ואילו היה מתחרט על עיקר הנדר יאבד שכר תעניותיו שהתענה אם היה תוהא על הראשונות לפיכך לא היה מתחרט.

Explanation: If he would regret the Neder from the beginning, he would lose the reward for what he fasted, if he regretted his initial [fasts due to his vow]. Therefore, he did not regret. (Shi'urei R. David - if he regrets only the vow, but not the fasts, why does he lose their reward? We must say that regret is not only for the vow, rather, for the entire matter.)

ר"ן ד"ה זיל לקילעך

(a)

Gemara: Go to your doorway.

לכניסת ביתך וכדאמרינן אקילעא דבי ריש גלותא.

Explanation: To the entrance of your house, like we say 'a'Kil'ah of the Reish Galusa's house.'

ר"ן ד"ה פתח פיתחא לנפשיה

Gemara: He opened a Pesach for himself.

לא שיתיר רב סחורה לעצמו דהא קי"ל לא יחל דברו הוא אינו מיחל אלא שמצא פתח שהיה יכול להיות ניתר בו.

Explanation: This does not mean that Rav Sechorah will permit himself. We hold that "Lo Yachel Devaro" - he does not profane [his own word]! Rather, he found a Pesach via which he could be permitted.

RAN DH Kol she'Hi Tiferes... [TRANSLATION: Whatever is glory to the one who does it.]

Explanation: It itself is praiseworthy, to the point that it is glory to the one who does it, and glory to him from people, that people praise him for it.

והא רתח רב נחמן כלומר לא נדרתי על דעת שיכעוס רב נחמן שלא תהא דרך ישרה שאכעיס אותו

Behold, Rav Nachman got angry - i.e. I did not vow with intent that Rav Nachman will get angry. This is not the straight way, that I should anger him!

וכי האי גוונא לא מיקרי נולד

Implied question: Is this not Nolad?

דשכיח דלירתח גברא רבה כרב נחמן על מי שנדר נדר חזק כל כך אדעתא דכל הני מילי.

Answer: It is not Nolad, for it is common that a great Chacham like Rav Nachman get angry at one who took such a strong Neder, with intent for all these matters [that Rav Nachman suggested for Pesachim].

ר"ן ד"ה על דעתא דמצטערי רבנן

Gemara: With intent that Rabanan will be pained.

והאי לאו נולד הוא דשכיח.

Explanation: This is not Nolad, for it is common.

ר"ן ד"ה ומי שרי הכי

Gemara: Can we permit like this?!

כלומר מי שרי לפתוח פתח שהנדר מוכיח הפך מאותו פתח שהרי כל עיקר הנדר לא היה אלא שאם תעבור על דעתו תאסר בהנאתו.

Explanation: Is it permitted to open a Pesach, that the vow proves oppositely to that Pesach? The entire essence of the vow was only if she will transgress his opinion, she will be forbidden to benefit from him!

RAN DH Iyn veha'Tanya... [TRANSLATION: Yes! And a Beraisa says, a case occurred with one...]

Inference: Even in such a case we are Pose'ach.

וא"ת ומאי מתמהינן מעיקרא ומי שרי הכי ומה בין זו לנדרי זרוזין דמתני'

Question: What was so astounding initially "do we permit in such a case?!" Why is this different than Nidrei Zeruzin of our Mishnah?

אדרבה היה לו לומר שהנדר מותר מאליו כהנך דמתניתין

Just the contrary! He should have said that the Neder is automatically permitted, like the others of our Mishnah!

י"ל דלא דמי דנדרי זרוזין דמתני' אין פיו ולבו שוין של מוכר ולא של לוקח שוין

Answer: This is different. In Nidrei Zeruzin of our Mishnah, the mouth and heart of the seller are not the same, and also of the buyer they are not the same;

שלעולם לא היה דעתו של מוכר שלא יפחות מן הסלע ולא דעתו של לוקח שלא יוסיף על שקל ומש"ה שרו

The seller never intended that he will not sell for less than a Sela, and the buyer never intended that he will not pay more than a Shekel. Therefore, they are permitted;

אבל זה דעתו היה להדירה אם תעבור על תנאו ודעתו וכי האי גוונא לאו נדרי זרוזין מיקרו

Distinction: However, here he intended to forbid her through a vow if she transgresses his stipulation and intent. Such a case is not called Nidrei Zeruzin;

אלא דאיכא פתח שאילו היה יודע שתעבור על דעתו לא היה מדירה

However, there is a Pesach. Had he known that she will transgress his will, he would not have forbidden her through a vow.

