DAF DISCUSSIONS - KESUVOS 5

ami asks:

what are two lines of halachic reasoning that would permit a couple to consummate on friday night?

what is the prohibition of malacha to make a wound on shabbot?

how do we know a minyan is needed for 7 brachos?

what is Eino Miskavein?

ami, New York, USA

The Kollel replies:

1. The Mishnah Berurah (280:4) states that we do not consider this as bleeding, since the blood does not come out of a wound, rather it is released from a place where it was collected as a pool. There are other reasons given in the Gemara, including Davar sh'Eino Miskavein (see 4 below) and Mekalkel, which means that an act which is destructive rather than constructive is generally not forbidden by the Torah on Shabbos, although it does still remain prohibited mi'd'Rabanan.

2. The prohibition on making a wound on Shabbos, where blood comes out, or gathers under the skin is Chovel, which is a Toldah of Shocheit.

3. We learn from Boaz who gathered together ten men when he married Rus, that Sheva Berachos needs ten people.

4. Eino Miskavein is when an act is done without the intention of doing the Isur. For example if one drags a table across a field that needs ploughing in order to have the table on the other side of the field, even though he knows that this may cause a furrow to be produced, this is Eino Miskavein.
