IN THE CASE OF MOTZI SHEM RA, THE GEMARA SAYS THAT THE ASEH FOR A PERSON TO BE MACHZIR GRUSHA IN THAT CASE COMES FROM THE WORDS " VLO T'HIYEH L'ISHA" - AND WE DONT NEED ANYTHING TO TELL US ABOUT AN INITIAL REQUIREMENT TO MARRY HER SINCE THE MAN IN THAT CASE IS ALREADY FULLY MARRIED TO HER HAVING DONE BOTH ERUSIN AND NESUIN? HOW THEN DO WE DARSHIN KOL YAMAV?

The Sifra says "Kol Yamav" includes even l'Achar Zeman. The Malbim explains that is refers to even if he was married for ten years without having children from her.