ובמתניתין נמי הא כתיבנא לעיל /נדרים/ (כא ד"ה גרסינן) שאם היו מוכר ולוקח מעמידין דבריהם חייל נדרייהו וכדמוכח בירושל'

Support: Also in our Mishnah, I wrote above (21a) that if the seller and buyer were Ma'amid their words, their vow takes effect, like is proven in the Yerushalmi.

אלא דאפשר שאף במעמידין פותחין פתח לומר אילו היית יודע שהלוקח לא יתן בו סלע כלום היית נודר

However, it is possible that even when they are Ma'amid, we are Pose'ach to say "had you known that the buyer will not give a Sela, would you have vowed?"

אם אמר לאו מתירין אותו וכדפתחינן הכא

If he says "no", we permit him, like we are Pose'ach here.

וא"ת ומאי שנא מהרוצה שיאכל חבירו אצלו ומדירו דא"ר אליעזר בן יעקב דנדרי זרוזין הוו

Question: Why is this different than one who wants that his friend will eat with him, and he is Madir him? R. Eliezer ben Yakov says that this is Nidrei Zeruzin;

והא התם פיו ולבו שוין שרוצה שיאכל עמו חברו ואפי' הכי אמרינן דנדרי זרוזין הוו ושרו ממילא

There, his mouth and heart are the same. He wants his friend to eat with him. Even so, we say that they are Nidrei Zeruzin, and they are automatically permitted!

י"ל דלא דמי דאילו התם הענין מוכיח מתוכו שאינו אלא זרוז שאין באכילת חברו אצלו קפידא כל כך שבשביל זה ידירנו מנכסיו בדוקא

Answer: This is different. There, the matter proves that it is only Ziruz. He is not so adamant that his friend eat, that for this he would truly be Madir him from his property;

אבל בהאי עובדא דדביתהו דאביי דאיכא קפידא טפי לאביי כי מנסבא לה דביתהו לקריבה ודאי איכא למימר דבדוקא הדירה ולאו לזרוז בעלמא

However, in this case with Abaye's wife, there was more adamancy to Abaye when his wife married [their daughter] to her relative, surely we can say that truly he was Madir her, and it was not mere urging;

ומש"ה פשיטא לן דצריך פתח ואין הנדר בטל מאליו אדרבה מתמהינן היכי שרינן ליה בהאי פתחא.

This is why it is obvious to us that he needs a Pesach, and the Neder is not Batel automatically. Just the contrary, we are astounded how we permit him with this Pesach!

RAN DH v'Heter Nedarim [TRANSLATION: And Heter of Nedarim...]

ביחיד מומחה או בשלשה הדיוטות במקום שאין מומחה

Ruling: A lone expert [permits Nedarim], or three commoners where there is no expert.

וכדאמרינן בהדיא בבכורות בפרק כל פסולי המוקדשין (דף לו:) אמר רבי חייא בר אבין אמר רב עמרם שלשה מתירין את הבכור במקום שאין מומחה

Support - Citation (Bechoros 36b - R. Chiya bar Avin citing Rav Amram): Three [commoners] can permit a Bechor [rule that it has a Mum] where there is no expert;

Citation (cont.) Question: [R. Chiya said that] three permit a Neder] where there is no Chacham. This teaches unlike R. Yehudah, who says that three permit a Neder, and one of them must be a Chacham.

We asked "where there is no Chacham - like whom?", and Rav Nachman said "a Chacham like myself." I.e. R. Yehudah requires one of the three to be a Chacham. Like whom must he be?

אמר רב נחמן כגון אנא כלומר דבעי רבי יהודה שיהא אחד מהם גמיר וסביר כגון אנא דגמירנא וסבירנא

Rav Nachman answered "like myself." I.e. R. Yehudah requires one of the three must be learned, and can reason, like myself; I have learned and can reason.

Citation (cont.) Question: R. Yehudah says that one of the three must be a Chacham. Is anyone Kosher for the other [two, i.e. even if they are totally unlearned]?!

If it sufficed that he learned and can reason, like Rav Nachman, how can R. Yehudah require that one of the three learned and can reason?

ומאי קאמר אחד מהן חכם במקום שאין חכם דאי בגמיר וסביר סגי בכל מקום שהוא הרי יש בו חכם

Also, how do we understand "one of them is a Chacham" in a place where there is no Chacham"? If it sufficed that he learned and can reason, wherever he is, there is a Chacham!

