Explanation: The Tosefes is like the [Ikar] Kesuvah, and she does not collect Shevach (improvements to the property);

אבל אי לא הוי תנאי כתובה ככתובה היתה גובה תוספת מן השבח כמו בעל חוב

However, if Tenai Kesuvah were not like the Kesuvah, she would collect Tosefes from Shevach like a creditor;

דגבי אפי' משבח שהשביחו יתומים ואף על גב דאין להם על מי לחזור והוי כמקבל מתנה

[A creditor] collects even Shevach that orphans made, even though they have no one to go to (for compensation for the Shevach that they lost), and this is like one who received a gift;

דאמרינן בפרק קמא דבבא מציעא (דף טו.) דלא גבי בעל חוב שבח מיניה משום דאין לו על מי לחזור

We say in Bava Metzi'a (15a) that a creditor does not collect Shevach from him (a gift recipient), for he has no to go to (to get compensation).

מכל מקום מן היורשין גבי דלא דמו למקבל מתנה שעליהם מוטל יותר לפרוע חוב אביהם

ii.

Even so, a creditor collects [Shevach] from heirs. They are unlike a gift recipient. It is more obligatory on them to pay their father's debt.

וכן משמע בפרק יש בכור (בכורות דף נא: ושם) דתנן אין הבכור נוטל פי שנים מן השבח ולא האשה בכתובתה ולא הבנות במזונותיהן

Support: In Bechoros (51b), a Mishnah says that a Bechor does not receive a double portion of Shevach, and a woman does not collect her Kesuvah [from Shevach], and daughters do not collect food [from Shevach];

ופריך בגמרא והאמר שמואל בעל חוב גובה את השבח ומשני מקולי כתובה שנו כאן

The Gemara asks that Shmuel taught that a creditor collects Shevach, and answered that this is a leniency (weakness) of Kesuvah.

והתם בשבח שהשביחו יתומים איירי ולא בשבח של לקוחות מדקתני ולא הבנות במזונותיהן

There we discuss Shevach that orphans made, and not of buyers, since it taught "and not daughters for their food";

ואי מלקוחות מאי איריא שבח הא קרקע נמי לא גבו דאין מוציאין למזון הבנות מנכסים משועבדים

If it was of buyers, why does it mention Shevach? Also land they do not collect, for we do not collect food for daughters from sold property!

והא דאמר בהמקבל (ב"מ דף קי. ושם) יתומים אומרים אנו השבחנו ובעל חוב אומר אביכם השביח על מי להביא ראיה

Implied question: It says in Bava Metzi'a (110a) 'if orphans say "we improved [the property]", and the creditor says "your father improved it", who must bring a proof?'

משמע דאי יתומים השביחו לא היה נוטל בעל חוב שבח

Inference: If the orphans improved it, the creditor would not collect the Shevach!

התם מיירי כגון שעשאה אביהן לו אותה קרקע אפותיקי ואמר אם לא אפרעך עד זמן פלוני יהיה קרקע זה קנוי לך מעכשיו דהתם

Answer: There, the father made the land an Apotiki (he stipulated that the loan will be paid from it), and said "if I do not pay you by (a particular) time, the land is acquired to you from now";

ודאי השבח של יתומים דהוי כיורד לתוך שדה חבירו שלא ברשות דשמין לו וידו על התחתונה

Surely the Shevach is of the orphans, for this is like one who goes into another's field without permission [and improved it]. We estimate for him, and he has the lower hand (he receives his expenditures or the improvements, whichever is less).

ותדע דהא קאמר התם דעל היתומים להביא ראיה מאי טעמא דארעא כיון דלגוביינא קיימא כמאן דגביא דמיא

Proof: It says there that the orphans must bring a proof. What is the reason? Since the land is destined to be collected, it is as if it was collected;

ואי דלא עשאה אפותיקי אמאי חשיב לה בחזקת ב"ח אדרבה הויא בחזקת יתמי דהא מצי לסלוקי ליה בזוזי וב"ח ניתי ראיה.

If [the father] did not make the land an Apotiki, why is it considered to be in the Chazakah of the creditor? Just the contrary, it is in the Chazakah of the orphans, for they can dispel the creditor with money (and he gets no land). The creditor should need to bring a proof!

(a)

Question: At the end of Maseches Shevi'is, [Tana'im] argue about money owned to a storeowner or for wages;

דאיכא למ"ד דאין משמטין ור' יוסי פליג ואמר כל מלאכה שפוסקת בשביעית משמטת

One opinion says that they are not Mishtamet (cancelled in Shemitah), and R. Yosi argues and says that any Melachah that ceases in Shevi'is is Mishtamet;

ולדידיה ניחא דה"ה דמשמט הקפת החנות וכל מילי אפילו דלאו הלואה

According to him [our Mishnah] is fine, for also money owned to a storeowner and all matters are Mishtamet, even what are not loans;

ואי לאו דתוספת ככתובה הוי משמט

If Tosefes were not like the Kesuvah, it would be Mishtamet.

