TOSFOS DH Kol she'Eino b'Zeh Acher Zeh Afilu b'Bas Achas Eino

(SUMMARY: Tosfos explains why elsewhere both take effect at once.)

(a)

Implied question (Ri): Why is this unlike [one who made an animal] Temuras Olah and Shelamim? Even though this cannot be one after the other (once it is Temuras Olah, it cannot become Temuras Shelamim), it takes effect at once, like it says in Temurah (25b) and Zevachim (30a)!

(b)

Answer (Ri): There, it is possible to fulfill both of them, like it says there. It is Ro'eh (grazes) until it gets a Mum, and is sold (redeemed), and they bring an Olah with half the money, and Shelamim with half the money;

1.

However, here he does not acquire all eight Amos. Which [four] should we give to him?! If he acquires these four, he does not acquire [the other] four!

2.

If one is Mekadesh a woman and her daughter, if Kidushin takes effect on this one, it does not take effect on the other. The same applies to all the cases brought below and in Kidushin (51a).

3.

The same applies to [a husband who said to his wife] "your vow is affirmed and annulled (Nedarim 69a)." (There is no way to fulfill both of these.)

(c)

Answer #2: The Ri gave another reason, but his Perush cannot be resolved with the Gemara in Nedarim.

2)

TOSFOS DH She'ani Ma'aser d'Eisei l'Chatza'in...

(SUMMARY: Tosfos gives two explanations of how it takes effect half-way.)

(a)

Explanation #1 (Rashi): Ma'aser takes effect on of every kernel [of what he designated] according to the calculation proper for Ma'aser. E.g. if he separated a fifth, half of each kernel becomes Kodesh;

1.

However, regarding Shevisah, we cannot say so, for we require four Amos together.

(b)

Question: It asks that Ma'aser Behemah does not apply half-way. Even if it applied half-way, it is difficult for [Rabah], why are the 10th and 11th mixed together?

1.

Based on the reason of half-way, only half of each animal should be Ma'aser, just like Ma'aser of grain, like Rashi explained!

(c)

Answer: Granted, if it applied half-way, there another question would be difficult. In any case, this question, why are both Kadosh at all, we could not ask.

(d)

Explanation #2 (Ri): Ma'aser is different, for if he said "this one Se'ah, half of every wheat kernel should be Ma'aser", and afterwards he said so also about another Se'ah, Ma'aser takes effect on both of them partially;

1.

Since it applies half-way one after the other, also at once Ma'aser should take effect on one Se'ah, and the other should be Tevel.

TOSFOS DH v'Amar Rabah Yatz'u Shenayim b'Asiri v'Chulei

(SUMMARY: Tosfos discusses whether or not Rabah must hold that Efshar Letzamtzem.)

(a)

Question: Perhaps there the reason is because it is impossible to be exact, and one came out first, and even without calling it [Asiri] it is Kadosh, like it says in Bechoros (60b) that the 10th is Kadosh automatically!

(b)

Answer #1: You are forced to say that Rabah holds that Efshar Letzamtzem, that both came out at once, for if Iy Efshar Letzamtzem, and one came out first, he should have said that the 10th and Chulin are mixed together!

1.

Even if he was silent when the 10th left, and afterwards the 11th came out and he called it Asiri, the 11th is not Kadosh at all, for the name Asiri was not uprooted [from the 10th].

(c)

Answer #2: Even if he holds that Iy Efshar Letzamtzem, since one cannot know which came out before the other, and he intended to call both Asiri, both of them are Kadosh. This is unlike one who called the 10th Asiri , and the 11th Asiri;

1.

Here we question [Rabah] from the last (11th), which is Kadosh only due to his words.

(d)

Decision: Explanation #1 seems primary to me.

4)

TOSFOS DH Asiri v'Echad Asar Me'uravin Zeh b'Zeh

(SUMMARY: Tosfos brings Rashi's correction.)

(a)

Correction: Rashi changed the text in his handwritten Perush to say 'both of them graze", because the Matanos of blood are different. Shelamim requires blood on [all] four [sides of the Mizbe'ach; he throws twice, on opposite corners], and Ma'aser requires [only] one. (Therefore, we cannot offer them);

1.

Therefore, they graze, and he profanes onto money the value of the better one, and says "whichever is the Shelamim, it is redeemed onto this money", and he eats both with their blemish like the law of Ma'aser. (One may not slaughter or sell it in the market, and one may not weigh the meat.)

TOSFOS DH u'Mar Savar l'Korban Gadol Mekaven

(SUMMARY: Tosfos explains why we needed to say so.)

(a)

Question (R. Efrayim): Why must we explain that R. Yochanan's reason is because he intends for a big Korban? It should suffice that R. Yochanan holds that Ein Bereirah! He holds that brothers who divide [an inheritance] are like buyers (we cannot say that each received his true inheritance. Rather, they trade their true shares for the portions they take) in Bava Kama (69b).

(b)

Answer (Ri): Bereirah does not apply here. We do not need a clarification, for [if he did not intend to be Mekadesh all of them, 40] would be Kadosh wherever they are in their mixture.

(c)

Question: [We need a clarification, for] he needs four of them (one of each kind of bread, from those that became Kadosh) to give to a Kohen for Terumas Lachmei Todah!

(d)

Answer (Ri): If each [set of 40] is by itself, he can separate four from each 40;

1.

However, if all of them are together, the only solution is to separate 11 from each kind, for each kind has 10 Chulin [loaves] and 10 Kadosh. Then, it is impossible that there is not one of the Kadosh ones (among the 11) that becomes Terumah.