אלא ודאי ה"ק אחד מהן חכם דהיינו גמיר וסביר במקום שאין חכם דהיינו סמוך

Conclusion - Opinion #1: Rather, surely it means that one of them is a Chacham, i.e. he learned and can reason, in a place where there is no Chacham, i.e. with Semichah;

דכי איתיה לסמוך לחודיה שרי נדרא

Where there is a Chacham with Semichah, he can permit Nedarim by himself.

וכיון דלר' יהודה בעי' סמוך ביחידי לרבנן נמי דמדרבי יהודה נשמע לרבנן דבהאי לא פליגי

Since R. Yehudah requires a Chacham with Semichah to permit by himself, also Rabanan do. We learn from R. Yehudah to Rabanan. They do not argue about this.

והכי נמי משמע לן בסוף פ' נערה המאורסה (לקמן /נדרים/ עח:) דאמרינן מועדי ה' צריכין מומחה פרשת נדרים אין צריך מומחה אלא אפי' ב"ד הדיוטות

(h)

Support - Citation (below, 78b): Mo'adei Hash-m (i.e. Kidush Rosh Chodesh, which determines the Yamim Tovim) require an expert. Parshas Nedarim does not require an expert, rather, even a Beis Din of commoners;

והא פרשת נדרים ראשי המטות כתיב

Citation (cont.) Question: Regarding Parshas Nedarim, it says "Roshei ha'Matos" [which connotes experts]!

Opinion #2: The Rambam (Hilchos Shevu'os 6:5) says that an expert Chacham can permit Nedarim. He does not require Semichah.

משמע דמפרש הרב ז"ל דהא דאמרי' התם במקום שאין חכם לאו סיומא דמלתא דר' יהודה היא אלא אדרבנן קאי

Inference: He holds that what the Gemara says there "where there is no Chacham" is not the conclusion of R. Yehudah's teaching. Rather, it refers to Rabanan;

דאמרי שלשה מתירין את הנדר במקום שאין חכם דאלמא חכם לחודיה מתיר

They say that three permit Nedarim where there is no Chacham. This implies that a Chacham can permit alone.

ומהדרינן כעין אמר מר במקום שאין חכם חכם כגון מאן כלומר כגון מאן מתיר ביחידי

We return [to ask], similar to "it was taught", in a place where there is no Chacham... - like whom? I.e. what kind of Chacham can permit alone?

Rav Nachman answered "it is like me", i.e. one who has learned and can reason. This shows that whenever he learned and can reason, he can permit Nedarim alone, even if he did not get Semichah.

וכבר כתבתי זה בפ"ק (דף ח: ד"ה ושמתא) ועוד אכתוב בזה בפרק נערה בס"ד

Explanation: The invitee [will not eat,] because he knows that the Neder does not take effect on him, for the host already was Mevatel it.

Implied question: We could have answered that the Madir (the host) says it quietly, so the Mudar (the invitee) will not hear!

Answer #2: If we discuss such a case, why does it say "as long as he remembers"? Obviously, he remembers, for he stipulates at the time of the vow!

Gemara: It means as follows. If one wants that his friend will eat by him...

נדרי זרוזין הן ואפי' אינו אוכל עמו לא חייל נדרא שלא נתכוון אלא לזרוזי והיינו דקתני אף.

Explanation: These are Nidrei Zeruzin, and even if he does not eat by him, the vow does not take effect. He intended only to urge. This is why it says 'Af' (also this is Nidrei Zeruzin).

Gemara: And one who wants that his vows will not be valid...

However, here the Tenai and the Neder do not come at once. We could say that he uproots (his Tenai).

Explanation: Rava does not come to argue with Abaye [about the Halachah]. He agrees that if he does not remember the Tenai at all at the time of his vow, the Neder is Batel;

However, he is not pleased to say that the text of our Mishnah is mistaken. Therefore, he says that really, [the Mishnah] says that he remembers;

It teaches that one who wants to be Mevatel his vow, on Rosh Hashanah he should say...

Ruling: In such a case, there are two laws. If he does not remember his Tenai at all at the time of his vow, the Neder is Batel;

If he did not say "I do based on my initial intent", he uprooted his Tenai and validated his vow.

דכיון שהיה זכור בשעת הנדר שהתנה ולא ידע ממה התנה אם דעתו היה שיתקיים תנאו לא היה לו לידור סתם כי היכי דלא לעקריה

Since he remembered at the time of the Neder that he stipulated, but did not remember what he stipulated about, if he wanted his Tenai to be carried out, he should not have vowed Stam, lest he uproot it (his Tenai).

