PATCHES AND THE LAND UNDER A SYCAMORE (Yerushalmi Halachah 8 Daf 14b)

רבי חייה בשם רבי יוחנן יש שם ערוגה שהיא ששה על ששה ויש לה שם בפני עצמה אינה מכורה.

(a)

R. Chiya the Great: (If a person sold a field) if it contained a patch measuring six by six tefachim, it is considered a separate field and is not included in the sale.

אמר רבי יוחנן הקונה סדן שקמה בתוך של חבירו מחלוקת ר' ישמעאל בר רבי יוסי ורבנין

R. Yochanan: If a person buys an older sycamore within his friend's field, it is a dispute between R. Yishmael bar R. Yosi and Rabbanan...

רבי ישמעאל בי רבי יוסי אומר קנה קרקע ורבנין אמרין לא קנה.

R. Yishmael says that he acquires its land (as well) and Rabbanan say that he does not acquire it.

ר' חייה בר ווא שאל מכר לו כל האילן ושייר לו סדן שקמה

(c)

Question (R. Chiya bar Vava): If he sold him all of the trees except an older sycamore, is the land underneath the sycamore also sold or not?

על דעתיה דרבי ישמעאל בי רבי יוסי קנה קרקע על דעתיה דרבנין לא קנה קרקע.

(d)

According to R. Yishmael bei R. Yosi, the buyer acquires it; according to Rabbanan, he does not acquire it.
