RAN DH Masnisin k'Nidrei Resha'im... [TRANSLATION: 'Like vows of Resha'im' - he vowed Nezirus, a Korban or a Shevu'ah.]

ר"ן ד"ה מתני 'כנדרי רשעים נדר בנזיר בקרבן ובשבועה

(SUMMARY: The Ran explains that this is through Yados.)

הך מתני' נמי פירושא דידות היא ומפרשינן בגמ' דה"ק דאם אמר כנדרי רשעים הריני והיה נזיר עובר לפניו הרי הוא נזיר

Explanation: Also our Mishnah explains Yados. The Gemara explains that it means as follows. If he said 'k'Nidrei Resha'im Hareini (I am)', and a Nazir passed in front of him, he is a Nazir;

וכן אם אמר כנדרי רשעים עלי חייב קרבן ומסתברא נמי דדוקא כשהיתה בהמה מונחת לפניו

Similarly, if he said 'k'Nidrei Resha'im Alai', he is obligated to bring a Korban. Presumably, this is only if there was an animal resting in front of him.

וכן נמי אם אמר כנדרי רשעים הימנו שלא אוכל והיה ככר מונח לפניו הרי הוא בשבועה שלא יאכלנו

Similarly, if he said k'Nidrei Resha'im Heimenu she'Lo Ochal, and there was a loaf resting in front of him, he has a Shevu'ah not to eat it.

ומיחייב בכל הני כי אמר כנדרי רשעים שהרי הרשעים דרכן לידור בכל אלו

He is liable for all of these when he said k'Nidrei Resha'im, for Resha'im normally vow about all of these;

ומפני שאין ראוי לעשות כן קרי להו נדרי רשעים שהרי רשעים הם לאותו דבר כן נראה בעיני.

Because it is improper to do so, he calls them Nidrei Resha'im, for they are Resha'im in this respect. So it seems to me.

RAN DH k'Nidrei Kesherim [TRANSLATION: Like vows of proper people.]

ר"ן ד"ה כנדרי כשרים

(SUMMARY: The Ran explains that Kesherim do not make Nedarim, and Resha'im do not make Nedavos.)

אף על גב דאמר הריני עלי הימנו והיה נזיר או בהמה או ככר לפניו לא אמר כלום שהרי אין הכשרים נודרים שאין רשאין לעשות כן

Explanation: Even if he said [k'Nidrei Kesherim] Hareini, Alai or Heimenu, and a Nazir, animal or loaf was in front of him, his words have no effect, for Kesherim do not vow, for they may not do so.

וה"ה נמי אם אמר כנדבת רשעים עלי לא אמר כלום לפי שאין רשעים [נודבים] שאם הם נודבים אינם רשעים לאותו דבר והכי איתא בתוספתא (ריש פ"א).

The same applies if he said k'Nidvas Resha'im Alai, his words have no effect, for Resha'im do not make Nedavos, for if they make Nedavos, they are not Resha'im in this respect. And so it says in the Tosefta (1:1).

RAN DH k'Nidvosam Nadar b'Nazir b'Korban [TRANSLATION: 'like their Nedavos' - he vowed Nezirus or a Korban.]

(SUMMARY: The Ran explains how Neder and Nedavah apply to Nezirus.)

שהרי הכשרים מתנדבים הם בקרבן ובנזירות הלכך כי אמר הריני והיה נזיר עובר לפניו הרי הוא נזיר

Explanation: Kesherim make Nedavos of Korban and Nezirus. Therefore, when he said Hareini, and a Nazir passed in front of him, he is a Nazir;

וכי אמר עלי ובהמה מונחת לפניו הוה ליה כאומר הרי הוא קרבן נדבה

When he said Alai and an animal was in front of him, it is as if he says "Harei Hu Korban Nedavah."

אבל בשבועה לא מחייב אפילו היה ככר מונח לפניו ואמר הימנו שלא אוכל לפי שאין הכשרים נשבעין לעולם

However, he is not obligated a Shevu'ah even if a loaf was in front of him, and he said Heimenu she'Lo Ochel, because Kesherim never swear.

ואף על גב דאמרי' לעיל /נדרים/ (דף ח) דלזרוזי נפשייהו נשבעים לדבר מצוה

Implied question: We said above (8a) that they may swear for a Mitzvah to make themselves zealous!

