וקשה מאי רבותא והא כתיב וקדשתו לכל דבר שבקדושה לברך ראשון

Question: What is the Chidush? It says "v'Kidashto" - for every matter of Kedushah, to bless first!

וי"ל דשוין לאו דוקא אלא כלומר שהכהן נמי תלמיד חכם אמנם אינו חשוב כמותו ואפי' הכי לא היה רבי פרידא רוצה לקרות לפניו

Answer: We do not mean literally equal. Rather, it means that also the Kohen is a Chacham, just he is not as important as R. Freida. Even so, R. Freida did not want to read before him.

וגם צריך לומר דשאר כהנים היו כפופים לרבי פרידא דאל"כ לא הוי רבותא

Explanation #1: We must say that other Kohanim were submissive to R. Freida. If not, there was no Chidush [that he never read first];

כדחזינן פרק הניזקין (גיטין דף נט: ושם) דרב הונא לא הוי קרי בכהני אי לאו דרבי אמי ורבי אסי כהני חשיבי דארעא דישראל הוו כייפי ליה

We find in Gitin (59b), that Rav Huna would not have read [first] in place of a Kohen if not that R. Ami and R. Asi, the esteemed Kohanim of Eretz Yisrael, were submissive to him.

ועי"ל דהא דאמר התם דרב הונא לא הוה קרי בכהני אלא משום דשאר כהני כייפו ליה היינו דווקא בשבתות וי"ט דאיכא כינופיא

Explanation #2: Alternatively, we can say that Rav Huna read like a Kohen only because [all] the Kohanim were submissive to him, i.e. only on Shabbos and Yom Tov, when there is a multitude [in the Beis ha'Keneses];

אבל בב' ובה' קורא שפיר בפני כהן אע"ג דלא הוי גדול כ"כ

However, on Monday and Thursday, he (a bigger Chacham) may read [first] even if he is not so great (that all Kohanim are submissive to him).

Explanation: This was even in a way that he (Avuha or Minyamin bar Ihi) could not come to an oath, and even if an oath will be incumbent on the Nochri, he would exempt him from it;

דשרי בשאר בני אדם אפ"ה לא היה רוצה לעשות.

This is permitted for other people. Even so, he did not want to make [a partnership with a Nochri].

קשה מאי ועוד דהא לעיל הוה מקיל טפי מחכמים והכא הוא מחמיר ואם כן מאי ועוד

Question: Why does it say "further"? Above he was more lenient than Chachamim, and here he is stringent. If so, why does it say "further"?

וי"ל דקאי אהא דאמר ר' יהודה ברישא מוכרין אותו לשם חצר ודוקא לשם חצר קאמר אבל סתם אינה יורדת מקדושתה

Answer: "Further" refers to what R. Yehudah said in the Reisha, we may sell it for a Chatzer. He permits only for a Chatzer, but Stam, it may not descend from its Kedushah;

והיינו ועוד דאמר ר' יהודה כלומר ועוד חומרא אחרת מלבד הראשונה.

R. Yehudah said further, i.e. another stringency, in addition to the first one.

TOSFOS DH Ein Ochlin v'Ein Shosin Bahen

Explanation: As long as they are Batel [they have no Kedushah].

דהא חזינן בברייתא דלעיל וגם שהאמוראים לא היו רוצים ליכנס בהן בגשמים מפני גשמים אלא משום דשמעתא בעי צילותא

Proof: We see in the Beraisa above, and also the Amora'im, did not want to enter them while it was raining to avoid the rain, only because learning requires clarity [and they could not think clearly in the rain].

והכא מיירי כשחרב דאז מהני התנאי

Here we discuss after they were destroyed. Then, the stipulation helps.

ודווקא לאותן שבבבל מהני התנאי שהרי לעת בא גואל במהרה בימינו תפקע קדושתן

Distinction: The Tenai helps only for those in Bavel. When the redemption will come, soon in our days, their Kedushah will be uprooted;

Question: Since a Tenai helps for those in Bavel, it is difficult above (26b)! Ravina had a [destroyed] Beis ha'Keneses in his land. Rav Ashi told him to buy it from the seven governors of the city;

ואמאי איצטריך לעשות כן אחר שנחרב

Why was this necessary, after it was destroyed?

וי"ל משום דזרעה דזריעה הוי קלות ראש ביותר ועגמת נפש ומשום הכי אסור אפי' בחורבנה.

Answer: It is because he seeded it. Seeding is overly frivolous, and agonizing. Therefore, it is forbidden even after it was destroyed [unless it is sold through the seven governors of the city].

TOSFOS DH v'Af Al Pi Ken Ein Nohagin Bahen Kalos Rosh

פירוש בבנינה שהרי בחורבנה שרי בכל הני

Explanation: This is when they are built. After they are destroyed, everything is permitted.

ואצטריך לאשמועינן משום דסלקא דעתך אמינא דדווקא אכילה ושתיה דהוי קלות ראש ביותר הוא דאסור

We need to hear this, because one might have thought that only eating and drinking, which are overly frivolous, are forbidden;

אבל חשבונות דלא הוי קלות ראש כל כך סלקא דעתך אמינא דשריא קמ"ל דלא.

However, calculations, which are not so frivolous, one might have thought that they are permitted. [R. Asi] teaches that this is not so.

TOSFOS DH she'Afilu Ro'os Tipas Dam k'Chardel Yoshvos Aleha Shivah Nekiyim

תוספות ד"ה שאפילו רואות טפת דם כחרדל יושבות עליה שבעה נקיים

Implied question: In Nidah (40a) we say that even like a mustard seed [or even less] is Tamei! (Why do we call this a stringency of Benos Yisrael?)

דשמא התם לא מיירי להצריכה שבעה נקיים אלא להיות נדה דאורייתא

Answer: Perhaps there we do not require seven clean days [for less than a mustard seed], but she becomes Nidah mid'Oraisa.

וקשיא היאך מצינו טפה כחרדל הגורמת שבעה נקיים בדאורייתא דודאי לא תקנו חכמים דבר דלית דכוותה דאורייתא

Question: Where do we find that a drop like a mustard seed obligates seven clean days mid'Oraisa? Surely, Chachamim did not make a decree unlike anything in Torah!

ויש לומר דאשכחנא בה שפיר בז' לספירתה שסותרת הכל.

(d)

Answer: We find this regarding a drop on her seventh clean day. It destroys her entire count [and obligates counting another seven clean days].
