In Masechta Makkos, it's brought down that a person (Ed Zomem) who intends to send a person into a galus is not sent into galus. Rather, He Receives Malkus. The Gemara explains that this offers an explanation with a kal vachomer saying, if a person who kills beshogage without a warning, he receives no din, how much more so aid zomemin who did not even kill. How does the Gemara refute the Kal Vachomer.

The Kollel replies:

The Gemara answers that one who actually accomplishes a Ma'aseh does not go to Galus, for it is insufficient Kaparah for him. However, an Ed Zomem -- who did not actually kill -- perhaps he can get Galus even though his act was done b'Mezid, intentionally.