ההיא שבועה לא מקרי נדבה שהרי כבר הם מחוייבים לקיים את המצוה,

Answer: That Shevu'ah is not called a Nedavah, for they are already obligated to fulfill the Mitzvah. (In such a case, the Shevu'ah takes effect for Lo Yochal, but not to obligate a Korban if he transgresses. (Ran 8a DH veha'Lo Mushba). - PF)

ואיכא למידק הרי נדבה אינה אלא באומר הרי זו ונדר בהרי עלי וחילוק זה ליתיה אלא בנדרים דקרבנות

Question: A Nedavah is only when one says "this is [a Korban]." A Neder is when one says "Harei Alai." This distinction applies only to Nedarim of Korbanos;

אבל בנזירות מאי נדר ומאי נדבה שייכי ביה הרי אינו אלא בענין אחד

Regarding Nezirus, how do Neder and Nedavah apply? There is only one manner!

נראה בעיני דנדר פירושו דבר שאינו בא לגמרי בנדבת הלב ונדבה פירושו מה שהאדם נודר יותר בנדבת נפשו ושמעשיו יותר רצויים

Answer: It seems to me that Neder is something that does not come totally through beneficence of the heart, and Nedavah is what a person vows more through beneficence of his Nefesh, and his actions are more pleasing.

ומש"ה אמרינן דנדר הוא הרי עלי לפי שאינו מתנדב לגמרי כיון שלא הפרישו עכשיו

Therefore, we say that Neder is Harei Alai, for he does not totally volunteer, since he did not separate it now;

ונדבה הוא באומר הרי זו לפי שמתנדב נדרו יותר רצוי

Nedavah is when he says Harei Zu. Since he volunteers, his vow is more pleasing.

וכיון שזה הוא פירושם של נדר ונדבה אף בנזיר אף על פי שאין הנדר של נזירות אלא בענין אחד מי שהכוונה שלו רצויה יותר קרוי נזירותו נדבה

Since this is the explanation of Neder and Nedavah, also regarding Nazir, even though the vow of Nezirus takes effect only in one way, one whose intent is more pleasing, his Nezirus is called Nedavah;

ומי שאינה רצויה כל כך קרוי נדר

One whose intent is not so pleasing, [his Nezirus] is called a Neder.

והרשעים כשנודרים בנזיר אין כונתם רצויה לגמרי אבל הכשרים מתוך שכונתם שלמה ורצויה ואין בנזירותם שום נדנוד עבירה קרוי נזירותם נדבה

Resha'im, when they vow to be a Nazir, their intent is not totally pleasing. Kesherim, since their intent is complete and pleasing, and there is no tinge of Aveirah, their Nezirus is called Nedavah.

והיינו דאמרינן בגמרא גבי נדבה דנזירות משכחת לה כשמעון הצדיק וכמו שנפרש בס"ד.

RAN DH Gemara keshe'Hayah Nazir Over Lefanav [TRANSLATION: When a Nazir was passing in front of him.]

ר"ן ד"ה גמ' כשהיה נזיר עובר לפניו

(SUMMARY: The Ran explains that Hareini by itself suffices.)

ואפילו הכי דוקא כי קאמר כנדרי רשעים הריני אבל כי אמר הריני לחודיה לא אמר כלום

Explanation #1: Even so, this is only when he said "k'Nidrei Resha'im Hareini." However, if he said only Hareini, his words have no effect.

דלא דמי לאומר אהא דאמרינן בפ"ק דקידושין דה"ל נזיר כשנזיר עובר לפניו

(b)

Implied question: Why is it unlike one who says "Ehei (I will be)"? We say in Kidushin (5b) that he becomes a Nazir if a Nazir passed in front of him!

משום דאהא לישנא מעליא ומהני אבל הריני אי לאו דאמר כנדרי רשעים הריני (הגהת מהר"ב רנשבורג) לא משמע דאמר מידי כך פירשו רבותי

Answer: That is because Ehei is a good expression, and it works. However, [regarding] Hareini, if he did not say k'Nidrei Resha'im Hareini, it does not connote that he said anything. My Rebbeyim explained like this.

ואינו נראה בעיני דהריני לא גרע מאהא

Rebuttal: Hareini is no worse than Ehei!

אלא מתני' משום דאתא לאשמועינן דאי אמר כנדרי כשרים הריני אפילו בנזיר עובר לפניו לא מהני נקט רישא כנדרי רשעים

Explanation #2: Rather, because our Mishnah comes to teach that if he said k'Nidrei Kesherim Hareini, even if a Nazir passed in front of him, it does not work, the Reisha mentioned k'Nidrei Resha'im;

אבל אין ה"נ דכל שאמר הריני בלחוד והיה נזיר עובר לפניו הרי זה נזיר.

However, indeed, whenever he said Hareini alone, if a Nazir passed in front of him, he is a Nazir.

THE RAN EXPLAINS THE GEMARA

ר"ן ד"ה ודלמא הימנו דאכילנא קאמר

Gemara: Perhaps he meant "Heimenu", that I will eat [from it]!

