DAF DISCUSSIONS - MENACHOS 38

michaeljrubin asks:

Hi,

I am under the impression that there is a shita attributed to brisk based on a baal hamaor not to wear tziztzis in reshus harabim on shabbos because tcheiles is meakev.

Are you aware of this shita? I could not find the baal hamaor. What would the baal hamaor do with the mishna that tcheiles not meakev.

Thank you!

The Kollel replies:

The Ba'al ha'Me'or is found in the second chapter of Maseches Shabbos (12a of the pages of the Rif in the standard editions of the Gemara).

The Ba'al ha'Me'or writes that the Halachah follows the view of Rebbi in Menachos 38a, who maintains that Techeles and white are Me'akev each other. He writes that since the Gemara on 38b tells us that the Tana who disagrees with Rebbi is Rebbi Yitzchak of the Beraisa, this means that the Chachamim of the Mishnah (38a) is in fact Rebbi Yitzchak, which is only an individual opinion, not the majority. So it now becomes Rebbi against Rebbi Yitzchak, and we apply the rule that the Halachah follows Rebbi when he argues with only one other Tana.
