THE INHERITANCE OF SONS, DAUGHTERS AND TUMTUMS (Yerushalmi Halachah 2 Daf 27b)

משנה הניח בנים ובנות וטומטום בזמן שהנכסים מרובין הזכרים דוחין אותו אצל הנקביות

(a)

If a person (passed away and) left behind sons, daughters and a tumtum (a person of unknown gender); when the estate is large, the males push away the tumtum to (be classified as one of) the females (without receiving a portion).

נכנסים מועטין הנקיבות דוחות אותו אצל הזכרים

(b)

If the estate is small, the females push away the tumtum to (be classified as one of) the males (without being sustained from the estate).

האומר אם ילדה אשתי זכר יטל מנה ילדה זכר נוטל מנה

(c)

If a person says, "If my wife gives birth to a boy, he should receive a gift of a mana (100 zuz)"; if she does give birth to a boy, he receives a mana.

ואם נקיבה מאתים, ילדה נקיבה נוטלת מאתים

If he said, "If she will have a girl, she should receive a gift of 2 mana"; if she does give birth to a girl, she receives 2 mana.

אם זכר מנה ואם נקיבה מאתים וילדה זכר ונקיבה הזכר נוטל מנה והנקיבה מאתים ילדה טומטום אינו נוטל

If he said, "If it is a boy, he should receive a mana and if it is a girl, she should receive 2 mana"; if she had twins, a boy and a girl, the boy receives a mana and the girl receives 2 mana. If she had a tumtum, it does not receive anything.

ואם אמר כל מה שתלד אשתי יטול הרי זה יטול ואם אין שם יורש אלא הוא יורש את הכל:

If he said, "Whatever my wife gives birth to, it should receive", it receives. And if it is the only inheritor, it inherits everything.

גמרא תני האומר המבשריני אם ילדה אשתי זכר יטול מאתים ילדה זכר נוטל מאתים. אם נקיבה מנה ילדה נקיבה נוטל מנה. זכר ונקיבה אין לו אלא מנה.

(d)

(Gemara) - Beraisa: If a person says, "The one who informs me that my wife had a boy will receive 200" - if she had a boy, he takes 200. "If it is a girl, he should he receive 100" - if it is a girl, he takes 100. If she had twins - a boy and a girl, he only receives 100.

R. Mana: (In explaining the last case of the Beraisa) - The company of the twin girl reduces the joy of having a boy.