כלומר וכיון דאיכא למימר דלמא דאכילנא קאמר הוו להו ידים שאין מוכיחות וסבירא ליה לשמואל דלא הויין ידים.

Explanation: I.e. since we can say that perhaps he meant that he will eat, these are ambiguous Yados, and Shmuel holds that they are not Yados.

Gemara: He distinguishes between Neder and Nedavah.

דאמר דכשרים מתנדבין ואינן נודרין.

RAN DH Tov mi'Zeh umi'Zeh... [TRANSLATION: Better than this and this is one who does not vow at all.]

מנודר ומשלם ומנודר ואינו משלם דלעיל מהאי קרא כתיב את אשר תדור שלם ובתר הכי כתיב טוב אשר לא תדור

Explanation: This is better than one who vows and fulfills, and one who vows and does not fulfill. Before this verse it says "Es Asher Tidor Shalem", and afterwards it says "Tov Asher Lo Tidor";

כלומר שהוא יותר טוב מנודר ומשלם דכתיב לעיל מיניה

I.e. this is better [even] than vowing and fulfilling, which is written before this.

וקא יהיב טעמא למילתיה משתדור ולא תשלם כלומר שמא תשכח ולא תשלם ולפיכך טוב אשר לא תדור כלל

He (R. Meir) gives a reason for his words, [this is better] than if you vow and do not fulfill, i.e. perhaps you will forget, and not fulfill. Therefore, it is good that you not vow at all.

משמע לן השתא דלא שני בין נדר לנדבה דאי לא לאשמועינן קרא דטוב מכולן [נודב] ומשלם.

(b)

Explanation (cont.): Now we understand that he does not distinguish between Neder and Nedavah. If not, the verse should teach that best of all is Nodev and he fulfills!

RAN DH R. Yehudah Omer Tov... [R. Yehudah says, better than this and this is one who vows and pays.]

ר"ן ד"ה ר' יהודה אומר טוב מזה ומזה נודר ומשלם

(SUMMARY: The Ran explains when it is better to vow.)

ודריש להו לקראי הכי את אשר תדור שלם וזו היא מדה משובחת

(a)

Explanation: He expounds the verse as follows. What you vow, fulfill. This is a praiseworthy trait;

אבל טוב אשר לא תדור משתדור ולא תשלם

However, it is better that you not vow, than to vow and not fulfill.

ואי תימא פשיטא

(b)

Implied question: This is obvious!

ה"ק לא תהא סבור שבשעת נדרך אתה מוסיף זכות ואח"כ אם שכחת או נאנסת לא הפסדת את שכרך

(c)

Answer: He means as follows. Do not think at the time of your vow that you increased merit, and afterwards if you forgot or Ones occurred, you did not lose your merit;

שאינו כן שאין השכר בשעת הנדר אלא בשעת התשלומים כך נראית שיטה זאת בעיני.

This is not so. The merit is not at the time of your vow, rather, at the time you fulfill. So it seems to me to explain this opinion.

Gemara: R. Meir said so about a Neder. He did not say so about a Nedavah.

דקרא לא איירי אלא בנדרים ולא בנדבה.

Explanation: The verse discusses only Nedarim, and not a Nedavah.

Gemara: Behold, it was taught 'like Nedavos [of Tzadikim]', his Neder of Nezirus or a Korban takes effect!

Explanation: This shows that proper people vow. How can you establish it like R. Meir?

ופירשו רבותי דהך קושיא בדין הוא דהוה מצי לאקשויי לה אגופא דמתני'

Explanation #1 (the Ran's Rebbeyim): Really, we could have asked this question on our Mishnah itself;

דהא מתני' משמע שאין הכשרים נודרין מדקתני כנדרי כשרים לא אמר כלום ובתר הכי קתני נדר

Our Mishnah connotes that Kesherim do not vow, for it says "k'Nidrei Resha'im, his words have no effect", and afterwards it taught [k'Nidvas Kesherim, this is] a Neder!

אלא דמעיקרא דייק מתני' גופא דמפליג בין נדר לנדבה מני ובתר דאוקי לה כר"מ דייקינן היכי קתני נדר

Rather, initially we were exacting about our Mishnah itself, which distinguishes between Neder and Nedavah. Like whom is it? After we established it like R. Meir, we are exacting about how it taught [k'Nidvas Kesherim, this is] a Neder.

ואינו נראה לי

Rebuttal: I disagree.

