnah of "we are Pose'ach" is like the Mishnah of figs, according to Rabah like he holds, and according to Rava like he holds;

ומש"ה כי קאמר רבא דבמשנה הכל מודים דכולן מותרין אפלוגתא דרבנן ורבי עקיבא נמי קאי ומשום הכי פריך ליה רבינא שפיר כנ"ל.

Therefore, when Rava said that when he changes, all agree that all are permitted, he refers also to the argument of Rabanan and R. Akiva. Therefore, Ravina's question was proper.

RAN DH v'Chasav Od ha'Ramban Zal [TRANSLATION: The Ramban wrote further]

ר"ן ד"ה וכתב עוד הרמב"ן ז"ל

(SUMMARY: The Ran discusses when Heter of part permits the entire Neder.)

דאפי' במשנה דוקא בנדר שהותר ע"י פתח שדומה קצת לנדרי טעות וכיון שיש טעות בנדר בטל כולו

(a)

Opinion #1 (the Ramban): Even when he changes, only a Neder permitted through a Pesach, which somewhat resembles Nidrei Ta'os, since there is a mistake in the Neder, it is totally Batel;

אבל התירוהו בחרטה אין כל הנדר ניתר אלא מה שהוא מתחרט בו בלבד

However, if it was permitted through regret, this does not permit the entire Neder, rather, only the part he regrets.

אבל בתוספות כתבו דאפילו ניתר בחרטה כיון דחכם עוקר הנדר מעיקרו מכיון שהותר מקצתו הותר כולו

Opinion #2 (Tosfos): Even if it was permitted through regret, since a Chacham uproots the Neder from the beginning, since part was permitted, it is totally permitted.

ודאמר הותר מקצתו הותר כולו דווקא בשכללם כולם כגון דאמר כולכם או לזה ולזה בוי"ו

He said "if it was partially permitted, it is totally permitted" only when he included all together, e.g. he said "all of you", or "to this and to this", with a Vov (and);

אבל אם אמר לזה לזה הותר אחד מהן הוא מותר וכולן אסורים דכמ"ד קונם לכל אחד ואחד דמי

However, if he said "to this, to this", if one of them was permitted, he is permitted, and all [of the others] are forbidden. He is like one who said "Konam" to every one.

וכדמוכח בפרק האיש מקדש (קדושין מו) גבי בזו ובזו ובפר' שבועות הפקדון (שבועות לח) גבי שבועה לא לך לא לך

Source: This is clear from Kidushin 46a, regarding [one who was Mekadesh a woman with dates, each worth less than a Perutah, and said "with this, and with this", and in Shevuos (38a) regarding a Shevu'ah [that I do not owe] "to you, to you."

Distinction: Only regarding Heter of a Chacham we say that a Neder that was partially permitted is totally permitted, because a Chacham uproots a vow from the beginning (retroactively);

אבל בהיתר חרם או נידוי אם החרי' או נידה י' בני אדם והותר אחד מהן הוא מותר וכולן אסורים,

However, regarding Heter of Cherem or Niduy, if one put 10 people in Cherem or Niduy, and one of them was permitted, he is permitted, and all [of the others] are forbidden.

וכן הדין בהפרת בעל דקי"ל בעל מיגז גייז.

The same applies to Hafarah of a husband, for we hold that a husband cuts off [the Neder from now and onwards. He does not uproot it retroactively.]

THE RAN EXPLAINS THE MISHNAH

ר"ן ד"ה מתני'. נדרי אונסין הדירו חבירו שיאכל אצלו וכו' או שחלה בנו

(a)

Mishnah: Nedarim of Ones - his friend put a vow on him that he will eat by him... or his son became ill.

כלומר דאע"ג דלאו אונס גמור הוא.

Explanation: I.e. even if it is not an absolute Ones.

ר"ן ד"ה הרי אלו נדרי אונסין

(b)

Mishnah: These are Nedarim of Ones.

לפי שלא עלה על דעתו לאסור נכסיו על חבירו אם לא יאכל עמו אלא כשיוכל לבא בלא אונס כלל ולא יבא

Explanation: This is because he never intended to forbid his property to his friend if he will not eat with him, only if he could have come without any Ones, and he does not come;

אבל כל שנאנס קצת כגון שחלה בנו וצריך לשמרו מותר דלאו אדעתא דהכי אדריה

However, whenever there was some Ones, e.g. his son was ill and he must guard him, he is permitted. He did not intend to forbid him via a vow in such a case.

