12th Cycle Dedication

ERCHIN 14 - Two weeks of study material have been dedicated by Mrs. Estanne Abraham Fawer to honor the twelfth Yahrzeit of her father, Rav Mordechai ben Eliezer Zvi (Rabbi Morton Weiner) Z'L, who passed away on 18 Teves 5760. May the merit of supporting and advancing Dafyomi study -- which was so important to him -- during the weeks of his Yahrzeit serve as an Iluy for his Neshamah.

SUMMARY

1. A Sedeh Achuzah is redeemed for a fixed value. Accordingly, it is often redeemed for much more or much less than its actual value.
 
2. There is a dispute about how a Sedeh Mikneh is evaluated for its redemption.
 
3. Everyone agrees that there is a difference between the redemption of a Sedeh Achuzah and a Sedeh Mikneh.
 
4. If a Shor Mu'ad kills an Eved Kena'ani, his owner must pay 30 Sela to the servant's owner, regardless of the servant's actual value at the time of his death.
 
5. A person who rapes or seduces a girl pays the fixed amount of 50 Sela, regardless of whether the girl was the daughter of an important family or a lowly family.

A BIT MORE

1. The fixed value of redemption is based on the following formula: for every amount of the field which is large enough to plant a Beis Kor (30 Se'ah) of barley (i.e. an area of about 274 square Amos), one must pay 50 silver Shekalim.
 
2. Tana Kama: The field's actual value is paid. Rebbi Eliezer: A Gezeirah Shavah teaches that a Sedeh Mikneh has the same law of redemption as a Sedeh Achuzah.
 
3. Besides the difference, according to the Tana Kama, in the way the fields are evaluated for their redemption, there is a difference when the original owner of the field redeems his field. If he redeems a Sedeh Achuzah, he must add one fifth of its value, but if he redeems a Sedeh Mikneh, he does not add a fifth.
 
4. If the ox kills an ordinary Jew, the owner must pay the victim's actual value to his heirs. If he does damage to, but does not kill, an ordinary Jew or Eved Kena'ani, he must pay full damages.
 
5. However, the damages of Boshes (embarrassment) and Pegam (blemish) are valued according to the status of the people involved.
