KESUVOS 6 (13 Tamuz) - Today's Daf is dedicated to the blessed memory of U.S. Army Staff Sgt. Seymour Ira Gottlieb (Yitzchak Shimon ben Chaim Shlomo Yosef ha'Levi, Z"L), who died in Word War II on the 13th of Tamuz 5704 in the battle of St. Lo, France, fighting the Nazis to save his Jewish brethren in Europe.

SUMMARY

Bei Rav: Rav permits a Bi'as Mitzvah on Shabbos, and Shmuel prohibits it. Neharde'a: Shmuel permits it, and Rav prohibits it. (1)
 
It is forbidden to squeeze a sponge on Yom Tov. (2)
 
Although Rebbi Shimon rules that an unintentional act of Melachah is permitted, if it is a Pesik Reisha (the Melachah inevitably will happen) he agrees that it is prohibited.
 
Rav follows the opinion of Rebbi Yehudah that an unintentional act of Melachah is forbidden. Shmuel follows the opinion of Rebbi Shimon that it is permitted. (3)
 
Beis Shamai: Any blood that a Ketanah – who is too young to see Dam Nidah – experiences the first four nights of marriage is regarded as the blood of Besulim.
 
Beis Hillel: Any blood that the newly married Ketanah sees is regarded as the blood of Besulim until the wound heals. (4)
 
Beis Shamai: If a girl is old enough to see blood but she has not yet seen blood, any blood that she sees the first night is regarded as the blood of Besulim. (5)
 
Shmuel: It is permitted to enter a tight passageway on Shabbos even though pebbles are dislodged.
 
A Chasan is exempt from Keri'as Shema for four nights after the wedding if he has not yet done Bi'as Mitzvah. (6)
 
A mourner is obligated in all of the Mitzvos with the exception of Tefilin.
 
Rebbi Shimon permits having relations on Shabbos, because most people know how to have Bi'ah without drawing blood.
 
If one opens up a sore on Shabbos for the purpose of making an opening, he is Chayav. (6)

A BIT MORE

1. Bei Rav was the place of Rav, and Neharde'a was the place of Shmuel. Each place was lenient for themselves.
 
2. It is inevitable that some of the absorbed liquid will be squeezed out.
 
3. Even though Rav follows the opinion of Rebbi Yehudah, he still may rule that a Bi'as Mitzvah on Shabbos is permitted, because it is a destructive act which is permitted on Shabbos.
 
4. As long as she continues to see blood when having relations, the wound has not yet healed.
 
5. Beis Hillel maintains that any blood that she sees the first four nights until Motza'i Shabbos is regarded as the blood of Besulim.
 
6. One Tana in the Beraisa maintains that the Chasan is obligated to read Shema on Friday night.
 
7. If it is for the purpose of extracting fluid, it is permitted.

BRIEF INSIGHT

PESIK REISHA
 
Although Rebbi Shimon maintains that an unintentional Melachah is permitted, if it is a Pesik Reisha he agrees that it is prohibited. The Aruch says that a Pesik Reisha d'Lo Nicha Lei (one has no interest in the outcome of the Melachah) is permitted. Even though the Melachah is inevitable, since the outcome of the Melachah is of no interest to the person, it is permitted. Tosfos disagrees with the Aruch and says that a Pesik Reisha d'Lo Nicha Lei is forbidden mid'Rabanan. For that reason, it is forbidden mid'Rabanan to squeeze a sponge on Yom Tov even though is a Pesik Reisha d'Lo Nicha Lei, since one has no use for the squeezed-out liquid. The Aruch, however, learns that the Isur of squeezing the sponge is not the Melachah of Sechitah, because that is a Pesik Reisha d'Lo Nicha Lei (and thus it should be permitted); rather, it is Asur because one might decide to keep the sponge in the Kli and be Mevatel it to the Kli, and he thereby would be making a Kli on Shabbos.

QUICK HALACHAH

KERI'AS SHEMA FOR A CHASAN
 
A man who marries a Besulah is exempt from Keri'as Shema if he has not yet had Bi'ah, because he is anxious about the Mitzvah. This exemption applied only in ancient times; nowadays, most people do not have proper Kavanah even when they are not a Chasan, and therefore even a Chasan is obligated in Keri'as Shema. (Shulchan Aruch OC 70:3)
 
Nowadays, a Chasan who does not read Keri'as Shema demonstrates arrogance, because he gives the appearance as if at other times he has proper Kavanah. (Mishnah Berurah)
