DAF DISCUSSIONS - MAKOS 3

Miles asked:

The Gemmara says that if Shmuel's statement was correct, then the zomimin would have to pay the full $1000. This is proven wrong when the Gemara says "Rava said, 'Here what are we dealing with, one who lends on collateral or one who hands over his documents to the court'"

But if this were true wouldn't the documents state when the loan was due and these witnesses wouldn't be proven wrong through hazama, rather just by checking the documents!?

The Kollel replies:

The document of loan may not have stated explicitly when the loan was due. That date may have been agreed upon orally. (Besides, if the witnesses were made Zomem before the Shtar was produced, the laws of Edim Zomemim would apply to the witnesses.)