אלא ה"ק בשלמא אי לא מוקמינן לה כר' מאיר מצינן לפרושי דנדר של כשרים מתוך שהוא ברצון גמור וכשר הדבר לעשות כן נדבה מקרי

Explanation #2: Rather, it means as follows. Granted, if we do not establish it like R. Meir, we could explain that Neder of Kesherim, since it is with full desire, and it is proper to do so, it is called Nedavah;

ואף על גב דאי אמרינן הכי לא שמעינן ליה לתנא דמפליג בין נדר לנדבה ולעיל אמרי' בפשיטות מאן תנא דשני ליה בין נדר לנדבה

Implied question: If we say so, we do not hear that the Tana distinguishes between Neder and Nedavah. Above, we said simply, who is the Tana who distinguishes between Neder and Nedavah!

Answer: Above, we said so because it is the truth;

אבל הש"ס גופיה דחי לה לאידך גיסא ולומר דלאו רבי מאיר היא ולא שני לן בין נדר לנדבה ומתרצא מתני' שפיר

However, the Gemara itself rejected this in the other direction, to say that it is not R. Meir, and we do not distinguish between Neder and Nedavah, and our Mishnah is explained well.

אלא אי אמרת רבי מאיר היא היכי מיקרי נדר דקרבן נדבה והרי כיון שאין הנדר ראוי לכשרים אי אפשר שיקרא נדבה.

However, if you say that it is R. Meir, how is Neder of Korban called Nedavah? Since Neder is not proper for Kesherim, it cannot be called Nedavah!

Gemara - Question: Also a Nedavah, perhaps it will come to a calamity!

דאע"ג דאמר הרי זו דלמא פשע ומאחר להביא יותר משלש רגלים.

Explanation: Even though he said 'Harei Zu', perhaps he will be negligent and delay bringing it more than Shalosh Regalim.

ר"ן ד"ה כהלל הזקן

(b)

Gemara: Like Hillel the elder.

אם אמר על בהמה המונחת בעזרה כנדבת כשרים נדר בקרבן שהרי כשרים מביאין בהמתן לעזרה ומקדישין אותה כדרך שהיה נוהג הלל הזקן.

Explanation: If he said about an animal in the Azarah 'k'Nidvas Kesherim', this is a Neder of a Korban, for Kesherim bring their animals to the Azarah and are Makdish them there, like Hillel the elder used to do.

ר"ן ד"ה מביאה חולין לעזרה

(c)

Gemara: He brings it as Chulin to the Azarah.

לאו בעזרה ממש שאסור להביא חולין לעזרה אלא בפתח העזרה.

Qualification: It is not literally to the Azarah, for one may not bring Chulin into the Azarah! Rather, to the opening to the Azarah.

ר"ן ד"ה נדבה דנזירות מאי איכא למימר

Gemara: A Nedavah of Nezirus - what is there to say?

כלומר היאך כשרים מתנדבין נזירות והא אית להו למיחש דלמא אתו לידי תקלה.

Explanation: I.e. how can proper people make a Nedavah of Nezirus? They should be concerned lest they come to calamity!

ר"ן ד"ה ה"ג כשמעון הצדיק

Gemara: The text says 'like Shimon ha'Tzadik.'

ולא גרסי' סבר לה

Clarification: The text does not say 'he holds like.'

והכי פירושא דכל שנדר מתוך עניין כזה (כן נראה להגיה) כל כך כוונתו רצויה דליכא למיחש לבא לידי תקלה.

Explanation: It means as follows. Anyone who vowed in such a way, his intent is so acceptable that there is no concern lest he come to calamity.

Gemara: The Asham of a Nazir Tamei.

שהתחיל למנות ונטמא במת שסותר מנינו ומביא קרבן ומונה כתחלה.

Explanation: He began to count Nezirus, and he became Tamei via a Mes. He cancels his count, brings a Korban and counts [30 more] days, like at the beginning.

Gemara: My Yetzer frenzied upon me.

מיהר מל' פחז כמים

Explanation: It was quick. This is like "Pachaz ka'Mayim."

Gemara: It wanted to remove me from the world.

RAN DH Mevi'in Chulin b'Azarah [They bring invalid Korbanos.]

לאו דוקא שכל זמן שלא התירן חכם נזירותן קיימת וקרבנותיהן חובה עליהן

Explanation: It is not truly [Chulin b'Azarah]. As long as a Chacham did not permit [his vow], his Nezirus is intact and his Korbanos are obligatory on him;

אלא כעין חולין קאמר שמתוך שאין כוונתן רצויה אף קרבנותיהן אינן רצויין

Rather, he means that it is like Chulin. Since his intent is not pleasing, even his Korbanos are not pleasing.

אבל בהך גברא שבא מן הדרום ליכא למיחש להכי שכיון שהיתה כוונתו כל כך רצויה בתחלה אנן סהדי שלא נתחרט.

(b)

Distinction: However, with this man who came from the south, there is no concern for this. His intent was so pleasing at the beginning, that we can testify that he did not regret.
