AN OVERHANGING TREE (Yerushalmi Halachah 11 Daf 7a)

משנה אילן שהוא נוטה לתוך שדה חבירו קוצץ מלא מרדע ע"ג המחרישה החרוב והשקמה כנגד המשקולת

(a)

(Mishnah): If a tree overhangs into a neighbor's field, he may cut any branches that hang within the height of the rod above a plough. For a carob or sycamore tree, he may cut all of the foliage that has crossed into his field.

בית השלחין וכל האילן כנגד המשקולת

For an irrigated field, he may cut all of the foliage of any tree that crossed into his field.

אבא שאול אומר כל אילן סרק כנגד המשקולת

Aba Shaul: He may cut all of the foliage of any non-fruit bearing tree.

אילן שהוא נוטה לר"ה קוצץ כדי שיהא הגמל עובר ברוכבו

(d)

If a tree is overhanging into a public domain, one may cut enough foliage so that a camel can pass with its rider.

ר' יהודה אומר טעון פשתן או זמורות

R. Yehudah: A camel that is loaded with flax or vine branches.

ר' שמעון אומר כל האילן כנגד המשקולת מפני הטומאה

R. Shimon: For any tree in a public domain, one may cut all of its foliage, because of the tumah (that can be transferred through it. If there is even a small part of a corpse under the tree and someone passes by, he becomes tameh because the tree acts as a tent.)

גמרא רבי יונתן הוה דאין טבאות והוה תמן חד רומיי והוה מגיריה בחקלא ובביתא. והוה לר' יונתן חד אילן נטה גו דהוא רומיי.

(Gemara): R. Yonasan was a Dayan who provided an excellent example of correct behavior. There was a Roman who was his neighbor in the field and at home. R. Yonasan had a tree that overhung into the Roman's property.

אתא קומי חד דיין אכן. אמר לון אזלון ותון בצפרא. אמר ההוא רומייה בגיני לא נפק דינא למחר אנא מבטל אילו מדידי וחמי היאך דינא נפק אין הוה דאין כל עמא ולא דאין נפשי' לית הוא בר נש.

A similar case came before him in court. Before he made his ruling, he told them, "Go (home) and come back in the morning." When the Roman heard about this, he said to himself, "It was because of me that he didn't make his ruling. Tomorrow, I will go and cut his branches that overhang into my field and I'll see how he will rule; if he tells the tree-owner to cut his branches, I will show everyone that he does not fulfill his own rulings".

באפתי רמשא שלח רבי יונתן בתר נגריה אמר פוק קוץ מה דנטה גו רומייה.

Towards evening, R. Yonasan sent for his woodcutter and told him to cut the overhanging foliage.

בצפרא קרץ בעל דיניה לגביה א"ל זיל קוץ מה דנטו גו דידיה א"ל רומייה דידך מה.

In the morning, the litigant came to R. Yonasan (for his ruling) and R. Yonasan told him, "Go and cut your overhanging foliage". The Roman said to him, "And what about yours?"

א"ל פוק חמי יתיה כמה דידי עבד דידיך. נפק חמיתיה אמר בריך אלההון דיהודאי.

R. Yonasan replied, "Go and see if my foliage is in your field". The Roman went out and saw what had been done and he exclaimed, "Blessed is the G-d of the Jews!"

חדא איתא אוקרית תאנין לרבי יונתן אמר לה בבעו מינך אי אעילתינון מיגליין אפקינון מיגליין. ואין אעילתינון מיכסיין אפקינון מיכסיין דלא יימרון ברייתא דינרין יהבת ליה ואוקרה תאינין.

Once, a woman who had a court case before R. Yonasan brought him figs as a gift. He told her, "Please remove those figs from here. If you brought them in uncovered, take them out uncovered; if you brought them in covered, take them out covered. Otherwise people will say that you brought me money (as a bribe) and camouflaged them with figs."

רבי חנינה אעיל לרבי יונתן בגינתיה ואייבליה תאנין מדנפק חמא חד אילין דברת שובעין חיוורין.

R. Chaninah went into R. Yonasan's vegetable garden to see him and R. Yonasan brought him figs to eat. When R. Chaninah was leaving, R. Yonasan saw that R. Chaninah had not eaten the figs, despite the fact that they were high quality figs called Bnos Sheva figs.

אמר ליה למה לא אוכלתני מן אילין א"ל דאינון לברי'. רבי חנינה חשש משום גזל בנו.

R. Yonasan asked him why he had not eaten. R. Chaninah answered that those figs belonged to R. Yonasan's son, as R. Chaninah was concerned for theft from a person's own son.