ר"ן ד"ה גמ'. אם לא אתינא מכאן עד תלתין יומין ליבטלן זכותאי

Gemara: 'If I do not return within 30 days, the proofs of my rights should be void.'

האי גברא בקש מב"ד שיתנו לו זמן וכדתנן בסנהדרין (דף לא) שכל ראיות שיש לך להביא הבא מכאן ועד ל' יום

Explanation: This man requested from Beis Din to give to him time, like the Mishnah in Sanhedrin (31a) 'all proofs that you can bring, bring them within 30 days';

וב"ד חששו שמא לא אמר כן אלא להשמט מהן ועשו עמו שיתפיס שטר זכיותיו שיש לו על חבירו בידם ואמר להם אם לא באתי מכאן ועד יום פלוני זכיותי הללו יבטלו.

Beis Din suspected that he says so only to evade them. They made him deposit the documents that he had against his opponent with Beis Din, and he told them, if I will not come before a specified day, these documents should be void.

ר"ן ד"ה וכי תימא קטלא שאני

(d)

Gemara: And if you will say that death is different

כלומר דבמקום קטלא איכא טענת אונס אבל במידי אחריני לא

Explanation: I.e. in a case of death, there is a claim of Ones, but not regarding other matters.

RAN DH ha'Tanan Nidrei Onesin... [TRANSLATION: But a Mishnah says, 'vows of Ones... these are vows of Ones', because it did not cross the mind of the Madir to put a vow on him if such a matter will occur to him.]

ר"ן ד"ה התנן נדרי אונסין וכו' הרי אלו נדרי אונסין לפי שלא עלה [על לב] מדיר להדירו אם יארע לו כך

(SUMMARY: The Ran explains the question, and why Rav Huna did not answer it.)

הכא נמי גבי מתפיס זכותיה נימא דלא עלה על דעתו דליבטלן זכותיה כל היכא דלא מצי למיתי

Explanation: Also here, regarding one who put his proofs [in Beis Din], we should say that it did not cross his mind that his proofs will be Batel in a case that he is unable to come!

ורב הונא דלא שני ליה מידי

(b)

Implied question: Why didn't Rav Huna give any answer?

משמע דלא חש לפרכיה משום דהתם לא ה"ל למדיר לאתנויי דמאי איכפת ליה

(c)

Answer: It seems that he was not concerned for the question, for there, there was no reason for the Madir to stipulate. Why does he care [if his friend becomes forbidden due to Ones]?

אבל הכא כיון דה"ל לאתנויי ולא אתני איהו דאפסיד אנפשיה.

However, here, since he should have stipulated, and he did not stipulate, he caused his own loss.

THE RAN EXPLAINS THE GEMARA

ר"ן ד"ה דלמא שאני הכא דאי הוי ידע דמאית מן אלתר גמר ויהיב גיטא

(a)

Gemara: Perhaps that case is different. Had he known that he would die, he would have resolved to divorce her immediately (unconditionally).

שהרי לא נתן לה גט אלא משום דלא ניחא ליה דתיפול קמי יבם וכ"ש דאי ידע דמאית גמר ומגרשה כי היכי דלא תיפול קמי יבם.

Explanation: He gave a Get only because he does not want her to fall to Yibum. All the more so, had he known that he would die, he would have resolved to divorce her, lest she fall to Yibum!

RAN DH v'Dilma Ones d'Megalya She'ani [TRANSLATION: Perhaps a known (common) Ones is different] (pertains to Amud B)

ר"ן ד"ה ודלמא אונס דמגלי' שאני

(SUMMARY: The Ran explains why common Onesim are different.)

כלומר דכיון דשכיח טובא ה"ל לאתנויי

(a)

Explanation: Since it is more common, he should have stipulated.

וה"ה דה"מ לשנויי דהכא היינו טעמא משום דאין אונס בגיטין משום צנועות ומשום פרוצות כדאיתא בפ"ק דכתובות (דף ב:)

(b)

Implied question: Why didn't the Gemara answer that the reason here is because Ein Ones b'Gitin (if one gave a Get on Tanai, even if the Tanai was fulfilled due to Ones, the Get is valid), due to virtuous women and immoral women, like it says in Kesuvos 2b? (The former might refrain from remarrying, from concern lest there was an Ones, and the Get is invalid. The latter might know about an Ones and deny it, and they will remarry, and their children will be Mamzerim. To prevent both of these concerns, Chachamim decreed that in a case of Ones, the Get is valid.)

