YEVAMOS 81

Ask A
Question

SUMMARY

Rav Huna: A Shomeres Yavam who has an intimate relationship with any other man is Pesulah to the Yavam.

Rebbi Yehudah: An Ailonis is regarded as a Zonah and she is Pesulah to a Kohen.

The wife of a Kohen who is a Seris Chamah may eat Terumah.

A Tumtum who is surgically opened and found to be a male may not do Chalitzah because he is a Saris.

Reish Lakish: The wife of a Kohen who is an Androginus may eat only Terumah d'Rabanan. (1)

Rebbi Yochanan: The wife of a Kohen who is an Androginus may eat both Terumah and the Chazeh v'Shok from Kodshim.

Rebbi Meir: If a bundle of Tilsan of Kil'ei ha'Kerem becomes mixed with other Tilsan, the entire mixture must be burned. (2)

The Chachamim maintain that six items of Kil'ayim or Orlah are so important that they are not Batel even in 200 parts. (3)

Tana Kama: A piece of Tamei Chatas or of Tamei Lechem ha'Panim that became mixed with other pieces of Chatas or Lechem ha'Panim is Batel. Rebbi Yehudah: It is not Batel. (4)

A BIT MORE

1. Reish Lakish maintains that since the Androginus is only a Safek male, his wife may eat only Terumah d'Rabanan, but not Terumah d'Oraisa. Moreover, she is permitted to eat Terumah d'Rabanan only when the Beis ha'Mikdash is not standing, but when the Beis ha'Mikdash is standing she may not even eat Terumah d'Rabanan lest she come to eat Terumah d'Oraisa.

2. Kil'ei ha'Kerem is prohibited in all Hana'ah and must be burned. Rebbi Meir: The bundle of Tilsan is not Batel even in 200 parts, because it is Chashuv and is sold by number, not by weight. Chachamim: It is Batel in 200 parts.

3. Rebbi Akiva maintains that there are seven items that are not Batel.

4. However, if a piece of Chatas that is Tahor or Lechem ha'Panim that is Tahor becomes mixed with other pieces of meat or bread, even the Tana Kama maintains that it is not Batel, since the mixture may be eaten by the Kohen and it is only a small loss.

BRIEF INSIGHT

A SMALL LOSS

The Beraisa says that if a piece of Chatas that is Tahor becomes mixed with other pieces of meat or bread, even the Tana Kama agrees that it is not Batel. Rashi says that the reason why it is not Batel is that the mixture may be eaten by the Kohen, and therefore even if it is not Batel it is only a small loss. The Aruch la'Ner asks that the Chatas must have been become mixed with the Chulin inside the Azarah, because a Chatas that is taken out of the Azarah is Pasul. It is not possible to eat the mixture in the Azarah because it is forbidden to eat Chulin in the Azarah, and this mixture is mostly Chulin. It is also not possible to take the mixture outside the Azarah, since a Chatas may not be taken out of the Azarah. Why, then, is it considered only a small loss, if it is impossible to eat the mixture altogether?

QUICK HALACHAH

KIL'EI HA'KEREM

It is forbidden to plant vegetables or grain next to vines, or vice versa. If one does so he does not get Malkus, but they become forbidden in Hana'ah and both plants must be burned. Even the straw of the grain and the wood from the vines is forbidden in Hana'ah. (Shulchan Aruch YD 296:3)

There is no Malkus in this case, because the Chiyuv Malkus applies only if one plants seeds of wheat, barley, and grapes at one time. (Taz)
