BERACHOS 30 - Two weeks of study material have been dedicated by Mrs. Estanne Abraham Fawer to honor the Yahrzeit of her father, Rav Mordechai ben Eliezer Zvi (Rabbi Morton Weiner) Z'L, who passed away on 18 Teves 5760. May the merit of supporting and advancing Dafyomi study -- which was so important to him -- during the weeks of his Yahrzeit serve as an Iluy for his Neshamah.

TOSFOS DH V'HEICHI MATZLI LAH

(SUMMARY: Tosfos establishes this with regard to Tefilas ha'Derech and cites a Machlokes regarding the Halachah.)

Clarification: It refers to Tefilas ha'Derech. Rav Sheishes says (that it is permitted) even walking.

Question: Why does the Gemara not give the distinction between them as being that whereas a short Tefilah is confined to a place where there is a Sakanah, 'Havineinu' is not?

וי"ל, דהכי קא בעי 'מאי בינייהו' - כל א' במקומו, תפלה קצרה במקום סכנה, 'והביננו' שלא במקום סכנה.

Answer: When the Gemara asks 'Mai Benaihu', it means when each one is recited in its respective place, a short Tefilah in a place of Sakanah, and 'Havineinu' even in a location where there is not.

Support: And so we conclude in 'Lo Yachpor' (Bava Basra, 25:), where the Gemara says 'You who live in the north of Eretz Yisrael, face the south!'

Explanation #1: Rashi explains that they did so before dawn-break

Refutation: This does not appear right however, because if they did, they would not have been Yotzei at all, seeing as it was not yet day.

לכך נראה כפי' ר"ח - דמשעלה עמוד השחר קאמר, והוו מקדמי קודם הנץ החמה קאמר, ועדיין אינו עיקר זמן תפלה.

(c)

Explanation #2: It therefore seems like the explanation of the Rach, that they Davened after dawn-break, but before sun-rise, which is not the ideal time to Daven Shachris.

TOSFOS DH MESAMECH GE'ULAH LI'TEFILAH ADIF

Extrapolation: This implies that one is permitted to Daven the Amidah on a journey walking, and that it is not necessary to stand still.

Question: Why does this differ from 'Havineinu', by which we concluded earlier that one must stand still?

Answer: 'Havineinu is different, in that it is short, in which case one does not lose so much travel time, as one does by the Amidah.

ועוד פירש הר"ם, דהכא כי הדר לביתיה מצלי מעומד, כדאמרינן בסמוך 'רב אשי מצלי בהדי צבורא ביחיד מיושב כדי לקרות ק"ש בשעתה, וכי הדר לביתי' מצלי מעומד'.

Halachah: Furthermore the Ram explains that here, once he arrives home, he must Daven again standing, as we will say shortly, 'Rav Davened together with the congregation on his own sitting down (as Rashi explains there), in order to recite the Sh'ma in its right time, and when he arrived home, he repeated the Amidah, standing'.

Alternative Halachah: The Rach however, Paskens like the father of Shmuel and Levi.

Refutation: Since Rav Ashi however attests that 'We did not see the venerable Rabbis doing this, it implies that the Halachah is not like them.

Reference to Question: At the beginning of the Perek (Daf 26. DH 'Ta'ah') Tosfos already cited the Kashya 'Why the reason is not because Tefilas Arvis R'shus' ...

Reference to Answer: And they answered that 'That refers specifically with regard to performing another passing Mitzvah instead ... '.

Halachah: Some commentaries confine the ruling that exempts one from repeating the Amidah to the first night, due to the fact that 'One does not declare Rosh Chodesh at night-time. But on the second night, whose sanctity is carried over from the preceding day, he is obligated to say the Amidah again.

Rejection: It does not however seem correct to draw this distinction.

TOSFOS DH MISTABRA MILSA D'RAV B'CHODESH MALEI

Clarification: This means that the previous month was a full one, because then one is able to recite it at the following Ma'ariv, which is the main one.

והיה אומר ה"ר יצחק לכל דבר שאמרו חכמים 'אין מחזירין אותו' כגון 'יעלה ויבא' בערבית, 'ועל הנסים', לא מיבעיא אם עקר רגליו ופתח בברכה שלאחריה דאין מחזירין אותו ...

Halachah: Rabeinu Yitzchak used to say that wherever the Chachamim say 'Ein Machzirin oso', such as 'Ya'aleh Veyavo' at Ma'ariv and 'Al ha'Nisim', not only where one 'has taken three steps back' (i.e., he began the following B'rachah) does one not need to go back ...

Halachah (cont.): But even where he did not 'take three steps back', but merely concluded the appropriate B'rachah, he does not go back either.

Refutation: According to Rabeinu Elchanan however, this does not seem correct, since we see that in Birchas ha'Mazon, both those whom the Chachamim required to go back and those that they did not have the same Din, there where they did mot 'take three steps back' (i.e. begin the following B'rachah) ...

כדאמר לקמן (דף מט:) 'אם שכח של שבת וסיים הברכה כולה, ועדיין לא התחיל בברכת הטוב והמטיב, אומר 'ברוך אשר נתן שבתות למנוחה ... '.