Answer: He answered the question according to the asker's opinion that Yesh Ones b'Gitin.

RAN DH ul'Rav Huna Michdi Asmachta Hi v'Asmachta Lo Kanya [TRANSLATION: According to Rav Huna why [are his proofs void]? This is Asmachta (an exaggerated promise), which is not binding!]

ר"ן ד"ה ולרב הונא מכדי אסמכתא היא ואסמכתא לא קניא (שייך לעמוד ב)

(SUMMARY: The Ran justifies the question against Rav Huna.)

דהאי גברא לא אתפיס זכותיה אלא משום דסמיך אדעתי' דליתי

Explanation: The man put his proofs [in Beis Din] only because he was confident [that he will come];

וכל כה"ג אפילו בלא אונס לא קני

In every such case, even without Ones, his words do not take effect.

אף על גב דרב הונא אמר בב"מ (דף סו) דאסמכתא קניא

(b)

Implied question: Rav Huna said in Bava Metzi'a (66a) that Asmachta acquires!

קים ליה להש"ס דהדר ביה רב הונא כדהדר ביה רב נחמן התם דמניומי אהדריה.

Answer: The Gemara knew that Rav Huna retracted from that, just like Rav Nachman retracted, for Minyomi convinced him to retract.

THE RAN EXPLAINS THE GEMARA

ר"ן ד"ה שאני הכא דמתפסן זכותיה

(a)

Gemara: Here is different, for he deposited his proofs [with Beis Din].

שכיון שיצאו מרשותו והתפיסן ביד ב"ד ליכא אסמכתא.

Explanation: Since they left his Reshus, and he deposited them in the hands of Beis Din, it is not Asmachta.

ר"ן ד"ה והשליש שטרו

(b)

Gemara: And one who gave his document to a third party.

שנתנו ביד שליש

Explanation: He gave it to a third party.

ר"ן ד"ה רבי יוסי אומר יתן

(c)

Gemara: R. Yosi says, he gives [the document back to the lender].

דס"ל אסמכתא קניא

Explanation: He holds that Asmachta acquires.

ר"ן ד"ה רבי יהודה אומר לא יתן

(d)

Gemara: R. Yehudah says, he does not give [it back to the lender].

דסבירא לי' אסמכתא לא קניא.

RAN DH She'ani Hacha d'Amar Livatlan Zechusi [TRANSLATION: Here is different, for he said that his proofs should be Batel.]

ר"ן ד"ה שאני הכא דאמר ליבטלן זכותי

(SUMMARY: The Ran gives two explanations of why his proofs are Batel.)

כלומר שהוא מוחל כל כח וזכות שיש לו באותן שטרות

(a)

Explanation: He pardons all rights that he has in those documents;

דכיון דמחילה היא לית בה אסמכתא דמיד זוכה בה חבירו

Since it is pardon, Asmachta does not apply, for his [opponent] immediately acquires.

וכן במוסר ליד חבירו ואמר לו אם לא אעשה כך זכה במה שבידך קנה

Opinion #1: The same applies to one who hands over to his friend and says "if I will not do so, acquire what is in your hand." He acquired;

דליכא אסמכתא אלא באומר אתן או אשלם וכיוצא בהן וכן דעת הרמב"ם ז"ל

This is because Asmachta is only when one says "I will give or pay", or similar matters. Also the Rambam says so.

ואין כן דעת רש"י ז"ל בפרק הזהב (ב"מ דף מח) גבי הא דתניא התם הנותן עירבון לחבירו ואמר לו אם אני חוזר בי אמחול לך ערבוני והלה אומר אם אני חוזר בי אכפול לך ערבונך נתקיימו התנאים דברי ר' יוסי

Opinion #2: Rashi disagrees in Bava Metzi'a (48b) regarding the Beraisa there "one who gives a security to his friend, and said "if I retract, I pardon my security to you", and the other says "if I retract, I will [return] double your security to you." R. Yosi says that the stipulations are binding;

[רבי יוסי לטעמיה] דקסבר אסמכתא קניא

R. Yosi teaches like he taught elsewhere. He holds that Asmachta acquires.

רבי יהודה אומר דיו שיקנה כנגד ערבונו

Citation (48b): R. Yehudah says, it suffices that he acquires corresponding to his security.

