IF AN IDOLATER HIRED A JEWISH LABORER (Yerushalmi Halachah 1 Daf 31a)

משנה השוכר את הפועל לעשות עמו ביין נסך שכרו אסור

(a)

(Mishnah): If an idolater hired a Jewish laborer to work with him with Yayin Nesech, his wages are prohibited.

שכרו לעשות עמו מלאכה אחרת אע"פ שאמרו לו העבר לי חבית של יין נסך ממקום למקום שכרו מותר:

If he hired him to do other work, then even if he told the Jew, "Move that barrel (of Yayin Nesech) from one place to another", his wages are permitted.

גמרא ולא שכרו הוא נותן לו.

(c)

Question: Isn't he being given the wages (in (a))? (Wages are considered money of items with which one may not gain benefit, which are actually themselves permitted for him to keep?)

רבי אבהו בשם רבי יוחנן קנס קנסוהו.

(d)

Answer (R. Abahu citing R. Yochanan): They enacted a penalty to prohibit even such wages (due to the stringency of Yayin Nesech).

תני החמרים והכתפים וכל העושין בשביעית שכרן שביעית

Beraisa: Donkey drivers and carriers and all who do labor with Sheviis produce - their wages have the sanctity of Sheviis.

אמר ר' זעירא פירות היתר היא מתניתא וההיא דהורי רבי יוחנן לאילין דבית רבי ינאי שלא יהו נוטלין שכר בידיהן (יין) [שמן] אלא מעות כרבי יהודה וכרבי נחמיה הורי להון .

(R. Zeira): The Beraisa is referring to produce that was properly treated (by declaring it ownerless, and it can now be used to pay the workers). And this that R. Yochanan ruled to the workers in R. Yannai's house (who worked in an oil press that was pressing Sheviis olives) that they may not accept the payment from the oil (even as a gift); rather, they must be paid with money - his instruction was according to R. Yehuda and R. Nechemiah who are stringent, because they consider it like paying off a debt with Sheviis produce. (However, the Halacha follows the Tana Kama there, in Maseches Sheviis, who permits it.)

אמר רבי יילי בפירות (ע"א)[עבירה] היא מתניתא כדמר רבי אבהו בשם רבי יוחנן ביין נסך קנס קנסוהו.

(R. Yayli): The Beraisa is referring to when they worked with prohibited Sheviis produce (such as aftergrowths, which may not be collected and marketed); and when the Baraisa taught that their payment takes on the sanctity of Sheviis, it follows that which R. Abahu explained from R. Yochanan (above (d)), that they enacted a penalty to prohibit even such wages (due to the stringency of Yayin Nesech).
