KESUVOS 10

Question

SUMMARY

The Chachamim decreed that a Besulah receives 200 Zuz for her Kesuvah, and a widow receives 100.

If the husband claims that his wife has no Besulim, she loses her Kesuvah because he would not lie after spending so much money on the wedding.

Since the Kesuvah is a Takanas Chachamim, the woman collects her Kesuvah from Ziboris (the lowest quality land).

Raban Shimon ben Gamliel maintains that the Kesuvah is Min ha'Torah.

Raban Shimon ben Gamliel rules that if a man marries a woman in Kaputkiya and divorces her in Eretz Yisrael, he must pay the Kesuvah with the money of Kaputkiya. (1)

Even Raban Shimon ben Gamliel agrees that the Kesuvah of a widow is mid'Rabanan.

Rebbi Acha says that if someone was never married before and he claims he found an opening, he is not believed.

The women of the family of Durkati have no blood of Besulim or blood of Nidah.

Just as sourdough is good for the dough, blood of Nidah is good for a woman. (2)

The Beraisa says in the name of Rebbi Meir that a woman who sees a lot of blood will have a lot of children.

A Besulah receives 200 Zuz for her Kesuvah, and a widow receives 100. (3)

Rav says that someone who ate dates may not rule on a Halachic matter.

One who drank a Revi'is of wine may not rule on a Halachic matter.

Dates are healthy when eaten after bread.

A BIT MORE

1. The money of Kaputkiya is better currency than that of Eretz Yisrael. Since Raban Shimon ben Gamliel maintains that a Kesuvah is Min ha'Torah, he rules that since the Kesuvah was written in Kaputkiya, the husband must pay her with the currency of Kaputkiya even though he divorced her in Eretz Yisrael.

2. Blood helps a woman conceive.

3. A widow or divorcee from Eirusin receives 200 Zuz for her Kesuvah. If the husband finds that she is not a Besulah, she loses her entire Kesuvah, because the marriage is regarded as a Mekach Ta'us.

BRIEF INSIGHT

TOSEFES KESUVAH

The Rif says in the name of the Ga'on that the husband is believed only regarding the principal Kesuvah, but not regarding the Tosefes Kesuvah. However, the Rosh maintains that he is believed regarding the Tosefes as well. The same logic that dictates that he is not lying regarding the principal Kesuvah applies to the Tosefes Kesuvah as well: If he hated her and wanted to divorce her, he would have done so before he made the wedding. This logic applies even more so to the Tosefes, since the Tosefes Kesuvah is written at the time of the Chupah. How could it be that at the time of the Chupah he wrote for her the Tosefes and the next morning he already regrets it? It must be that he is saying the truth when he says that she has no Besulim, and thus he is believed regarding the Tosefes Kesuvah as well.

QUICK HALACHAH

CHECKING WITH A BARREL OF WINE

If a man claims that his wife had no blood of Besulim, if she is from the family of Durkati she remains with her Chazakah that she is a Besulah. If she is not from the family of Durkati, Beis Din investigates whether she has an illness that may have been the cause of the lack of blood, or whether she was not eating enough and her lack of nutrients is the cause. Beis Din brings her to the bathhouse to bathe, and gives her food and drink, and then they have a second Bi'ah. If she again sees no blood, his claim is considered valid. (Shulchan Aruch EH 67:5)
