SELLING A COURTYARD (Yerushalmi Halachah 4 Daf 13b)

משנה המוכר את החצר מכר בתים שיחין ומערות אבל לא את המטלטלין

(a)

(Mishnah): If a person sold a courtyard, the sale included the houses and different types of pits (inside the houses) but not the movable items.

בזמן שאמר לו הוא וכל מה שבתוכה הרי כולן מכורין

If he told him that he is selling all of its contents, they are all sold.

בין כך ובין כך לא מכר את המרחץ ולא את בית הבד שבתוכה

Either way, he did not sell him the bathhouse or olive press that are inside the courtyard.

ר' לעזר אומר המוכר את החצר לא מכר אלא אוירה של חצר:

R. Elazar: A person who sells a courtyard only sold the airspace of the courtyard itself.

גמרא רבי יצחק שאל על דעתיה דרבנן מכר לו חצר סתם מכר בתים בורות שיחין ומערות אבל לא המטלטלין או מכר לו אפילו המטלטלין.

(Gemara) - question (R. Yitzchak): According to the Rabbanan, if he sold a courtyard without specifying, it includes houses and different types of pits; but does it include movables?

Question #2 (R. Yitzchak): According to R. Elazar, if he sold him a courtyard, he only sold the airspace of the courtyard. When he said "it, and everything in it", the sale includes houses and types of pits, but does it include movables?

אמר רבי יוחנן ואנא אייתיתיה מדבית לוי היו שם (חצירות)[חנויות] פתוחות לפנים מכורות פתוחות לחוץ אין מכורות לפנים ולחוץ אילו ואילו מכורות:

Answer (R. Yochanan): I will answer it using a Beraisa from the House of Levi - (If a person sold a courtyard,) if there were shops that opened inwards (selling only to the courtyard's residents), they are sold; if they opened outwards (selling only to the public), they are not sold. If they opened inwards and outwards, they are viewed as if they opened only inwards and they are sold. (This seemingly answers R. Yitzchak's first question - our Mishnah does not mention that shops are included at all in the sale of a courtyard. Therefore, the Beraisa must be referring to selling 'a courtyard and its contents'. So if he does not acquire the shops that open outwards, he certainly does not acquire the movables.) (Note: The text here was corrected according to the Tosefta Bava Basra 3:2.)
