Question

SUMMARY

Even if a person does not have money to pay the Kesuvah of his wife the Kesuvah is not ripped up. (1)
 
A Chacham may ask a person if he would have made the Neder if he knew that Shabbos and Yom Tov are included in the Neder. If he responds in the negative he is released from the Neder.
 
At first the Chachamim said that he is only released from the Neder on Shabbos and Yom Tov until Rebbi Akiva taught that he is released from the entire Neder. (2)
 
If someone makes a Neder prohibiting "all of you" if he is released from his Neder regarding one of them they are all permitted.
 
If someone makes a Neder to this person and to this person and to this person, if he is released from the first person they are all permitted.
 
If he is released from the last person only the last person is permitted.
 
If he says that this person shall be forbidden like a Korban and this person shall be forbidden like a Korban a separate Pesach is required for each Neder. (3)
 
If someone prohibits wine with a Neder because it is bad for the stomach and someone tells him that old wine is good for the stomach the entire Neder is void. (4)
 
If someone prohibits onions with a Neder because they are bad for the heart and someone tells him that Kufri onions are good for the hear the entire Neder is void.
 
A Chacham may ask a person if he would have made the Neder if he knew that he or his family would be disgraced by the Neder. (5)
 
If someone makes a Neder that he will not marry a woman because she is ugly if it turns out that she is not ugly the Neder is void.
 
Rebbi Yishmael says even if she was ugly at the time and she becomes nice looking after the Neder he is permitted to marry her.
 
In order to make Shalom between a man and his wife the Torah says that the name of Hashem that is written bi'Kedushah shall be erased in the water.

A BIT MORE

1. If he obtains the money at a later date he must pay the Kesuvah to his wife.
 
2. Because a person who is released from part of a Neder is released from the entire Neder.
 
3. This is in accordance with the opinion of Rebbi Shimon. According to the Chachamim if he said to this person and to this person a separate Pesach is required for each Neder.
 
4. Because a Neder that is partially Mutar becomes entirely Mutar.
 
5. We are not concerned that he will lie because he is embarrassed to admit that he would have made the Neder anyway.
 
6. Rebbi Yishmael holds that a Neder may be released on the basis of Nolad.

BRIEF INSIGHT

BAVA BEN BUTA
 
A wife broke two candlesticks on the head of Bava Ben Buta upon the instructions of her husband and he said, "You did the will of your husband. Hashem Yisbarach should grant you two children like Bava Ben Buta." The Chasam Sofer asks why was it permitted for the wife to disgrace a Talmid Chacham in order to do the will of her husband. The Chasam Sofer answers that the Gemara says that Bava Ben Buta advised Hurdus to renovate the Beis ha'Mikdash. Some people were angry at him for doing so because from the time the Beis ha'Mikdash was renovated the Torah became split into two because that was the time of the disputes between Beis Shamai and Beis Hillel and the Torah became like a thousand Torahs. Even though the Pasuk says "The Torah will go out from Zion and the word of Hashem from Yerushalayim," however as soon as the second Beis ha'Mikdash was built there was no more prophecy and from the time that Hurdus renovated the Beis ha'Mikdash the Torah was split into two. The reason for this is because it was built through the Persians and Hurdus was a servant. Since the Beis ha'Mikdash was not built by Jews it caused a cessation of prophecy and the split of the Torah. Therefore the husband wanted his wife to break two candlesticks on his head because the two candlesticks represented the light of Torah and the light of prophecy which had been compromised because the Beis ha'Mikdash was built by Nochris.

A PARTIAL NEDER
 
A Neder that is partially Mutar becomes completely Mutar. What is the case? If someone makes a Neder to fast for a certain amount of time and it includes Shabbos and Yom Tov, we ask him would you have made the Neder if you have taken into account that it includes Shabbos and Yom Tov and it becomes completely Mutar. (Shulchan Aruch YD 229:1)
 
It is a Sevara that he had in mind that the Neder shall only be valid if the entire Neder is valid. The Ran says however that it is a Gezeiras ha'Kasuv.
