DAF DISCUSSIONS - BAVA BASRA 159

Barry Epstein asked:

Two questions:

1. Can a firstborn sell his firstborn share to anyone, or only within his class (sons)?

2. Can one sell one's right to his entire inheritance?

Barry Epstein, Dallas, USA

The Kollel replies:

According to Rav Meir (who maintains that one can sell something he does not yet own -- "Adam Makneh Davar she'Lo Ba l'Olam"), anyone can sell his inheritance to anyone else. According to the Chachamim, one generally may not.

Barry Epstein replied:

Thank you for your response. Which of the 2 opinions that you cite is halachah today?

Barry Epstein, Dallas, USA

The Kollel replies:

The second opinion.