ומתניתין דקתני ובלבד שיהא זכור הכי קתני ובלבד שיהא התנאי זכור בפיו בשעת הנדר.

Our Mishnah, which teaches "as long as he is Zachur (remembers)", means "as long as the Tenai is Zachur (mentioned) with his mouth at the time of the Neder."

Ruling: We hold like Rava. Therefore, whenever he stipulated from the beginning "any Neder...", and at the time of his vow he forgot his Tenai, his vow is Batel;

Note: Why does he say 'therefore'? In the previous Dibur, the Ran said that Rava does not come to argue with Abaye [about the Halachah]! We can say that Rava agrees with Abaye's Halachah, but perhaps Abaye argues with Rava's law. (PF)

Support: The Rambam rules like this in Hilchos Nedarim (2:5).

Opinion #1: In some congregations, on Yom Kipur, they say Kol Nidrei ve'Esarei... They intend for this matter (Rava's Perush of our Mishnah), to be Mevatel vows that they will vow afterwards.

אלא שלשונם משובש שנראה מלשונם שהם מתירין נדרים שעברו וזה אין לו ענין אלא נדרים הבאים לאחר מכן

Question: However, their text [of Kol Nidrei] is mistaken. Their words connote that they permit past vows, and this (our Mishnah, according to Rava) pertains only to future vows!

אלא שרבינו יעקב ז"ל היה מתקן הלשון כדי שיהא משמעותו להבא לומר כל נדרי ואסרי די אסרנא ודי חרמנא כולו קמוץ כדי שיהא נראה להבא

Answer: R. Tam fixed the text [of Kol Nidrei] to imply the future. One says "Kol Nidrei ve'Esarei... Di Asrana v'Di Charamna... all have the Nekudah (vowel) Kamatz, to denote the future.

אין ראוי לומר כן כדי שלא יקלו ראשם בנדרים דהא תנא מסתם לה סתומי

(f)

Objection: It is not proper to say so, lest people be lightheaded about Nedarim. The Tana concealed the matter. (We should not publicize it!).

וכתב הרמב"ם ז"ל בפ' הנזכר שיש מן הגאונים שאומרים שאין תנאי קודם מבטל מה שאסר עצמו לאחר מכן אלא בנדרים אבל לא בשבועות

Opinion #2: The Rambam (Hilchos Nedarim Perek 2) says that some Ge'onim say that a stipulation beforehand is Mevatel what he himself forbids only regarding Nedarim, but not regarding Shevu'os. (Since Kol Nidrei permits also Shevu'os, they cannot hold that it is a stipulation to annul future utterances.)

ויש מהם מי שאומר שהשבועות והנדרים שוין הם לדין זה

Other [Ge'onim] say that Shevu'os and Nedarim are the same for this.

ומיהו אמרו בתוספות דווקא בשבועות ונדרים שנשבע ונדר לעצמו אבל מי שהשביעו חברו או שהדירו אין ביטול זה מועיל לו כלום שעל דעת חברו הוא נשבע ונודר

Distinction: Tosfos said that this is only for Shevu'os and Nedarim that one made for himself. If a Neder or Shevu'ah was imposed on a person, this Bitul does not help at all, since he swears or vows based on the other person's will;

וכמו שמבטל תנאו לגמרי דמי דהא אסקינן דלא משתבע אדעתא דנפשיה אלא על דעת משביעו וכדאמרינן בשמעתא דנדרי הבאי.

It is as if he is totally Mevatel his Tenai, for we conclude that he does not swear based on his own will, rather, on the will of the one who imposes the oath, like we say in the Sugya of Nidrei Havai (exaggeration).

THE RAN EXPLAINS THE GEMARA

Gemara: They asked, do Chachamim disagree with R. Eliezer ben Yakov, or do they not argue?

דאיכא לספוקי בהכי משום דדלמא עד כאן לא קאמרי רבנן דנדרי זרוזין הוו אלא במוכר ולוקח שאין פיהם ולבם שוים דאף מתחלה היו רוצים בשלשה דינרין

Explanation: There is doubt about this, for perhaps Rabanan said that Nidrei Zeruzin are Batel only regarding a seller and buyer, for their mouths and hearts are divided. From the beginning they want three Dinarim;

אבל למדיר חבירו שיאכל אצלו איכא למימר שבדוקא הוא מדירו.

However, one who is Madir his friend to eat by him, we can say that truly he is Madir him!
