ZEVACHIM 69 (8 Tamuz) - Today's Dafyomi study is dedicated to the memory of Dr. Moshe Gottlieb, Moshe Ze'ev ben Chaim Shlomo Yosef ha'Levi z'l, who healed the sick of Jerusalem and Israel with Chesed. Dedicated by his loving family on the day of his Yahrzeit.

SUMMARY

1. If a Kohen slaughters a bird (brought as a Korban in the Azarah) instead of doing Melikah, it is Pasul, but it is not Metamei as a Neveilah.
 
2. If Melikah is done to a bird of Chulin inside the Azarah, it is Metamei as a Neveilah.
 
3. The Beraisa states that if the Melikah of a bird was done by a non-Kohen or a Kohen who is Pasul, or if it became Pigul, Nosar, or Tamei, it is not Metamei as a Neveilah.
 
4. According to Rebbi Yitzchak, if the Melikah of a bird is done by a non-Kohen and the bird is placed on the Mizbe'ach, it is not removed. However, if the Kemitzah of a Minchah is done by a non-Kohen and placed on the Mizbe'ach, it is removed.
 
5. Melikas Kodshim outside the Azarah, and Melikas Chulin both inside and outside the Azarah, are Metamei as a Neveilah.
 
6. One who slaughters a bird of Kodshim outside the Beis ha'Mikdash is Chayav Kares.
 
7. According to Rebbi Meir, if Melikah is done to a bird of Kodshim, or Shechitah to a bird of Chulin, and the bird is found to be a Tereifah, it is not Metamei as a Neveilah. Rebbi Yehudah disagrees.
 
8. According to Rebbi Yosi, if Shechitah is done to a bird of Chulin and the bird is found to be a Tereifah, it is not Metamei as a Neveilah. However, if Melikah is done to a bird of Kodshim and the bird is found to be a Tereifah, it is Metamei as a Neveilah.
 
9. The Neveilah of an animal transmits Tum'ah via carrying and contact, but not via swallowing. The Neveilah of a bird does not transmit Tum'ah via carrying or contact, but only via swallowing.
 
10. If an animal was slaughtered and was found to be a Tereifah, it is not Metamei as a Neveilah.
 
11. Rebbi Yehudah says that the Neveilah of a non-Kosher bird does not convey Tum'ah to the clothing of the person who swallows it.

A BIT MORE

1. If the bird is slaughtered outside the Azarah, it also is not Metamei as a Neveilah.
 
2. If Melikah is done to a bird of Chulin or Kodshim outside the Azarah, the bird also is Metamei as a Neveilah.
 
3. This Beraisa is in accordance with Rebbi Yochanan. Rav says that if a non-Kohen does the Melikah, the bird is Metamei as a Neveilah.
 
4. The Melikah of a bird brought on a Bamah may be done by a non-Kohen. Therefore, if a non-Kohen does the Melikah in the Beis ha'Mikdash, although it is Pasul it is not Metamei as a Neveilah. In the case of a Minchah, the Kemitzah of a Minchah may be done by a non-Kohen on a Bamah. However, it is not placed into a Kli Shares there, and thus the law of Kemitzah in the Beis ha'Mikdash -- which is placed into a Kli Shares -- cannot be learned from Kemitzah on a Bamah.
 
5. Melikah permits only a bird of Kodshim to be eaten. If Melikah is done to a bird of Chulin, it may not be eaten and it is Metamei as a Neveilah. Only Melikah may be done to a bird of Kodshim, and not Shechitah. However, a verse in the Torah teaches that one is Chayav Kares even for Shechitah of a bird of Kodshim outside the Beis ha'Mikdash.
 
7. Rebbi Meir derives from a Kal va'Chomer that if the Shechitah of an animal (which is found to be a Tereifah) is Metaher it from Tum'as Neveilah, even though Tum'as Neveilah is transmitted via carrying or contact, then certainly the Shechitah of a bird (which is found to be a Tereifah) is Metaher it from Tum'as Neveilah, since the Tum'as Neveilah of a bird is not transmitted via carrying or contact, but only via swallowing. Subsequently, the Melikah of a bird is derived through a Meh Matzinu from the Shechitah of a bird, and it is also Metaher the bird from conveying the Tum'ah of a Neveilah.
 
8. Rebbi Yosi says that since the law of a bird is derived through a Kal va'Chomer from the Shechitah of an animal, only the law concerning Shechitah may be derived, but not the law concerning Melikah.
 
9. If someone pushed meat of Neveilah of an animal down another person's throat, it does not transmit Tum'ah to the clothing of the person who swallowed it.
 
10. Rebbi Meir and Rebbi Yehudah disagree about whether a bird which was slaughtered and found to be a Tereifah transmits the Tum'ah of Neveilah. They agree that an animal which was slaughtered and found to be a Tereifah does not convey the Tum'ah of Neveilah.
 
11. Only a Kosher bird, which may not be eaten only because it is a Neveilah, transmits Tum'ah to the clothing of the person who swallows it, but not the Neveilah of a non-Kosher bird, which may not be eaten even if it is not a Neveilah.
