Question

SUMMARY

If someone vows to be a Nazir twice he must keep two separate Neziruyos. (1)

A Shevu'ah after a Shevu'ah does not go into effect.

A Shevu'ah is effective even on something that is not tangible, but a Neder is only effective on something tangible.

A Neder is effective to prohibit a Devar Mitzvah but a Shevu'ah is not effective on a Devar Mitzvah.

The Torah warns that a person will not be absolved if he swears in vain.

If someone makes the same Shevu'ah twice, if he is released from the first Shevu'ah by a Chacham the second Shevu'ah goes into effect.

If someone vows to be a Nazir twice and after he completes the first Nezirus and separates a Korban he is released from the Nezirus by a Chacham, the Nezirus counts for his second vow of Nezirus.

If someone vows that an object should be forbidden like a salted meat, if he explains that he is referring to the salted meat of a Shelamim it is a valid Neder.

If he explains that he is referring to the salted meat that is brought to an Avodah Zarah it is not a valid Neder. (2)

If he does not explain whether he means the salted meat of a Shelamim or of an Avodah Zarah it is a valid Neder because a Stam Neder is a valid Neder.

If someone vows that an object should be forbidden like a Cherem, if he explains that he is referring to the Cherem of Shamayim it is a valid Neder.

If he explains that he is referring to the Cherem of the Kohanim it is not a Neder. (3)

If he does not explain whether he is referring to the Cherem of Shamayim or of the Cherem of the Kohanim it is forbidden. (4)

If someone vows that an object shall be forbidden like Terumah if he explains that he is referring to Terumas ha'Lishkah the Neder is valid.

If he explains that he is referring to Terumas Aharon it is not a Neder.

If he does not explains whether he is referring to Terumah of Aharon or to the Terumas ha'Lishkah the Neder is valid. (5)

If someone vows that an object shall be forbidden like Ma'aser if he explains that he is referring to Ma'asar Behemah the Neder is valid.

If he explains that he is referring to Ma'aser of produce it is not a Neder.

If he does not explain whether he is referring to Ma'asar Behemah or to the Ma'aser of produce it a valid Neder.

A Safek Nezirus is not a Nezirus. (6)

If someone is Makdish his Beheimos and Chayos, a Koy (Safek Behemah Safek Chayah) is also Kadosh. (7)

A BIT MORE

1. For each one of the two Neziruyos he must shave and bring a separate Korban.

2. Because the meat that is sacrificed to an Avodah Zarah is a Davar ha'Asur not a Davar ha'Nadur.

3. Because the Cherem of the Kohanim is permitted once it reaches the hands of the Kohanim.

4. This is the opinion of Rebbi Meir who holds that Stam Charamim are assumed to mean for Hekdesh. Rebbi Yehudah holds that only Stam Charamim in Galil are forbidden because the people of Galil are not familiar with Chermei Kohanim and therefore we assume that he meant the Cherem of Hekdesh. However, Stam Charamim in Yehudah are permitted because we assume that he meant Chermei Kohanim.

5. This is the opinion of Rebbi Meir who holds that Stam Terumah is assumed to mean Terumas ha'Lishkah. Rebbi Yehudah holds that only Stam Terumah in Yehudah is assumed to mean Terumas ha'Lishkah, but Stam Terumah in Galil is assumed to mean Terumah of Aharon because the people of Galil are not familiar with Terumas ha'Lishkah.

6. If someone vows he will be a Nazir if this pile of grain consists of 100 Kor he is not a Nazir even if the pile does consist of 100 Kor.

7. Rebbi Eliezer says that a Koy is not included in the Hekdesh.

BRIEF INSIGHT

CHERMEI KOHANIM

If someone vows that an object should be forbidden like a Cherem, if he explains that he is referring to the Cherem of the Kohanim it is not a Neder. The Rosh asks that the Cherem of the Kohanim is forbidden as long as it had not yet been given to the Kohen and thus it is a Davar ha'Nadur and it should be a valid Neder. The Rosh answers that when someone makes a Neder with Chermei Kohanim it implies a Cherem that has already reached the hands of the Kohen.

QUICK HALACHAH

TWO SHEVU'OS

"Shevu'ah that I will not eat this Kikar, Shevu'ah that I will not eat this Kikar," the second Shevu'ah is not effective. If he is released from the first Neder the second Neder is effective. (Shulchan Aruch YD 238:21)

A Chacham releases a Neder retroactively and it is as if he has never made the Shevu'ah at all and therefore the second Shevu'ah goes into effect. (Shach)