(d)

Proof: Like the Gemara will say later (Daf 49:) 'If someone forgot to mention Shabbos (R'tzei), and concluded the B'rachah, but did not yet begin the B'rachah of 'ha'Tov ve'ha'Meitiv', he recites 'Baruch asher Nasan Shabbasos li'Menuchah' ...

וקאמר נמי התם 'אם טעה ולא הזכיר של ר"ח קודם שעקר רגליו, דהיינו קודם שיתחיל ברכת הטוב והמטיב - דאותה קורא עקר רגליו - אומר 'ברוך אשר נתן ראשי חדשים ... '.

Proof (cont.): Likewise, says the Gemara there, 'If he erred and failed to mention Rosh Chodesh ('Ya'aleh Veyavo') before 'taking three steps back' (i.e. before beginning 'ha'Tov ve'ha'Meditiv', which the Gemara refers to as 'taking three steps back'), he recites 'Baruch asher Nasan Roshei Chodashim ... '.

אלמא, היכא דלא עקר, אלו ואלו שוין.

Proof (cont.): From which we see that there where one did not 'take three steps back' the two cases share the same Halachah ...

ואם עקר רגליו - שהתחיל בברכת הטוב והמטיב של שבת, חוזר לראש, ושל ר"ח מעוות לא יוכל לתקון.

Proof (cont.): Whereas if he has 'taken three steps back', where he already began 'ha'Tov ve'ha'Meitiv', on Shabbos he goes back to the beginning, but on Rosh Chodesh, it is 'a wrongdoing which can be rectified'.

והכי נמי יחזור לאותה ברכה. אם לא התחיל בברכה שלאחריה.

(e)

Conclusion: Here too, he ought to go back to the beginning of the B'rachah, as long as he has not already begun the next one.

ומיהו אין ראיה מהתם, דשאני התם בברכת המזון, שכבר בירך ג' ברכות, וברכת הטוב והמטיב לאו דאורייתא היא; על כן אין מחזירין אותו לגמרי, כי אין דומה שם הפסק כל כך ...

(f)

Rejection #1 (of Refutation): There is no proof from there however, since Birchas ha'Mazon is different, inasmuch as he has already concluded the three B'rachos (d'Oraysa) and the B'rachah of ha'Tov-ve'ha'Meitiv is only de'Rabbanan. Consequently, he does not go back completely, in which case it does not appear so much of a Hefsek (an interruption).

ואין להביא ממנו ראיה לי"ח ברכות, דאם יחזירוהו בדבר שאין לו לחזור, הוי כמו הפסקה.

Refutation #1 (cont): One cannot therefore use that as a precedent for the Amidah, where going back where it is not necessary is akin to a Hefsek.

ועוד, דאין להביא ראיה לכאן, דאם היית אומר היכא שלא עקר רגליו בי"ח ברכות שהיה לו לחזור, א"כ היה צריך לחזור ל'רצה', ואין זה הגון.

(g)

Refutation: #2: Moreover, one cannot bring a proof from there to here, because if we were to say by the Amidah, that there where he has not taken three steps back he would have to go back, that would mean going back to 'R'tzei', and that would not be correct.

ומיהו אומר ר"י דראה את ר"ת דהיכא דלא עקר רגליו, חזר לרצה, אפי' בדברים שאין מחזירין כגון 'על הנסים'.

(h)

Reinstating Initial Refutation: However, the Ri attested to having seen Rabeinu Tam go back to 'R'tzei', there where he did not 'take three steps back', even regarding things for which (after having 'taken three steps back') he would not have needed to go back, such as 'Al ha'Nisim'.

וכן עמא דבר.

Conclusion: And that is the accepted ruling.

TOSFOS DH AL TIKRI BE HADRAS ELA B'CHERDAS

תימה, אמאי לא מוכח בהדיא מדכתיב בתריה "חילו מלפניו כל הארץ"?

(a)

Question: Why is this not evident from the Pasuk that appears later "Chilu (be afraid) mi'Panav Kol ha'Aretz".

וי"ל, היינו קרא דכתיב במזמור "הבו לה' בני אלים", ומההוא קרא בעי להוכיח במסכת מגילה (דף יז:) שאומרים אבות וגבורות וקדושת השם, וי"ח ברכות תקנו כנגד האזכרות.

(b)

Answer: The Pasuk that the Gemara cites ('be'Hadras Kodesh') appears in the same Mizmor (29) as "Havu la'Hashem B'nei Eilim, from which the Gemara in Megilah (17:) derives the B'rachos of Avos, Gevuros and Kedushas Hash-m; Whereas the eighteen B'rachos it learns from the number of Sheimos that appear in the Kapitel.

ומשום הכי דייק מאותו קרא שכתוב באותה פרשה; אבל אותו ד"חילו ... " אינו כתוב באותה פרשה.

(c)

Conclusion: That explains why the Gemara prefers to cite a Pasuk from that Parshah, rather than the Pasuk "Chilu" which is not written in the same Parshah.
