TOSFOS DH Kablan Amrei Lah Eino Me'id

(SUMMARY: Tosfos discusses why he wants the borrower to keep the land.)

(a)

Explanation: This is even if he has other land.

(b)

Question #1: (Why can't he testify?) What difference does it make to him? If the lender will take the Kablan's property, the Kablan takes from the borrower, since [we discuss when the borrower] has other land!

1.

Suggestion: The Kablan has Beinonis, and also the field he wants to testify about is Beinonis, but the borrower's other land is Ziburis;

i.

He will lose when the lender takes his (the Kablan's property), and [the Kablan] will be able to get back only Ziburis.

2.

Rejection #1: If so, also the lender may not testify for the borrower, even if [the borrower] has other land, in such a case!

3.

Rejection #2: [The Beraisa] connotes that in every case he may not testify. It does not distinguish whether the land is Beinonis or Ziburis.

4.

Rejection #3: In Gitin (49b), it seems that it is proven there that if the borrower has only Ziburis, also the Kablan gives only Ziburis!

(c)

Answer: The reason a Kablan may not testify for the borrower, even if [the borrower] has other land, is because it is a toil for him to go to Din with him;

1.

When the borrower has many lands, the lender will not collect from the Kablan, since he can easily collect from the borrower.

(d)

Possibility #1: However, the lender may testify for the borrower in every case, even if what he testifies about is Beinonis and the other [land of the borrower] is Ziburis, because he would not testify falsely due to getting Beinonis in place of Ziburis, for in any case it is worth the same.

(e)

Possibility #2: "Another land" in our entire Sugya means similar quality land.

2)

TOSFOS DH Hachi Garsinan Kegon deka'Amar Befaneinu Hodeh

(SUMMARY: Tosfos explains why this applies to admission, but not when there are witnesses.)

(a)

Explanation: The son of the sharecropper, craftsman or Gazlan [says "he admitted in front of me."] Therefore, a craftsman has no Chazakah, but his son has a Chazakah, when he claims "in front of me, you admitted to my father that you sold it to him";

1.

He is believed through a Migo, that if he wanted, he could have said "I bought it from you."

(b)

Distinction: However, a Gazlan's son has no Chazakah, for the admission that he admitted to the Gazlan is not an admission, for had [the original owner] not admitted to [the generation] that he sold it to him, [the Gazlan] would have taken him and his donkey to the king's officer [for conscription].

(c)

Assertion: The text does not say "e.g. witnesses say."

(d)

Proof #1: If there are witnesses that he admitted to him that he bought it from him, a craftsman and sharecropper themselves would be believed!

(e)

Proof #2: Since there are witnesses, why must the son of a sharecropper or craftsman make Chazakah? Even without Chazakah, we should establish it with him, for there are witnesses! R. Tam said so.

3)

TOSFOS DH Pa'amim she'Ben Ben Gazlan...

(SUMMARY: Tosfos discusses why we do not claim for the Gazlan's grandson.)

(a)

Question (Ri): Why doesn't he have a Chazakah? We claim for an heir. He should have said "perhaps if his father was alive, i.e. the Gazlan's son, he would have said "I later bought the stolen land from you!"

(b)

Answer #1 (Ri): The text says "sometimes a Gazlan's son has a Chazakah, e.g. when he comes with a claim based on his father's father, i.e. the Gazlan's father;

1.

The Chidush is, even though it was in the hand of someone who has no Chazakah, i.e. his father, the Gazlan, in any case he (his son) has a Chazakah, since he says that it was his grandfather's.

(c)

Answer #2: We can defend the first text "sometimes a Gazlan's grandson has no Chazakah." It means that the case is, he comes with a claim based on his father's father, and says that his father, the Gazlan's son, told him that his father, the Gazlan, left (bequeathed) it to him

1.

If [the Gazlan's son] later bought it from [the original owner], he would have told him "I bought it"!

(d)

Answer #3 (Ri): We do not claim for an heir such a matter, which is not common.

(e)

Support: This is like below (70b), we do not claim for orphans "Ones occurred" because it is not common.

(f)

Implied question: It says above that a Gazlan's grandson and a craftsman's son has a Chazakah!

(g)

Answer: This is only because he says "in front of us, he admitted."

(h)

Support: Just the contrary, from there we can prove that if not for this [admission], he has no Chazakah, since initially it came to him due to his craft, sharecropping or theft.

4)

TOSFOS DH Yarad me'Umnaso Yesh Lo Chazakah

(SUMMARY: Tosfos brings two opinions about Kelim he received while he was a craftsman.)

(a)

Explanation #1: We can explain that [he has a Chazakah] in those Kelim that he gave to him after he ceased his trade, similar to a sharecropper who ceased sharecropping.

(b)

Explanation #2: [He has a Chazakah] even in those Kelim that he gave to him when he was still a craftsman. This is if he delayed after [ceasing] his trade as long as it is normal to return to the owner.