ופירש רש"י ז"ל שם לא זה יכפול ולא זה ימחול משום דאסמכתא היא

Explanation (Rashi): This (one who received the security) does not double it if he retracts, and this (the one who gave the security) does not pardon it if he retracts, because it is Asmachta.

אלמא אפילו במחילה שייכא אסמכתא

Inference: Asmachta applies even to pardon.

והא נמי דמי שפרע מקצת חובו דאיתיה לעיל בסמוך מוכח הכי דודאי ההוא תנאי מתורת מחילה הוא

Also the one who paid part of his debt, which we brought above, proves like this. Surely that stipulation is based on pardon;

דאי לא נהי דס"ל לרבי יוסי דאסמכתא קניא היאך יגבה זה כל השטר והלא כבר נמחל מקצת שעבודו ושוב אינו חוזר וגובה

If not, granted, R. Yosi holds that Asmachta acquires. However, how can he collect the entire document? Part of its lien was already pardoned. He cannot collect after this!

אלא ודאי מתחלה כך התנה אם לא נתתי לך השאר מכאן ועד שלשים יום לא יהא המעות אלו פרעון אלא מתנה ואפ"ה רבי יהודה אומר לא יתן

Conclusion: Rather, surely from the beginning he stipulated "if I will not give to you the rest within 30 days from now, these coins are not payment, rather, a gift", and even so, R. Yehudah says that he does not give;

אלמא אסמכתא אפילו גבי מתנה ומחילה לא קניא

Inference: Asmachta does not acquire, even regarding a gift and pardon.

אלא ה"פ שאני הכא דאמר ליבטלן זכותאי כלומר שהוא מודה שאם לא בא לאותו זמן שראיותיו בטלות כלומר שהם שקר.

(d)

Conclusion: Rather, the Gemara means that here is different, for he said that his merits should be Batel. I.e. he agrees that if he does not come at that time [that he fixed], his proofs are Batel, i.e. they are false.

10)

RAN DH v'Hilchesa Asmachta Kanya [TRANSLATION: The law is, Asmachta is binding; this applies when there was no Ones, and they acquired from him in an esteemed Beis Din.]

ר"ן ד"ה והלכתא אסמכתא קניא והוא דלא אניס והוא דקנו מיניה בב"ד חשוב

(SUMMARY: The Ran explains that this is only regarding a small Ones.)

והוא דלא אניס כלומר אפי' דומיא דחלה בנו שאינו אונס גמור

(a)

"There was no Ones" means even a small Ones, like his son becoming sick, which is not total Ones;

דאי אנוס גמור קאמר פשיטא

Question: If it was total Ones, obviously [he does not acquire]!

אלא כי האי אונסא קאמר דהא מדמינן לה לעיל למתניתין דנדרים

Answer: Rather, it refers to a [small] Ones like this, for above we compare [Asmachta] to our Mishnah of Nedarim;

דכי היכי דאמר במתניתין דאדעתא דחלה בנו לא הדירו הכא נמי כי אתפיס זכותיה לא עלה על דעתו שיניח בנו חולה ויצא לריב.

Just like it says in our Mishnah that he was not Madir him with intent that his son fall sick, also here, when he put his proofs in Beis Din, it did not cross his mind that he will leave his sick son and go to contest [in Beis Din].

RAN DH v'Hu d'Kanu Minei b'Beis Din Chashuv [TRANSLATION: This is when they did a Kinyan with him in a respected Beis Din.]

ר"ן ד"ה והוא דקנו מיניה בב"ד חשוב

(SUMMARY: The Ran discusses when we require an esteemed Beis Din.)

כלומר אלים לאפקועי ממונא כגון בי דינא דרב אמי ורב אסי

(a)

Explanation: It is powerful to uproot money, e.g. the Beis Din of R. Ami and R. Asi.

ושלא כדברי הרמב"ם ז"ל שהצריך סמוך

This is unlike the Rambam, who obligates that they have Semichah.

ואם כדבריו היה לו לומר בב"ד מומחה

Rebuttal: If so (they must have Semichah), it should have said "an expert Beis Din"!

