DAF DISCUSSIONS - MENACHOS 71

Barry Epstein asked:

The Mishnah speaks of the people of Jericho stacking the grain against Rabbinic law and yet they were not reproved. Why was this, given that today it seems one would always be reproved for not following Rabbinic law?

Barry Epstein, Dallas, USA

The Kollel replies:

The Teshuvos Maharit (1:83) actually brings this as an example of the rule that one should not protest against someone who clearly knows the Halachah and decides not to keep it when it is only a Rabinnic transgression, and the rebuke will not accomplish anything.
