NIDAH 12 - dedicated by Mrs. Rita Grunberger of Queens, N.Y., in loving memory of her husband, Reb Yitzchok Yakov ben Eliyahu Grunberger. Irving Grunberger helped many people quietly in an unassuming manner and he is dearly missed by all who knew him. His Yahrzeit is 10 Sivan.

SUMMARY

1. A woman should not check herself before having relations with her husband.
 
2. If a woman checks herself immediately after having relations and finds blood, both she and her husband must bring an Asham Taluy.
 
3. The Beraisa discusses the status of a woman who has no set time at which she sees Dam, but she sees at any time.
 
4. The Gemara explains why the Tana Kama says that a man must divorce his wife with the understanding that he can never remarry her.
 
5. The Tana Kama states that such a woman (see #3) does not even receive her Kesuvah money.

A BIT MORE

1. If he sees her doing so, he may separate from her, because the Chachamim did not mandate that she check, lest her husband think that she is checking because she suspects that she is Tamei.
 
2. However, a woman should not examine herself at such a time, unless she handles Taharos. Her husband will not want to be with her if he realizes that she always checks to see if they are liable to bring an Asham Taluy.
 
3. Tana Kama: Having relations with such a woman is forbidden, because she might become a Nidah at any moment; her husband must divorce her with the understanding that he will never remarry her. Rebbi Chanina ben Antignos: She may have relations with her husband if she checks herself before and after doing so; she does not have to get divorced.
 
4. This is because we suspect that, after the divorce, her body will eventually regulate itself and she will have a set time she sees Dam, and she will proceed to marry someone else. Her husband will then claim that he divorced her under the false pretense that she could see Dam at any time, thereby invalidating the Get that he gave her, resulting in her marriage to the second man being a grave sin and any children she begot from him Mamzerim. In order to avoid this possibility, Beis Din requires that he divorce her unconditionally, with the understanding that he can never remarry her.
 
5. Since her husband cannot have relations with her, she does not receive her Kesuvah money. She is not even entitled to claim food support from his estate before the divorce.