והקשו הראשונים ז"ל ב"ד חשוב למה לי דהא אמר בפרק איזהו נשך (ב"מ דף סו) דכל היכא דאמר מעכשיו ליכא משום אסמכתא

(b)

Question (the Rishonim): Why do we need an esteemed Beis Din? It says in Bava Metzi'a (66b) that whenever he said 'from now', there is no problem of Asmachta!

וקנין סודר ע"כ כמעכשיו הוא דאי מעכשיו לא קני בתר הכי נמי לא קני דהא הדר סודר למריה

You are forced to say that Kinyan Sudar (Chalipin) is like [saying] 'from now.' If it does not acquire now, also later it does not acquire, for the garment was returned to the owner!

וה"ל כאומר לחברו משוך פרה זו ולא תקנה לך אלא לאחר ל' יום דלא קנה כל היכא דלא קיימא בחצרו אלא היכא דא"ל מעכשיו (כתובות פב)

i.

This is like one who says to his friend "do Meshichah on this cow, and do not acquire it until after 30 days." If it is not in his Chatzer [at the end of 30 days], he acquires only if he said 'from now' (Kesuvos 82a).

וכיון דכל קנין על כרחין כמעכשיו הוא ומעכשיו סגי לבטולי אסמכתא ב"ד חשוב למי לי

ii.

Since you are forced to say that every Kinyan [Sudar] is like 'from now', and 'from now' suffices to be Mevatel [the problem of] Asmachta, why do we need an esteemed Beis Din?

תירץ ר"ת ז"ל דכי אמר דמעכשיו מבטל אסמכתא ה"מ כי ההיא דפרק איזהו נשך דמשכן לו בית משכן לו שדה שמסר לו שדהו

(c)

Answer #1 (R. Tam): When he says 'from now', this is Mevatel Asmachta, only in a case similar to in Bava Metzi'a, when he gave a house or field for collateral. He gave the field to him;

אבל הכא שלא מסר ליד מי שהתנה עמו כלום צריך קנין וב"ד חשוב

However, here he did not hand anything over to the one with whom he stipulates. Therefore, he needs a Kinyan and an esteemed Beis Din.

ולפיכך אמר הרב ז"ל שכן הדין בכולהו אסמכתות בעלמא דכל שאינו מוסר ליד חבירו אין מעכשיו מועיל בהן אלא קנין בב"ד חשוב

Therefore, [R. Tam] holds that the same applies to all Asmachtos in general. Whenever he does not hand [anything] over to his friend, 'from now' does not help. Only a Kinyan in an esteemed Beis Din helps.

ואין כן דעת הגאון ז"ל שכתב דהאי פיסקא ליתיה אלא במתפיס זכותיה בלחוד וכתבה (גירסת כתב יד) הרב אלפסי ז"ל בפרק גט פשוט

(d)

Answer #2: This is unlike the Gaon who wrote that this ruling (that we need a Kinyan in an esteemed Beis Din helps) applies only when one deposits his proofs in Beis Din. The Rif wrote this [opinion] in Bava Basra (78a).

וכדבריו נראה שאין עסק לב"ד חשוב בתנאין שבין אדם לחבירו

(e)

Support: This seems correct. An esteemed Beis Din has no involvement with stipulations between a man and his friend;

אלא הכא דוקא קאמר משום דהאי גברא לא מדעתיה בלבד אמר דאי לא אתי לבטלן זכותי' אלא ב"ד הזקיקוהו לכך

Only here we say [that we need an esteemed Beis Din] because this man did not say purely on his own will "if I will not come, my proofs are Batel." Beis Din forced him to say so, i.e. [my proofs] are false.

ומש"ה דוקא כי קנו מיניה ב"ד חשוב מהני אף על גב דלא אמר מעכשיו דב"ד חשוב אלים לאפקועי ממונא

Therefore, it helps when an esteemed Beis Din acquired from him, even though he did not say 'from now', for an esteemed Beis Din has power to uproot money.

וכי תימא אפקועי ממונא דב"ד חשוב למה לי תיפוק לי דקנו מיניה וכל קנין מעכשיו הוא

(f)

Question: Why must we say that an esteemed Beis Din can uproot money? It should suffice that they acquired from him, and every Kinyan is 'from now'!

