SUMMARY

1. It is forbidden to derive benefit from a hand or a foot which broke off from an Avodah Zarah, because it is significant enough to be worshipped.

2. A Nochri can nullify his own or his friend’s Avodah Zarah.

3. A Yisrael cannot nullify the Avodah Zarah of a Nochri.

4. The Avodah Zarah of a Yisrael can never be nullified.

5. If a Nochri chisels an Avodah Zarah in order to use the woodchips for firewood, the Avodah Zarah is permitted.

6. If the Nochri chisels an Avodah Zarah in order to beautify it, the woodchips are permitted but the Avodah Zarah is forbidden.

7. If a person finds a metal Avodah Zarah, he either should grind it up and let the wind carry it away, or throw it into the sea, according to Rebbi Yosi. The Rabanan disagree.

8. If a person finds a figure of a dragon with the head cut off and it is a Safek whether a Yisrael or a Nochri cut it off, it is permitted.

9. If a bird makes a nest in a Hekdesh tree, one may not benefit from the nest. If one benefits from the nest, he does not bring a Korban Me'ilah.

10. If a bird makes a nest in an Asheirah tree, one is permitted to benefit from the nest.

11. If one finds a utensil with a diagram of the sun, moon, or a dragon, he must throw it into the Dead Sea, according to the Tana Kama.

12. If a person slaughters an animal to a mountain, river, sea, or desert, or even to an insect, the animal is forbidden.

A BIT MORE

1. Shmuel explains that the hand or foot is on a special base which was made for it. Although Shmuel maintains that a broken Avodah Zarah is permitted, since the hand or foot was placed on a base it is apparent that the Nochri intends to worship it.

2. Even a Nochri who worships a different Avodah Zarah than his friend may nullify the Avodah Zarah of his friend.

3. Rava explains that it is a Gezeirah because of the concern that a Yisrael will make a Kinyan on the Avodah Zarah of the Nochri before he breaks it. It will therefore become the Avodah Zarah of a Yisrael, which can never be nullified.

4. Since the Avodah Zarah cannot be nullified, it must be buried.

5. Since he chisels the Avodah Zarah for the firewood, he nullifies it.

6. Although he does not nullify the Avodah Zarah, the woodchips are permitted because he intends to throw them out, thus nullifying them.

7. According to the Rabanan, he must throw it in the sea. He should not grind it up and allow the wind to carry it away, because it may fertilize his friend's field, and thus he would be benefiting from an Avodah Zarah.

8. It is permitted because of a Sfek Sfeika. It is a Safek if it was worshipped as an Avodah Zarah at all. Even if it was worshipped as an Avodah Zarah, it is a Safek whether a Yisrael or a Nochri cut off its head.

9. Although the nest is not Hekdesh, one is forbidden to benefit from it because of a Gezeirah lest he benefit from the branches of the tree.

10. It was not necessary for the Rabanan to make a Gezeirah in the case of an Asheirah tree, because a person keeps away from Avodah Zarah. However, he may not climb the tree to reach the nest. Rather, he should poke it down with a pole.

11. This is because of the concern that it was worshipped as an Avodah Zarah. Rebbi Shimon ben Gamliel maintains that it is forbidden only if the diagram is on a decorative utensil.

12. Anything that is worshipped is regarded as an Avodah Zarah. It is forbidden to derive benefit from an animal that was slaughtered to it.
