DAF DISCUSSIONS - KESUVOS 87

Steve asked:

When the prospective wife is to be married, how does she know at that time that she will be the administratrix of her husband's estate to tell her husband to "give me in writing that you will impose no oath upon me"?

Steve

Atlanta, GA

The Kollel replies:

This is the question of the Gemara on the opinion (Rav Yehudah in the name of Rav) who says that the Shevu'ah mentioned in the first part of the Mishnah is that of an Apotropos (see Tosfos DH Ela who says clearly that this is the Gemara's question). Indeed, the Gemara does not answer this question. Instead, Rav Ashi says that the statement of Rav Yehudah in the name of Rav is not referring to the Shevu'ah that the woman requests from her husband to exempt her from as mentioned in the beginning of the Mishnah, but rather it is referring to the end of the Mishnah, to Shevu'ah which the Yesomim (heirs) of her husband make her swear, which is clearly discussing the Shevu'ah of an Apotropos (see Rashi DH Anan).