(c)

Assertion: Also a craftsman's son, whom we said above has a Chazakah when he says "in front of us, he admitted", this is when he delayed after his father died;

1.

If not, it seems that he would not be believed through a Migo, that if he wanted, he could have said "I bought it", for also if he claimed "I bought it from you", he would not be believed!

47b----------------------------------------47b

5)

TOSFOS DH Megureshes v'Einah Megureshes Ba'alah Chayav bi'Mzonoseha

(SUMMARY: Tosfos explains that this is when he designated for her another land.)

(a)

Explanation: The case is, he designated for her another land. If not, she has no Chazakah, for since she is entitled to food, she was eating her food (it is no proof that she owns it), like we say below.

6)

TOSFOS DH Re'ayasan Re'ayah u'Ma'amidin Sadeh b'Yadan

(SUMMARY: Tosfos explains why it needed to say both of these.)

(a)

Explanation (Rashba): It mentions both of these (his proof is valid, and we establish the field with him) because it needed to teach about a Gazlan that his proof is invalid and we do not establish the field with him;

1.

There, both are needed. Had it taught only that his proof is invalid, one might have thought that it is not a proof so that we will establish the field with him, but he gets [back] the money he paid;

i.

We would not say the reason "had he not admitted to him, he would have taken him and his donkey to the king's officer." Rather, we would say that it is because if they hung someone and he sold, it is not a sale, and even if he counted the money.

ii.

Therefore, it says both of these. His proof is totally invalid, and he does not get even money. The reason is, "had he not admitted to him..."

(b)

Explanation (Rashba): "All of them" refers also to a son who did not separate [from his father] and a woman who was not divorced.

(c)

Implied question: It says below (55b) regarding a woman in her husband's property "[he said that he sells it to her] to get her to reveal the coins" [that she took from him, and take them back]!

(d)

Answer #1: Since we establish this when he admitted, revealing coins does not apply.

(e)

Answer #2: It connotes below that Rav Huna and Rav Nachman do not say [that he sold merely] to reveal coins.

7)

TOSFOS DH u'Ma'amidin Sadeh b'Yadan

(SUMMARY: Tosfos explains how a field applies to a craftsman.)

(a)

Explanation: A field applies also to a craftsman, e.g. if he is a builder.

8)

TOSFOS DH Aval bi'Shtar Kanah

(SUMMARY: Tosfos resolves Rav's opinion with the Beraisa in Kesuvos.)

(a)

Explanation: This applies also to one who bought from the husband, and afterwards bought from his wife, like is proven from our Mishnah in Gitin (58b).

(b)

Question: A Beraisa in Kesuvos (95a) teaches that if he wrote [a sale document] to one buyer, and she did not sign for him, and he wrote to a second [buyer], and she signed for him, she forfeited [her lien on it for] her Kesuvah.

1.

Inference: This is only because she did not sign for the first. However, if she signed for the first, she did not forfeit her Kesuvah, like is proven there, even if she wrote a document!

(c)

Answer #1 (Ri): We establish Rav's teaching that with a document he acquired, to discuss a document of proof after the Kinyan. Since she made a document after the Kinyan to improve his rights so much, he acquired;

1.

The case in Kesuvos discusses a gift document without another Kinyan, only the document.

(d)

Answer #2: There, "Chasmah" is an expression of finishing, like "Chasmu" regarding the Toref of Gitin (the part that changes from Get to Get, e.g. the names, the date...), and "the Torah was given Chasumah", in Gitin (60a).

1.

I.e. she completed the sale and consented verbally.

(e)

Answer #3: She truly signed, in her husband's document. Rav says that through a document he acquired when she made a sale document in her name.

(f)

Answer #4: Presumably, Rav's reason is like Shmuel, who said in Gitin (58a) "even with a document, he acquired only if she wrote for him Acharayus." (We explain like Maharam. Rav and Shmuel argue about a document that does not mention Acharayus);

1.

Shmuel holds like he taught in Bava Metzi'a (14a) that Acharayos is not Ta'us Sofer (if a document does not mention Acharayos, there is no Acharayos. We do not say that the scribe forgot to write it) in documents of sale. Rav holds that Acharayos Ta'us Sofer.

(g)

Question: Below (48a), we challenge Rav Huna, who says "if they hung someone and he sold, it is a sale" from Shmuel's teaching "even with a document, he did not acquire";

1.

If it depends on Acharayus, why is it difficult for him from Shmuel more than from Rav?

9)

TOSFOS DH v'Rav Bivi Mesayem Bah v'Chulei

(SUMMARY: Tosfos questions this expression.)

(a)

Question: The wording is difficult. (Rav Bivi cites Rav Nachman, who cited Rav Huna. "Mesayem Bah" connotes that he agrees to the teaching, and adds to it, that the Gazlan gets back his money.) Rav Bivi argues (with Rav Huna), like we say below (48a)!

1.

Also Rav Huna does not discuss this (when we know that the Gazlan paid), rather, admission, but not one who counted [the money]!