אבל לרבנן דאית להו אין משמט אלא מלוה אם כן אפי' אם אין התוספת ככתובה אינו משמט דלאו הלואה היא

However, according to Rabanan, only a loan is Mishtamet. If so, even if Tosefes were not like the Kesuvah, it would not be Mishtamet, for it is not a loan!

ואור"י דלמ"ד בפ"ב דגיטין (יח. ושם) פגמה אף על פי שלא זקפה גבי כתובה דמשמט

Answer (Ri): According to the opinion in Gitin (18a) that if she collected part of the Kesuvah, even though she was not Zokef (to calculate the remainder, or write a document for it), regarding Kesuvah it is Mishtamet;

נפקא מיניה אם פגמה הכתובה הוי כאילו פגמה התוספת

[Tosefes is like the Kesuvah] affects one who collected part of the Kesuvah. It is as if she collected part of the Tosefes (and she must swear to collect the rest);

וכן למ"ד עד שתפגום ותזקוף אם פגמה וזקפה הכתובה כאילו פגמה וזקפה התוספת.

Similarly, according to the opinion [that it is Mishtamet] only if she collected part and was Zokef the Kesuvah, it is as if she collected part and was Zokef the Tosefes.

TOSFOS DH Yasvun Tanan

תוספות ד"ה יסבון תנן

(SUMMARY: Tosfos explains how this opinion can explain the Mishnah on 90a.)

ואם תאמר תקשי ליה מתניתין דמי שהיה נשוי (לקמן דף צ.) דתנן שניה ויורשיה קודמין ליורשי ראשונה

(a)

Question: The Mishnah below (90a) is difficult for him! It says that the second [wife] and her heirs come before the first and her heirs. (One wife died in her husband's lifetime, and the other after his death. Without any enactment, the latter received her Kesuvah when she was widowed, and her heirs inherit her. If there is enough property, also the first's heirs inherit her Kesuvah from her!)

וי"ל דהתם דחי לה לעולם אחת בחייו ואחת במותו אין לה כתובת בנין דכרין ומאי קודמין קודמין לנחלה.

(b)

Answer: There, we reject this. Really, [perhaps] Kesuvas Benin Dichrin does not apply when one wife dies in her husband's lifetime, and the other after his death. "Before" means that they are first to inherit. (We say the first and her heirs for parallel structure with "the second and her heirs." The latter inherit from her, mid'Oraisa!)

(SUMMARY: Tosfos prefers R. Chananel's text.)

כפי' ר"ח דגריס ברישא ייחד לה ארעא בארבע מצרנהא ואח"כ גריס מטלטלי ואיתנהו בעינייהו

(a)

The text: [It seems that] the correct text is like R. Chananel explained. His text initially says "he designated land for her [within] four borders, and afterwards it says "Metaltelim, and they are intact."

והשתא אתי שפיר דלא הזכיר יחוד גבי מטלטלי משום דכבר הזכיר יחוד גבי ארעא ועלה קאי

(b)

Support: This explains why the text does not mention designation regarding Metaltelim, for it already mentioned designation regarding land, and [the case of Metaltelim] refers to it (it contrasts to the law of land mentioned previously).

אבל לספרים דגרסי מטלטלי ואיתנהו בעינייהו ברישא תימה דלא קאמר ייחד לה מטלטלי כיון דלא דיבר כלום ביחוד.

(c)

Question: However, according to texts that mention intact Metaltelim first, this is astounding that it did not say that he designated Metaltelim for her, since [until now] it did not mention designation at all!

TOSFOS DH Kesovu v'Havu Lei Kanu Minei Lo Tzarich Le'imlichei Bei

(SUMMARY: 1. Tosfos gives the reason for this. 2. He brings two opinions about whether it applies to a gift document.)

וה"ה אפי' לא אמר כתובו וחתומו כיון דקנו מיניה לא צריך לאמלוכי ביה

(a)

Explanation: The same applies even if he did not say "write and sign." Since they acquired from him, they need not consult with him;

דסתם קנין לכתיבה עומד כדאמרינן בחזקת הבתים (ב"ב דף מ. ושם)

This is because Stam Kinyan is destined to be written, like it says in Bava Basra (40a).

ולא נקט כתובו וחתומו

(b)

Implied question: [If so,] why does it say "write and sign"?

אלא משום סיפא דאפילו הכי צריך לאמלוכי ביה

Answer: This is due to the Seifa (when they did not acquire from him. Even if he said "write and sign",) even so they must consult with him.

וטעמא כיון דבעין יפה נותן שמקנה לו מיד ואינו רוצה להמתין עד שילך ויזכה בשדה

Explanation: Because he gives generously, he is Makneh to him immediately. He does not want to delay until he goes and acquires the field [through Chazakah]...