דאי השתא לא קני בתר הכי לא קני דהא הדר סודרא למריה וכדברי ר"ת ז"ל

If it does not acquire now, also later it does not acquire, for the garment was returned to the owner, like R. Tam said!

Answer: Surely, he said correctly. If one was Makneh a field to his friend Stam, and acquired from him, he acquired immediately;

However, when he stipulated "if I will not come", this does not connote that he should acquire now, rather, after that day, and it turns out that he does not acquire at all;

אלא מש"ה סגי הכא בקנין סתמא משום דב"ד אלימי לאפקועי ממונא והוי כמעכשיו.

However, the reason Stam Kinyan suffices here, is because Beis Din has power to uproot money, so it is like 'from now.'

RAN DH v'Nimtza Achshav Piskan Shel Devarim [TRANSLATION: Now it turns out that this is how we rule.]

דכל היכא דאיכא מעכשיו לית ביה משום אסמכתא

Explanation #1: Whenever there is 'from now', there is no [problem of] Asmachta;

ובמתפיס זכותא אי קנו מיניה בב"ד מהני ומעכשיו לחודיה נמי מהני ביה

When one deposited his proofs, if they acquired from him in Beis Din; it helps. Also 'from now' by itself helps.

ולא נ"ל כן דאי משום אפקעותא דב"ד נגעו בה קנין למה ליה

Rebuttal: I disagree. If it is due to Beis Din uprooting [money], why do we need a Kinyan?

אלא הכא הכי קאמר והוא דקנו מיניה

Explanation #2: Rather, here we say that this is when they acquired from him;

כלומר דלא תימא כיון דאמר לבטלן זכותיה כלומר שהוא מודה שאם לא בא לאותו זמן ראיותיו בטלות לא צריך קנין משום דהודאה בב"ד היא ולא בעיא קנין

I.e. do not say that since he said that his proofs will be Batel, i.e. he agrees that if he does not come, his proofs are Batel, we do not need Kinyan, for the litigant admitted, and Kinyan is not needed;

דליתא דאילו הודה כן בלא שום תנאי ה"נ

This is wrong. If he admitted, also without any stipulation [his proofs should be Batel]!

אבל כיון שתלה באם אין כאן הודאה גמורה הלכך אפי' אמר מעכשיו לא מהני

Rather, since he attributed [Bitul of his proofs] to "if" (if I will not come), this is not a total admission. Therefore, even if he said 'from now' it does not help.

דאפי' תימא כיון דאיכא מעכשיו ליכא אסמכתא אפי' הכי במה יקנה הלה שיבטלו זכיותיו הלכך בעי קנין כי היכי דליקני חבריה

Even if you will say that since there is 'from now', there is no Asmachta, even so, how does his opponent acquire that his proofs are Batel? Therefore, we need a Kinyan, so his opponent will acquire.

ואין ה"נ דאי אמר מעכשיו וקנו מיניה לא בעינן ב"ד חשוב דבקנין קני חבריה ובמעכשיו ליכא למיחש לאסמכתא

Implied question: If he said 'from now' and they acquired from him, we do not require an esteemed Beis Din. His opponent acquires through Kinyan, and with 'from now', there is no concern for Asmachta! (Why did the Gemara mention an esteemed Beis Din?)

אלא דכיון דבב"ד עסקינן אשמועינן דינא אחרינא דכל היכא דהוי ב"ד חשוב לא צריך מעכשיו

Answer: Since we discuss Beis Din, we teach another law, that whenever there is an esteemed Beis Din, we do not need 'from now';

דאנן סהדי דלא מחייך בבי דינא וכמאן דאמר בפי' מעכשיו דמי

We can testify that one does not jest in Beis Din. It is as if he explicitly said 'from now';

דכיון דב"ד חשוב הוא מאי דאמר לבטלן כהודאה גמורה משוינן ליה

Since it is an esteemed Beis Din, we consider what he said "[the proofs] should be Batel" like a total admission.

ונמצא לפירוש זה שאין אנו צריכים כאן להפקעת ממון ולא נשתנה דין זה משאר דיני אסמכתא

Consequence: According to this explanation, we do not need to uproot money. This is no different than other laws of Asmachta;

והוא דבר נכון ועולה כהוגן כן נראה לי.

Mishnah: [We vow] to Charamim.

מחרימין ושוללין.

Mishnah: And to tax collectors.

להפטר מן המכס.