יש לנו לומר דייפה כחו נמי לענין כתיבה דסתם קנין שבש"ס היינו קנין חליפין

We should say that he gave to him greater rights also regarding writing, for Stam "Kinyan" in the Gemara is Chalipin. (Maharam Shif - if Stam Kinyan were Chazakah, he was not Makneh until they did Chazakah, so he is not giving to him greater rights!)

Distinction: According to the opinion that Acharayus Lav Ta'os Sofer (if a document does not mention Acharayus, there is no Acharayus), they must consult with him to write Acharayus, like Shmuel says in Bava Metzi'a (14a) "one must consult about Shibud."

אבל למ"ד טעות סופר הוא אין צריך לימלך

However, according to the opinion that Acharayus Ta'os Sofer, they need not consult.

Observation: However, if he wants, he can retract, like it says in Bava Basra (77a) [if David said] "acquire this field for Ploni and write the document for him", David can retract [authorization to write] the document, but he cannot retract [the gift of] the field.

Explanation #1 (Rivam citing Riva): He can retract only regarding a sale document, for he does not want Shibud against him in a document. Through a sale document, [if a creditor took the buyer's land, the buyer] can take property that [the seller] sold [afterwards, to get back the value of what he paid];

אבל במתנה שאין השטר אלא לראיה אף בשטר אינו יכול לחזור דעבדינן תקנתא לרמאה דמוכחא מילתא שרוצה לחזור ממתנה

However, regarding a gift, the document is a mere proof. He cannot retract even [authorization to write] the document. We enact due to swindlers. It is clear that he wants to retract from the gift. (There is no other reason to retract from the document.)

Explanation #2 (R. Tam): Even regarding a gift, he can retract from the document, for he does not want many documents against him. People will think that it is a sale document, which has Shibud, and they will refrain from lending to him;

Also, his property will cheapen when there are rumors that he sold his property, or gave it.

Implied question: A Mishnah (Bava Basra 168a) says that if one's loan document was erased, he comes to Beis Din, and they write for him another document;

Citation (the Reisha of this Mishnah, Demai 4:1): One who buys Peros Demai (i.e. from an Am ha'Aretz, who is suspected not to tithe) from one who is not trustworthy, on Shabbos he asks [the seller, and if he says that he tithed them], and may rely on him to eat them;

חשכה מו"ש לא יאכל עד שיעשר

(b)

Citation (cont.): Once it gets dark on Motza'ei Shabbos, he may not eat until he tithes them.

R. Shimon Shezuri holds that similarly, he fears Terumah. Even though he does not fear the Isur of Tevel, he fears the Isur of Terumah, when one tithed (what he bought from the Am ha'Aretz) and it became mixed with the Peros. (When one tells him that this happened, he would not lie about whether he had tithed what he sold);

ורבנן פליגי עליה בהא אף על גב דלית ליה תקנתא.

Rabanan argue with him about this, even though there is no solution [to permit the mixture to a Yisrael. One must sell them to a Kohen who will eat them like Terumah. Terumah normally sells for about half the price of Chulin. If they became Tamei, there is no solution at all.]

(SUMMARY: Tosfos discusses when the Kinyan depends on the document.)

Explanation #1: It seems that this is only if Kinyan is written in the document. Then Rav considers it like Matanas Bari (a healthy person's gift). He strengthened [the recipient], for he wrote it in the document;

אבל אם כתב כל נכסיו וקנו מידו ולא נכתב הקנין בתוך השטר לא הוי לרב כמתנת בריא ואם עמד חוזר ואם מת קנה כדין מתנת ש"מ

However, if he wrote [to give away] all his property, and Kinyan is not written in the document, Rav does not consider it like Matanas Bari. If he recovered, he can retract. If he died, [the recipient] acquired, like Matanas Shechiv me'Ra;

Citation (146b - Mishnah): If a Shechiv Mera wrote all his property, and left over any amount of land, it is a gift (he cannot retract). If he did not leave over any land, it is not a gift (he can retract).

Rather, it is specifically with a Kinyan, and it taught that if he did not leave over any land, it is not a gift, and if he recovers, he can retract.

Implied question: When we asked the contradiction in Shmuel, we could have asked from the Mishnah there, which says that the gift is not weaker due to the Kinyan!

Answer: We prefer to ask a contradiction in Shmuel. We can answer the Mishnah, that it discusses when he gives to him Yifuy Ko'ach (increased rights), for he wrote "and we acquired from him, in addition to this gift";

We should be concerned lest he intended that the Kinyan finish only through writing and giving the document to the recipient!

He uprooted the power of Matanas Shechiv me'Ra, which acquires through mere words. He wants it to acquire only after death, and then his power lapsed.

Implied question: How do Rav and Shmuel establish our Mishnah, which says that if he did not leave over any land [it is a gift]?

Answer: Both Rav and Shmuel establish it when they acquired from him through Chazakah, which is not destined to be written, [un]like Chalipin;
